MINUTES OF A MEETING OF THE FRIENDSWOOD
ZONING BOARD OF ADJUSTMENT
May 3 , 1983
The Board of Adjustment met in a regular meeting , 7 : 00 p .m . ,
on Tuesday, May 3 , 1983 , in the Mayor ' s. office with the
following present :
Chairman , Ed Dykes Nick Capiano , Bldg . Inspector
Harold Whitaker Bobbie Henry , Secretary
.Ray Nelson Terry Maeker , Asst . Secretary
Hal Taylor
With a quorum present , the following business was transacted :
Acknowledgement by Board of letter from chairman of the
Community Appearance Board .
Unanimous consent of the members to approve the minutes
without being read .
REQUEST BY ROBERT ZWICK FOR VARIANCE FROM THE SIGN ORDINANCE
Robert Zwick , owner of Z ' s Shoe Repair , at Captains Corner ,
requested . a variance from the sign ordinance regarding the
total amount of square feet for wall sign area . He was re-
questing a total of 61 sq . ft . including an additional sign
for the rear of the building .
MOTION : ( Ed Dykes ) To grant a variance from the sign ordinance
to Robert Zwick , allowing him the additional
sign for a total of 61 sq . ft .
SECOND : (Harold Whitaker)
VOTE : Unanimous FOR
REQUEST BY CHARLES SMITH FOR A VARIANCE FROM ZONING ORDINANCE .
A drawing was presented by Mrs . Charles Smith , 134 Cherry Tree
Lane , regarding 25. ft . set-back from rear property line . A
building permit had been issued in error oby Nick Capiano . Upon
this error being called to his attention by neighbors of Mrs .
Smith who objected to the building of the proposed addition , the
building permit was rescinded by Mr-. Capiano . Mrs . Smith was
then directed to the Board of Adjustment for a hearing . Mrs .
Smith was told that the Board didn ' t agree with her that a
variance should be granted which would allow the addition to
place her home 20 ft . from the property line .
MOTION : ( Ray Nelson.) To grant a variance
MOTION FAILED FOR LACK OF SECOND

REQUEST BY RALPH LOWE FOR A VARIANCE FROM THE ZONING ORDINANCE
Mr . Lowe was told by the Board of Adjustment that no variance
was necessary because he was within the ordinance regarding
his home that is being built on FM 528 .
MOTION : ( Harold' Whitaker) The owner has the prerogative to
designate Clear Creek as the rear of his property , thus making
the side in question the side set-back. Therefore no variance
is necessary provided that the building inspector determines
the foundation is at least 10 ft . from the property line .
SECOND: (Ray Nelson )
VOTE : Unanimous
REQUEST BY BURGER KING FOR A VARIANCE FROM THE SIGN ORDINANCE
In addition to a standard building sign , 72 sq , ft. , request
was made by Burger King for a 10 ' by 10 ' . 15 ' high temporary
free standing sign for one year to be replaced by a 4 ' by 4 '
monument sign .
MOTION : ( Hal Taylor ) To grant the variance for the sign for
six months .
SECOND : ( Harold Whitaker)
VOTE : Unanimous FOR
REQUEST FOR VARIANCE ON. ROADWAY BY DICKIE ARNDT
Dickie Arndt , upon request from Planning & Zoning , asked for
a variance on a street ROW and an existing pre-school .
MOTION : ( Hal Taylor ) If P&Z approves Development , the Board
will *grant a variance -based on 5 ' set-back
from roadway to side of structure .
SECOND : ( Harold Whitaker)
VOTE : Unanimous FOR
ADJOURNMENT- Motion was made that the meeting adjourn. The
meeting was adjourned .
