July 12, 1977
SUBJECT: Request of Dr. C. Boone to build "Cluster Hdmes" on
11 .61 acres as described in attached letter of June 20,
1977.

The meeting was opened at 7:40 p.m. by Bruce Foster. Dr. Boone
did not put in his appearance until about 7:45 p.m. .
Bruce Foster read a letter from Dr. Boone. Legal opinion was given
by Mr. Olsen, the attorney, that because property in question is
now zoned part R-1 and part C-1 , the Board of Adjustment has no
authority to act on Dr. Boone's request.
George Rummel explained that he had received a telephone call
from Mr. Ken Fossler, of the Planning and Zoning Commission. There
is a new zoning law, now under consideration by the Friendswood City
Council . Included in this new law the area in question is proposed
to be zoned C-3, which is a new "cluster" type construction of a
combination apartment and condominium home. This is the type
construction planned by Dr. Boone.
There were a total of 14 adults present in addition to the Board
and Dr. Boone. These people said they lived adjacent to the property
under consideration. A showing of hands of this group, eleven (11 )
were against the project, three (3) had no opinion. A Marvin Clark,
1102 Briar Meadow, acted as spokesman for this group. He gave the
following reasons for their objection:
1 . There is an elementary school nearby with a portion of the
street marked off for children, pedestrian and bicycle
traffic. The increased people using this road, if project
was built (55 famild!es) , would present a hazard.
2. The sewer system would be overtaxed as well as the water
system.
3. Everyone in the area had purchased their lots of one (1 )
or more acres each to get away from high density housing.
Mr. Vandiver questioned the need for multi-family homes in Friendswood.
Dr. Boone pointed out that his project had not been rejected by the
Planning and Zoning Commission and that the City Council was now
considering the R-3 zone for this land. He said the plat calls for
all 55 units to be built on 3.5 or 4 acres, the rest of the 11 .61
acres would be left green for recreation.
MOTION: (Ed. Dykes) made a motion that no action be taken by
the Board of Adjustment in light of the attorney's
opinion that we had no jurisdiction.

Vote: Unanimous FOR MOTION CARRIED
(Dr. Boone left meeting before vote was taken. )
The meeting was adjourned at 8:15 p.m.
