Ladies and Gentlemen:
I have been a resident of Friendswood for 50 years. On December 14, 1997, my
home burned down. My wife and 1 are in the process of putting our lives back
together. 1 am requesting a variance from Ordinance No. 90-26 due to several
factors. 1 feel this ordinance was written with the best intentions in mind for
traditional subdivisions. However, in my case, 1 am living next door to my sister
in the middle of open pasture land owned by Wesley West Cattle Company.
Therefore, we have no city streets and must use FM 518 as the point at which the
flood prevention elevation measurement is made. Unfortunately, 1 am on a high
speed embankment where the road is extremely high in relation to the land. If I'am
forced to use this ordinance, I am concerned of the impact to my property and that
of my sister. It is my intention to construct a select fill dirt pad and house slab to
elevate my future home, but not to the degree specified in this ordinance. I shall
provide elevation shots of my existing slab as well as that of the center of FM 518
along with my requested future slab height at our meeting. 1 look forward to your
considering my request and appreciate your time.

Re: Variance Request for
Minimum Slab Elevation
Dear Mr. Hill:
This letter comes in response to our discussion at the City Council meeting on February 2. The
Flood Damage Prevention Ordinance(Ord. 90-26) sets the minimum slab elevation requirements
for the construction of any new building within the city. Any variance from that ordinance
requires that you present your request at a meeting with the Zoning Board of Adjustment. Based
upon our discussion, I would suggest that you pursue a variance request. I would also
recommend that you identify the following issue at your presentation to the Board which acts to
artificially increase the elevation of your slab.
The ordinance sets the minimum slab height at either 18 inches above the elevation of the top of
curb or centerline of the adjacent street or 12 inches above natural ground,whichever is higher.
Almost all residential and collector streets are"cut in"and become a part of the drainage system
during heavy rains. This specific criterion is used to ensure that the slab is constructed above the
street elevation so that the house is not flooded in the event that the street must-convey water
during the 100-year storm.
In your situation,the street referenced is a state highway. Generally, state highways are utilized
as evacuation routes during.heavy rains or hurricanes and are constructed at elevations
significantly higher than the 100-year flood level so as to be passable during these events. The
road bed of F.M. 518 is not designed to convey storm water during a heavy rainfall event. Based
upon this fact, it is my opinion that any additional height above the centerline of F.M. 518-should
not be required. The minimum slab elevation should be set at the elevation of the centerline of
F.M. 518 or 12 inches above natural ground, whichever is higher.

To whom it may concern:
I am the president of Wesley West Cattle Company and a trustee of-the Wesley
West Descendants Trust , the owners of much of the land that surrounds Jim
Hill's Lot 59 of Slone Subdivision. I am in receipt of the notification of the
variance request of James E. Hill's to build his slab less than 18" above the
center of F.M. 518 as required. I have talked to Mike Hoge about the variance
and I do not have a problem with the Commission granting Mr. Hill's request.

Ladies and Gentlemen:
1 have enclosed a great deal of information in this package and will be glad to review
any of it that you deem necessary. In an effort to summarize the material, I am
requesting a one foot variance of ordinance no. 90-26. As you can see, from the
information attached on page 4, the highway in front of my home is the super-
elevated portion of FIN 518. The center of the highway is elevation 27.92'. Based
upon this elevation, the City code requires a finished grade of 29.42'. 1 am
requesting a variance elevation of 28.50' and strongly feel that this height will both
prevent my home from flooding and cause the least amount of impact upon my
sister's home and adjacent landowners property. I also have great concern for
shocking or killing some 18" caliper trees within 30' of my home that my mother
and I planted some 35 years ago.

of Friendswood which was held at City Hall on February 24, 1998 at 7:00 P.M.

Chairman Taylor, called a public hearing to order to receive public input
regarding James E. Hill's request for a variance at 2404 S. Friendswood
Drive, North East part of Lot 59, Slones Subdivision, Galveston County,
Texas, for a slab height - to rebuild a burned house with a slab height of
less than 18" above the center of F.M. 518 as required, but approximately
