With a quorum present, the one request before the Board was pre-
sented:
Blaine Ballard, Great American Homes , asked for a variance on
side yard set-backs for Lots 11 through 18 in Block 1, Section II
of Regency Estates . He explained that from the first building in
Regency the set-backs quoted in the deed restrictions have been
used. This is less than the City' s set-backs . Recently this error
was discovered by the Building Inspector and they have been ordered
to honor the greater set-back. Ballard said they now have contracts
on the above lots and the plans will not. allow for the new set-backs .
Mayor Lowe , who was present , explained that the City is now negotiat-
ing with Great American Homes for property off the back of several
of their lots along F.M. 528 which is necessary for straightening
the dangerous curve along the highway. He said there is also ,a _
proposal to exchange some land with Great American Homes to build a
swimming pool to be dedicated to the Homeowners Association. Mayor
Lowe asked _tha.t the Board take into consideration these negotiations
and the advantages to the City in making their decision.
