Mission Estates III Deed Restrictions require that any homeowner must receive approval from the Association's Architectural Control
Committee (ACC) before changing, altering, or maintaining any building, fence, wall, or other structure on their deeded property.
Changes and alterations include(without limitation) exterior additions (and paint colors thereof), exterior paints, grading plans, patio
covers and trellises and offstreet parking of vehicles. The Association has the right to have any homeowner remove or change any
improvements on the homeowner's property which have not been approved by the Architectural Control Committee. To request

Dear Zoning Board of Appeals:
We are very glad to be living in Friendswood, and we're especially glad to be in a
community that goes to great efforts to protect the value of our property through the
zoning process. Additionally, we appreciate the difficulty of your job, of any public
service, and we know that making decisions that create exceptions to the rules is not only
difficult to do, but also can cause you grief later. All this to say that we understand the
difficulty of your responsibilities.
On the other hand, for the first time in our lives, we are asking for one of those difficult
exceptions. We want to build a roofed patio in our back yard, covering an existing patio
slab that we want to expand. Our problem is our back yard from the brick wall of our
house to back fence is 26 feet. Our building permit request was denied because zoning
says we cannot build less than 25 feet from our back line.
The reasons we want the back patio:
1. The back of our house faces west, making the back yard useless during the afternoons
and early evenings for most of the year.
2. Without a roof, we cannot enjoy the more pleasant mornings, for our patio furniture is
damp from dew.
3. We enjoy a back yard. We have spent much time and money on flower gardens and a
sprinkler system in spite of the smallness of the yard. We take great pride in having a
beautiful yard. We want to be able to sit in it!
4. It will enhance the value of our house.
5. The size of the yard is only a little bigger than a patio or garden home, something
very appealing to us. Garden homes have covered patios.
6. It will help cool the house in the summer. (The west wall has seven windows and a
door, providing for a lot of sunshine and heat in the summer.)
Reasons we think the zoning rule should be excepted:
1. Our homeowners association has already approved the plan.
2. The patio will enhance the value of our house and will not be a detriment in any way
to the neighbors.
3. Garages in the neighborhood, including those next door and across the back fence, are
closer to the building line than we require.

4. All yards of single story homes in our subdivision are small, by design. That should
not make us ineligible for an attractive, useful patio.
5. Other homes have built patios within ten feet of the back line, let alone twenty-five
feet. Those homes are an asset to the properties in the neighborhood.
6. We are responsible citizens and will complete the job satisfactorily.
If indeed you will not approve our plan as proposed,will you consider one of the
following options:
1. We can reduce the depth of the patio. Currently the plan is 15 feet deep. We can
reduce it to 12 feet or fewer.
2. We can make it detached, much like the patio just completed on the house at FM 528
and Briarwood.
3. We can use removable garden bricks instead of a slab and an open air joist system
instead of a solid roof.
4. At the very least, we can cover the existing patio slab, but the size of that slab is truly
insufficient.
5. Your suggestions:

The Feasters propose to build a covered patio structure which is tied into
their house roof in their rear yard 11' from their rear property line.
Ordinance #85-4 established a Specific Use permit for single-family lots in
Mission Estates and Carmel Village that were platted smaller than the
required lot size. That ordinance specifies that except for front and side
yard setbacks, " all other limitations, restrictions and conditions set forth
for SFR in the City of Friendswood" apply. One of the restrictions that
would still apply would be the required rear setback of 25' .
Staff respectfully requests that this variance not be granted.

Minutes of the Regular Meeting of the Zoning Board of Adjustment of the City
of Friendswood which was held at City Hall on August 25, 1998 at 7:00 p.m.
with the following members present constituting a quorum:

Members Gary Yokum, Gary Harris and Tommy Rives were absent from this
meeting.
Chairman Hal Taylor called the regular session to order at 7:00 p.m. .
Assistant City Secretary, Linda S. Thornton administered the Oath of Office
to appointed Alternate Member Marsha Standridge.
Chairman Taylor, appointed Alternate Member Tracy Goza, as a Regular voting
member for this meeting.
Chairman Taylor, called a public hearing to order to receive public input
regarding request by James T. and Margaret F. Feaster, for a variance at
1904 LaSalle, Lot 20, Block 3, Section 3, Mission Estates Subdivision,
Galveston County, Texas, for building a covered patio structure which is
tied into the house roof in the rear yard 11' from the rear property line
instead of the required 251 . Friendswood City Code, Appendix C-Zoning,
Section 7.Q.2.
Discussion followed with James T. Feaster explaining the variance request
and hardship being smaller lot size.
Renee Baker, President of Mission Estates Home Owners Association, P.O. Box
2023, Friendswood, Texas, spoke for the variance.

*David O'Brien made a motion to deny variance at 1904 LaSalle, Lot 20,
Block 3, Section 3, Mission Estates Subdivision, Galveston County, Texas.
Seconded by Ron Decker
Motion approved unanimously.
Chairman Taylor, called a public hearing to order to receive public input
regarding Michael R. and Deborah A. Richardson at 1910 LaSalle, Lot 23,
Block 3, Section 3, Mission Estates Subdivision, Galveston County, Texas,
for an accessory structure (Swimming Pool) setback from the rear property
line of 5' instead of the required 101 . City of Friendswood Code, Appendix
C-Zoning, Section 7.Q.3 .
Discussion followed with Deborah Richardson reading her letter for a
variance to the Board and submitted her letter to the Board Secretary,
Linda Thornton. Mrs. Richardson also explained the hardship is that
Michael Richardson is an insulin dependent diabetic patient that needs a
pool for exercise purposes as requested by his doctor.
Renee Baker, President of Mission Estates Home Owners Association, at P.O.
Box 2023, Friendswood, Texas, spoke for the variance.
Discussion followed with Building Official Linda Taylor giving her
justification of her interpretation of the variance request.
Hearing no further input the Public Hearing was closed.
Building Official Linda Taylor submitted a memo from the City Attorney Kim
Mickelson, dated April 20, 1998, referencing Setbacks for Swimming Pools.
*Ron Decker made a motion to approve the variance at 1910 LaSalle, Mission
Estates Subdivision, as requested for the accessory structure 10 ' rear set-
back reduced to 5' as requested in the application, based on the referenced
paragraph about swimming pools, Section 8. J. 4, of the Zoning Ordinance
84-15.
2nd by Tracy Goza
Motion approved unanimously.
The Board based this approval on an administrative interpretation of
the ordinance that this pool is allowed in the required rear yard.
*Discussion followed to move June 23, 1998 minutes to September 22, 1998
meeting for approval.
