SANITARY SEWER 1905 DeSota Friendswood, TX 77546 August 31, 1998 City of Friendswood Planning and Zoning Committee Friendswood, TX Dear Committee Members: I am requesting a variance to the building code that restricts building a structure within ten feet of the property line for the purpose of installing a swimming pool in my back yard_ The size of my pool is approximately 35 feet by 14 feet and will be install within five feet of the property line. This installation will not infringe on the utility easement which is five feet. My need for this pool is not just recreational; it is also needed for health reasons. I have a long history of high cholesterol (well over 200) and heart problems are prominent in my family. Under my doctor's instruction, I manage this problem by maintaining a vigorous exercise program, and diet. Until December 1997 I jogged four.miles per day, four days per week. In December, I sustain a knee injury that was later diagnosed through a MRI as a small meniscus cartilage tear. My doctor informed me that 1 needed to change my exercise to something that is either low or no impact and he recommended swimming. In January and February of this year we started making plans for installing a pool. A building permit was submitted in March and was turn down because the pool would have been within ten feet of the property line. Because of the timing, we could not submit this request until April; consequently, the construction could not have started until May. We did not wish to have this construction going on during the summer months. We also considered building only a nine foot wide pool in order to stay ten feet off the property line; however, this is not an acceptable solution due to safety reasons. A person could easily suffer a serious head or neck injury should they dive into the pool from the side if it was only nine feet wide. Even though we plan on carefully supervising the activities around our pool, the risk is too great. Based upon the health and safety reasons listed above and the fact that there are a significant number of existing pools in our subdivision built within ten feet of the property line I would greatly appreciate you approving this request. As I stated in that memo, I agree that swimming pools are included within the scope of the ordinance's definition of"accessory structure." The last paragraph of my memo stated that a permit applicant who disagreed could appeal that interpretation to the Zoning Board of Adjustment. Perhaps I was not very artful in my choice of words; let me elaborate on what options an individual, who is unsatisfied by the city's position, has. I believe there are two ways in which an applicant can apply to the Board for relief. The first alternative would be to apply for a variance. In order for a variance to be granted, the applicant would have to meet the requirements of the city's ordinance: 1. a variance would not be contrary to the public interest, 2. a literal enforcement of the ordinance would result in unnecessary hardship, 3. the spirit of the ordinance would be preserved, and 4. substantial justice would be done. City of Friendswood Code of Ordinances, Appendix C, §l I.B. A variance is a last resort, and should be granted in order to prevent a constitutional Baking of someone's property, that is, generally, when they are left with no use of'the property. Since the applicant would still have a home, and other possible recreational types of uses on the property, it is doubtful the conditions for a variance could be met. 09/04/98 10:4E OLSON & OLSON 4 2E1 996 3260 N0.051 P003i00e The other alternative would be to appeal the city's interpretation of the definition of "accessory structure." The ordinance requires the following standards be met in evaluating such cases: l. a reasonable difference of interpretation as to the.intent of the regulations exists, 2.. the interpretation will not grant a special privilege to one property inconsistent with others similarly situated, and 3. the decision is in the public's interest and consistent with spirit of the zoning regulations. City of Friendswood Code of Ordinances, Appendix C, §11.A. The Board would hear evidence about what did or did not constitute an accessory structure, evaluato the ordinance terms and other evidence, and make their determination according to these standards. The purpose of requiring consideration and findings based on these staa¢ard is to prevent the Board from usurping legislative functions, and to protect the city from challenges of spot zoning or preferential treatment. This is not an opportunity for the Board to rewrite the terms of the ordinance based on whether they think the ordinance should be written differently, or whether the regulation should or should not, as a matter of policy, be applied differently. If the Board considers a policy change desirable, that recommendation should be forwarded through the appropriate avenue. On a related matter, I understand that a request for a variance on the side yard setback for a pool was posted and heard at the August meeting, but was approved as an appeal, ess wherein the Board overrode the city's interpretation of the term "accory structure." In my opinion, the Board must act on the matter that is presented to ftra., that is, what has been noticed and published in accordance with the Zoning Act, Tsx. Loc. Gov'T CODE Ch. 211, and the Open Meetings Act, TEx. GOV'T CODE Ch. 551. If an item is noticed and posted on the agenda as a variance,the Board must hear and docile it as a variance. If notice has been sent out in preparation for the meeting, and the applicant wishes to amend their request to seek an interpretation, the city may Assess another application fee from that applicant. Early information to an applicant to help them evaluate their options, as you and I have discussed, may assist in preventing thu from happening, and I have attached a draft of an information sheet to this memorandum. Mrs. Richardson also explained the hardship is that Michael Richardson is an insulin dependent diabetic patient that needs a pool for exercise purposes as requested by his doctor. Building Official Linda Taylor submitted a memo from the City Attorney Kim Mickelson, dated April 20, 1998, referencing Setbacks for Swimming Pools. *Ron Decker made a motion to approve the variance at 1910 LaSalle, Mission Estates Subdivision, as requested for the accessory structure 10' rear set- back reduced to 5' as requested in the application, based on the referenced paragraph about swimming pools, Section 8. J. 4, of the Zoning Ordinance 84-15. 2nd by Tracy Goza Motion approved unanimously.
