CHAIRMAN DYKES CALLED TO ORDER A PUBLIC HEARING FOR THE PURP OF RECEIVING TESTIMONY FROM ANY INTERESTED PERSONS REGARD ING OS OS E E REQUEST FROM CHARLES MALTESE FOR A VARIANCE OF LOT SIZE LOCATED AT 5129 WHITTIER OAKS DRIVE IN WEDGEWOOD VILLAGE SUBDIVISION. JERRY CARPENTER WITH SOUTHWEST CONSTRUCTORS 'SPOKE FOR MR. CHARLES MALTESE. SHE PRESENTED A SURVEY AND ARCHITECTURAL PLANS. DISCUSSION FOLLOWED. CHAIRMAN DYKES ASKED FOR INPUT FROM INTERESTED PERSONS REGARDING REQUEST OF A VARIANCE. BY DAN LONG OF DAN LONG CUSTOM HOMES, INC. TO REQUEST PERMISSION TO FACE PROPOSED RESIDENCE LOCATED AT 5103 WHITTIER OAKS DRIVE TOWARDS BLACKHAWK BLVD. , INSTEAD OF WHITTIER OAKS DRIVE. DAN LONG SUBMITTED ' PLANS AND STATED THAT THE OWNERS WANT A CIRCULAR DRIVEWAY. MANY OTHER HOMES FACE BLACKHAWK. HE IS RI QUESTING A 25 FOOT SIDE SETBACK ON EACH STREET AND A 17 FOOT SET BACK IN THE BACK OF THE PROPERTY. MR. AND MRS. DIXON SPOKE IN OPPOSITION TO HIS REQUEST AND THAT THE BUILDING RESTRICTIONS OF WEDGEWOOD VILLAGE SUBDIVISION WERE AGAINST IT ALSO. DAN LONG PRESENTED PHOTOS OF PROPERTY'WHICH SHOWED THE FORMS AS BEING ALREADY BUILT. CHAIRMAN DYKES CALLED FOR INPUT REGARDING REQUEST FROM DAN .LONG DAN LONG CUSTOM HOMES, INC. , TO REQUEST A VARIANCE AT 4211 I'(:Ui1lES FOREST ROAD IN FOREST CREEK SUBDIVISION. THIS IS A 60X110 LOT AND HE STATED THERE IS NO HOME PLANNED FOR IT NOW. 't?Rr�'HA SMITH AND QWEN CHESTER ASKED WHAT TYPE OF HOME WOULD BE BUIL ,T ON THIS LOT AND DAN LONG SAID IT WOULD FOLLOW IN LINE WITH THE OTHER HOMES IN THE AREA. THEY HAD NO OBJECTIONS. MOTION WAS MADE BY HAL TAYLOR TO APPROVE THE VARIANCE- BY CHARLES MALTESE OF LOT SIZE LOCATED AT 5129 WHITTIER OAKS DRIVE IN WEDGEWOOD VILLAGE SUBDIVISION IF GARAGE IS MOVED BACK TO GIVE THE 5 FOOT SET BACK. SECONDED BY HOWARD YEAGER. MOTION APPROVED UNANIMOUSLY. ** DAN LONG DISCUSSED WITH BOARD HIS REQUEST FOR PERMISSION TO FACE HIS PROPOSED RESIDENCE TOWARD BLACKHAWK BLVD. INSTEAD OF WHITTIER OAKS DRIVE. THERE WAS MUCH DISCUSSION. MR. AND MRS. DICK DIXON, OF .5114 WHITTIER, OBJECTED TO THE VARIANCE :BEING GRANTED. STEVE JOHNSON STATED IF THE HOUSE FACED BLACKHAWK IT SHOULD BE IN A CONTINUOUS LINE WITH THE OTHER HOMES. THERE WAS MUCH DISCUSSION. MOTION WAS MADE 1BY HOWARD YEAGER TO GRANT THE VARIANCE TO ' FACE THE PROPOSED RESIDENCE TOWARD BLACKHAWK INSTEAD OF WHITTIER OAKS DRIVE LOCATED AT 5114 WHITTIER OAKS DRIVE. ' IT WILL INCLUDE A �17 FOOT REAR SET BACK WITH THE HOUSE TO FACE BLACKHAWK AS PROPOSED ON PLAN. SECONDED BY STEVE JOHNSON. MOTION APPROVED UNANIMOUSLY. **DAN LONG DISCUSSED WITH THE BOARD HISREQUEST FOR A VARIANCE FOR A SIDE SETBACK OF 12-13 FEET LOCATED AT 5123 WHITTIER OAKS DRIVE IN WEDGEWOOD VILLAGE SUBDIVISION. HIS PLANS WERE REVIEWED AND DISCUSSED. DISCUSSION FOLLOWED. MAURICE ESTLINBAUM MADE THE MOTION TO GRANT THE VARIANCE AS SHOWN ON THE, PLAT, WHICH- WOULD BE 13 FEET SET BACK. SECONDED BY STEVE JOHNSON. MOTION APPROVED UNANIMOUSLY. "THE LAST TWO ITEMS WERE COMBINED IN DISCUSSION. THE TWO LOCATIONS WERE 4211 AND 4215 TOWNES FOREST ROAD IN FOREST CREEK SUBDIVISION. DAN LONG WAS REQUESTING A FIVE FOOT SIDE SETBACK ON BOTH LOCATIONS. DISCUSSION FOLLOWED. MAURICE ESTLINBAUM AND HAL TAYLOR WERE