Special Meeting
Zoning Board of Adjustment
November 9, 1998
Minutes of the Special Meeting of the Zoning Board of Adjustment of the City
of Friendswood which was held at City Hall on November 9, 1998 at 6:30 p.m.
with the following members present constituting a quorum:

Members Ann Talbot and Marsha Standridge were absent.
Chairman Hal Taylor called the special meeting to order at 6:30 p.m.
Discussion was held with City Council regarding the following Zoning
Ordinance issues which were, Swimming Pool Locations, Determining Building
Heights, and Substandard Lot sizes.
Motion made and approved to adjourn at 7:45 p.m. .

Subject: Swimming Pool Setbacks
Date: November 9, 1998
At its November 6, 1998 meeting, the City of Friendswood Planning and Zoning Commission
(Commission) voted unanimously (7 to 0) to recommend to Council that the section of the
Zoning Ordinance that addresses swimming pools in Residential zoning districts that are to be
used by the owners of the property and their guests (Section 8.14) be modified. The reason for
the modification is to clarify the intent of this section of the Zoning Ordinance.
The "swimming pool" section of the ordinance was included to further limit swimming pool
location and use, not as an exception to the accessory structure regulations included in the
_ ordinance. Recently several variances have been granted by the Zoning Board of Adjustment to
location determinations established by City staff. City staff location determinations were based
on the "accessory structures" section of the ordinance. Because the "swimming pool" section of
the ordinance does not include a specific reference to a swimming pool as an accessory structure,
the Zoning Board of Adjustment has overturned the City staffs rulings.
The modification proposed to the "swimming pool" ordinance adds language that clearly
identifies a swimming pool as an accessory structure and makes it subject to the same siting
requirements as other accessory structures. The additional restrictions relating to swimming
pools (ownership/use, limiting location to only the backyard) remain.

Subject: Ten Foot Landscaped Open Space

At its November 6, 1998 meeting,the City of Friendswood Planning and Zoning Commission
(Commission) voted unanimously (7 to 0) to recommend to Council that a 10 foot landscaped
open space be required along street right of way in front yards and side yards if the lot is a corner
lot in the following zoning categories: Planned Unit Development (PUD), Community
Shopping Center(CSC), Old Business District (OBD), Light Industrial (LI), Industrial (I),
Business Park(BP), and Agricultural (A-1). This proposal makes the foregoing commercial
zoning categories consistent with the proposed ordinance that addresses Neighborhood
Commercial (NC), Office Park District(OP), and Local Neighborhood Commercial (LNC).
The Entryway Overlay District includes a 10 foot landscaped open space for all commercial
zoning categories. The proposal will not affect any new development along major thoroughfares
covered by the Entryway Overlay District. Only development along other Friendswood streets
would be impacted. The Commission feels that all commercial districts should exhibit the same
landscape appearance in order to provide an orderly appearance throughout the City.
In order to enhance efficiency, the Commission has asked that the above addition be made to the
ordinance amendment concerning NC, OP, and LNC that will soon be the subject of a public
hearing. In this way, two public hearings can be avoided.
