TAYLOR CALLED THE MEETING TO ORDER . MARY ELLEN BELLARD , DAVID O 'BRIEN, III AND HOWARD YEAGER WERE APPOINTED REGULAR MEMBERS FOR THIS MEETING. CHAIRMAN TAYLOR CALLED FOR PUBLIC INPUT REGARDING REQUEST FROM RICHARD , 15819 WANDERING TRAIL , WEDGEWOOD VILLAGE SUBDIVISION , SEEKING VARIANCE TO CONSTRUCT A CARPORT IN SIDE YARD WITH 3 FOOT SIDE SETBACK FROM THE REQUIRED 10 FOOT SIDE SETBACK. ,RICHARD BEARD STATED HIS HOME IS SMALL AND ON A SMALL LOT. HE HAS A CONCRETE DRIVEWAY ON ONE ENTIRE SIDE OF THE HOME WHICH CURVES INTO THE BACKYARD AND THE CARPORT WILL BE ON THE SIDE OF THE HOME AND THREE FEET FROM THE PROPERTY LINE . THE ROOF IS TO BE OVER THE EXISTING DRIVEWAY AND CONSTRUCTION WILL BE TO MATCH THE HOME AND BE TOTALLY OPEN ON SIDES . THE UNUSUAL HEIGHT OF THE CARPORT IS TO ACCOMMODATE HIS SAILBOAT WITH A HIGH MAST AND TRAILER WHEN HE PULLS IT OUT OF THE BACKYARD . MR . BEARD DISPLAYED PICTURES HE HAD TAKEN FROM ALL ANGLES TO SHOW THE POSTS ALREADY IN PLACE AND THE CLOSE SETBACK OF 3 FEET OF HIS NEIGHBORS HOME TO HIS . 'DISCUSSION FOLLOWED AT LENGTH . CHAIRMAN TAYLOR CALLED FOR PUBLIC INPUT REGARDING REQUEST FROM WILLIAM E . MALLARY , 402 INDEPENDENCE , HERITAGE ESTATES SUBDIVISION TO SEEK VARIANCE FOR AN ADDITION TO GARAGE 15 FOOT FROM THE REQUIRED 25 FOOT REAR PROPERTY LINE . WILLIAM MALLARY GAVE THE BOARD HANDOUTS WITH INFORMATION HE WAS TO DISCUSS. HE STATED HIS ADDITION OF HIS GARAGE WAS REJECTED ON A BUILDING PERMIT BECAUSE HIS ADDITION WOULD RESULT IN SETBACK FROM REAR PROPERTY LINE OF LESS THAT 25 FEET. HE FELT THAT THE PROPOSED ADDITION TO EXISTING GARAGE WHICH SATISFIES THE DEFINITION OF AN ASSESSORY BUILDING (SECTION, 7 , PARAGRAPH 0. 3 , AREA & HEIGHT EXCEPTIONS) TO A GREATER DEGREE THAN THAT OF A RESIDENTIAL DWELLING AND THE GARAGE MEETS ASSESSORY USE DEFINITION (SECTION 7 , PARAGRAPH 4 . ) . THE DISTANCE BETWEEN THE GARAGE AND RESIDENCE ( 10 FEET) ALSO EXCEEDS THE FOOT SEPARATION REQUIREMENT FOR ASSESSORY BUILDINGS (SECTION 8 , PARAGRAPH C . ) DISCUSSION FOLLOWED AT LENGTH. A GENTLEMEN FROM THE ARCHITECTURAL COMMITTEE FROM HERITAGE ESTATES CIVIC CLUB STATED THAT HE COULD SEE NO PROBLEM WITH HIS ADDITION AND FELT THE COMMITTEE WOULD CONCUR , BUT HE WOULD HAVE TO TAKE IT BEFORE THEM. A LETTER WAS PRESENTED FROM CAROL HARDY KOPERNA WHO STATED SHE IS IN FAVOR OF THE VARIANCE BEING GRANTED . CHAIRMAN TAYLOR CALLED FOR PUBLIC INPUT REGARDING REQUEST FROM JOHN C . WYCOFF OF WYCOFF & ASSOCIATES , INC . , REPRESENTING DAVID NICHOLAS, 903 LANCASTER , REGENCY ESTATES. SUBDIVISION, SEEKING VARIANCE TO REQUEST 2 FOOT , 9 INCHES FROM THE REQUIRED 10 FOOT SIDE SETBACK FOR AN ADDITION TO HOME . JOHN C . WYCOFF STATED ON THE ORIGINAL SURVEY THE SIDE SETBACK WAS NOT SHOWN AS 7 FOOT 3 INCHES BUT AS 10 FEET AND IT WAS FOUND WHEN THE BUILDING INSPECTOR WENT OUT TO MEASURE ALTHOUGH THE ADJOINING HOME IS TEN FEET FROM THE PROPERTY LINE . NICK CAPUANO TOLD THE BOARD THAT MANY HOMES IN THIS SUBDIVISION DO NOT HAVE THE PROPER DISTANCE FROM THE PROPERTY LINE. THE HIP ROOF AND BRICK WORK WILL CONTINUE EVENLY WITH THE NEW ADDITION TO ADD TO THE UNIFORMITY OF THE HOME . DISCUSSION FOLLOWED .
