BOARD OF ADJUSTMENT

MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT
OF THE CITY OF FRIENDSWOOD WHICH WAS HELD AT CITY HALL ON
- JUNE 28 , 1988 WITH THE FOLLOWING MEMBERS CONSTITUTING A QUORUM:
CHAIRMAN WILLIAM TAYLOR
REGULAR MEMBER MAURICE ESTLINBAUM
REGULAR MEMBER STEVE JOHNSON '
REGULAR MEMBER MARY ELLEN BELLARD
ALTERNATE MEMBER DAVID O 'BRIEN,III
BUILDING INSPECTOR NICK CAPUANO
ASSISTANT TO CITY SECRETARY JANE TOLLETT
CHAIRMAN TAYLOR CALLED THE MEETING TO ORDER.
CHAIRMAN TAYLOR CALLED FOR PUBLIC INPUT REGARDING REQUEST FROM
ORLANDO ROSAS AT THE LOCATION OF 15706 EDENVALE, WEDGEWOOD
. VILLAGE SUBDIVISION SEEKING VARIANCE OF 4 FOOT. SIDE SETBACK TO
EXISTING TREEHOUSE.
MR. ROSAS STATED HE HAS BUILT A TREEHOUSE IN THE SOUTHWEST CORNER
OF HIS BACKYARD , 16 .FEET HIGH AND 4 FEET DEEP . HE DID NOT KNOW
OF ANY ORDINANCES THAT HE HAD TO FOLLOW AND AS SOON AS HE
I RECEIVED A LETTER FROM THE BUILDING DEPARTMENT STATING THAT HE
DID NEED PERMITS , HE STOPPED CONSTRUCTION WHICH WAS IN JANUARY OF
1988 . DISCUSSION FOLLOWED AT LENGTH.
JANE TOLLETT, ASSISTANT TO THE CITY SECRETARY, READ INTO THE
MINUTES A LETTER ' FROM GLORIA WEIDNER , 15707 WANDERING TRAIL,
STATING THAT SHE WAS AGAINST THE VARIANCE BECAUSE ' OF THE
CLOSENESS OF THE TREEHOUSE AND THE EXTREME HEIGHT.
CHAIRMAN TAYLOR CALLED FOR PUBLIC INPUT REGARDING REQUEST FROM
GREG RAPP , REPRESENTING RICHARD ASHLEY, AT THE LOCATION OF 411
FIELDCREEK DRIVE, F'IELDCREEK FOREST SUBDIVISION', SEEKING VARIANCE
OF 5 FOOT REAR SETBACK TO BUILD A PORCH.
MR . RAPP STATED THAT NICK CAPUANO , BUILDING INSPECTOR, HAD
APPROVED THE PLANS FOR THE HOME TO BE BUILT BUT NOT THE PORCH
.AREA BECAUSE THE PLANS FOR THE PORCH EXTENDED _ INTO THE -REAR
SETBACK FIVE FEET AND HE REALIZED IT WOULD REQUIRE A VARIANCE
FROM THE BOARD OF ADJUSTMENT. THE HOME IS QUITE LARGE AND ODD
SHAPED AND THE PATIO AREA WILL EXTEND TWENTY FEET BACK. WHICH WILL
BE COVERED . DISCUSSION FOLLOWED .
**MARY ELLEN BELLARD MADE THE MOTION TO DENY THE VARIANCE AT
1570-6 EDENVALE.
MAURICE ESTLINBAUM SECONDED THE MOTION. THE MOTION WAS
UNANIMOUS . •

**STEVE JOHNSON MADE THE MOTION TO APPROVED THE VARIANCE AT 411
FIELD.CREEK DRIVE •REGARDING 5 FOOT REAR SETBACK TO BUILD A PORCH.
MAURICE ESTLINBAUM SECONDED THE MOTION. MOTION APPROVED .
UNANIMOUSLY.
THE MINUTES WERE APPROVED AS PRESENTED FROM REGULAR MEETING 'S OF -
APRIL 26 , 1988 AND MAY 24 , 1988 .
CHAIRMAN TAYLOR READ- THE MEMO FROM CITY- ATTORNEY, JOHN OLSON-,
;REGARDING OPINION/DEFINITION OF "HARDSHIP" CASES WHICH- STATED : "A
:CIRCUMSTANCE-_:=WHICH IS NOT SELF-IMPOSED AND WHICH RESULTS IN THE -
--INABILITY OF THE PROPERTY OWNER .TO ENJOY A- REASONABLE USE OF THE
LAND" . DISCUSS•ION FOLLOWED WITH THE BOARD DECIDING THAT ==:NICK .
CAPUANO- PRESENT A COPY . OF WHAT CONSTITUTES A- HARDSHIP - TO ALL
APP-LICA-N_TS OF BOARD OF ADJUSTMENT. -

CHAIRMAN TAYLOR STATED THE MAYOR HAS REQUESTED. THE ZONING BOARD
OF ADJUSTMENT TAKE ON THE ADDED RESPONSIBILITY AS "FLOOD
•
ORDINANCE APPEALS BOARD" . HE RECOMMENDED THE BOARD TAKE ON THE
POSITION BECAUSE IT "DOES . RELATE TO WHAT THE. BOARD OF ADJUSTMENT' S
JOB IS . THE ENTIRE BOARD DECIDED TO ACCEPT THE POSITION AND THE
SECRETARY TO THE BOARD WILL WRITE A MEMO TO THE MAYOR AND COUNCIL
ACCEPTING THE POSITION.
THE- MEETING ADJOURNED AT 8 : 00 PM. CHAIRMAN TAYLOR EXTENDED AN
INVITATION TO THE BOARD TO ATTEND "MCDONALD ' S" GRAND OPENING.
