The Public Hearing was called to order at 7:00pm with the following people in attendance: Chairman David O’Farrell Commissioner Richard Sasson Commissioner Sally Branson Commissioner Rhonda Neel Commissioner Tony Annan Aubrey Harbin, City Planner Becky Summers, Development Coordinator Arnold Polanco, City Attorney Absent: Lovell, Borghese 2. Receive comments from the public, both oral and written, regarding: a. A request for a zone classification change from Community Shopping Center (CSC) and Specific Use Permit 99-18 for a School (CSC/SUP 99-18) to Community Shopping Center/Specific Use Permit (CSC/SUP) to allow NAICS Use #8131 Religious Organizations at 3700 & 3702 FM 528 being 6.081 acres of land platted as Unrestricted Reserve A, Block 1 of Calvary Chapel Southeast Houston Amended Plat, Harris County Clerk File No. 20060081527 and .583 acres of land out of Reserve “G2”, Block 19, Forest Bend Subdivision, Section 3, City of Friendswood, Harris County, Texas Harbin explained the church was proposing alterations to their existing building, originally permitted in 2007. She stated since the church originally began occupying the space, the City had updated the Permitted Use Table which now requires a Specific Use Permit for Religious Uses. She said the SUP request was to bring the church’s zoning into compliance with City codes. Elizabeth Wagner, resident, spoke regarding the zone change letter she received. She asked for clarification and Chairman O’Farrell said the church was enclosing their porches and updating the zoning on the property. Wagner stated the City needed to expand its tax base but that she did not have an issue with the existing church updating their facility. 3. The Joint Public Hearing adjourned at 7:05pm. FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS 2 January 9, 2017 P & Z Meeting Regular Meeting - (2nd Floor Conference Room) 1. The Regular Meeting was called to order at 7:07pm with the same people in attendance minus the City Attorney. 2. Communication from the public/committee liaisons (To comply with the provisions of the Open Meetings Act, the Commission may not deliberate on subjects discussed under this agenda item. However, the Commission may direct such subjects to be placed on a later regular Commission agenda for discussion and/or possible action.) None 3. A request for a zone classification change from Community Shopping Center (CSC) and Specific Use Permit 99-18 for a School (CSC/SUP 99-18) to Community Shopping Center/Specific Use Permit (CSC/SUP) to allow NAICS Use #8131 Religious Organizations at 3700 & 3702 FM 528 being 6.081 acres of land platted as Unrestricted Reserve A, Block 1 of Calvary Chapel Southeast Houston Amended Plat, Harris County Clerk File No. 20060081527 and .583 acres of land out of Reserve “G2”, Block 19, Forest Bend Subdivision, Section 3, City of Friendswood, Harris County, Texas Annan said he did not want to set a precedent for churches in commercial zoning districts. Harbin explained a Specific Use Permit allows the Commission to evaluate each project separately and would not set a precedent. Neel asked if existing uses fell out of compliance often because of changes the City makes to the Permitted Use Table. Harbin said ordinance changes do create non-conforming lots and structures. Branson said the property is already off the tax rolls and this was zoning clean-up. She did not see any impact to the City or neighbors. Sasson asked if the change would impact alcohol sales for the nearby liquor store and gas station. Harbin said the church is not within the distance restriction from those stores and would not impact them. Annan asked if the church would be adding parking to accommodate the 7,000 square feet of space they will gain by enclosing the porch areas. Summers explained the site currently has an overage of parking spaces and the expansion complies with the City’s parking requirements. Motion: Branson Second: Neel Vote: 4 to 1 (Annan against) Motion passed. 4. Consideration and possible action regarding a recommendation to change Chapter 54 Section 54-5 Maximum permissible sound levels (a)(1)b. Residential during night time hours from 58 dB to 55 dB 3 January 9, 2017 P & Z Meeting No action – item tabled at 12-15-16 meeting. 5. Consideration and possible action regarding future Planning and Zoning Commission meeting dates Harbin said the next regular meeting would be held Thursday, January 19th at 7:00pm. She also outlined future meetings as: February 2 – regular meeting – Parks Master Plan presentation by James Toney February 6 – workshop with Council (4:30/5); JPH with Council (7:00pm) February 16 – regular meeting – CIP presentation by Patrick Donart Harbin inquired about holding a workshop, at the Mayor’s request, on January 21st in the morning time. Those present said they could work with that date. 6. Communications from the Commission Sasson reported CEDC discussed the panhandle area of Friendswood and problems for development such as the nearby Brio site, lack of utilities, and flooding. Sasson also reported CEDC officially supports the Large Retail changes the subcommittee has been working toward. 7. The meeting was adjourned at 7:23pm.