CONCERNED ABOUT GRANTING A "BLANKET VARIANCE" BECAUSE THERE WERE NO HOUSES PLANNED FOR THESE LOCATIONS AT THIS TIME. THEY WOULD RATHER HAVE PLANS TO LOOK AT AND CONSIDER IN BLACK AND WHITE. DAN LONG WITHDREW HIS TWO REQUESTS ' 'UNTIL HE DOES HAVE A HOME BUYER WITH .HOUSE PLANS AND HE AGREED HE WILL ITHEN COME BEFORE THE BOARD AT THAT TIME. CHAIRMAN DYKES STATED HE FELT THAT HE NEEDED A VICE-CHAIRMAN FOR :0IIE BOARD OF ADJUSTMENT. MAURICE ESTLINBAUM MADE THE MOTION TO NOMINATE HAL TAYLOR .-BECAUSE HE HAS BEEN A.MEMBER OF THE BOARD THE LONGEST, NEXT TO CHAIRMAN DYKES. SECONDED 'BY MARY ELLEN BELLARD. MOTION APPROVED UNANIMOUSLY. - *THE MINUTES WERE READ FROM JULY 23, 1985 BY CHAIRMAN DYKES WITH. ONE CORRECTION. THE CORRECTION WILL BE: MR. AL O'FARRELL WILL' BE GRANTED A TOTAL AREA OF 50 SQUARE FEET FOR HIS SIGNS. THEY WERE THEN APPROVED AS READ WITH THE CORRECTION. 2 **MOTION' WAS MADE AND SECONDED TO ADJOURN AT 8:25 P.M. BOX 323 S MANVEL,TEXAS 77578 Dear Zoning Board Member, I _am w_ritting this letter in explanation -of the attached arawing which accompanies my application for a variance on the side set back lines on lots 14 and 15 in Forest Creek Subdivision. First let me explain the drawing: 1 . I have not attempted to draw the the actual street scene Ibut rather a"typical" for comparison purposes . 2. Please note that every house has three equal size windows , in two different configurations , and either a double or t-.ro single garage doors , plus of course a front door. This similiarity is for size comparison pur_oses . 3. I have taken every garage to be 400 sq . ft . and subtracted that amount from the slab area to arrive at an approximate living area . The drawing illustrates in the following ways why my request for a variance should be granted : 1 . In the street scene , houses C and D ap_;ear to be the smallest houses on the block because they are the narrowest . As shown in the plot plans this is not the case . This appearing to be smaller will result in narrower houses having a. detrimental effect on the subdivision because it will result in the appearance that srnailer hence cheaper houses have been built . 2 . Notice that "F" is actually the smallest house on our "typical" block but it appears to beone of the biz;;est because of its width. 3. House "B" is 400 ft. larger trian either "C" or "D" yet it has more usable back yard than either of the narrovier houses . It makes better use of the available land . 4. The layout of house "C" with ziie garLLge grotesouely stuck out in the front is a frequently used design for narrow houses because -the garage takes up- so much of uae width of -- the house that to create a decent arrangement of the living areas the simplest solution is to move the garage forward out of the way. The same :arrangement on house "G" a wider house does not look nearly as bad. I hope that. this drawing has helped you see that my request for this variance is not an attempt to cheapen the look of the neighborhood but an attempt to maintain the rood appearance of the subdivision. In fact construction cost of the houses I eventually build on these two lots will not be affected by wheither they are 40 feat or 50 feet wide .
