Joint Public Hearing
1. The Joint Public Hearing was called to order at 7:07pm with the following people in
attendance:
Chairman David O’Farrell Commissioner Craig Lovell
Commissioner Sally Branson Commissioner Tony Annan

2. Receive comments from the public, both oral and written, regarding:
a. Zone classification change from Single Family Residential (SFR) to Neighborhood
Commercial (NC) at S. Friendswood Dr./Old Rd., 2.039 acres being Part of Lot 45,
Slone Subdivision, out of the B.W. Camp Rice Farms in the John Dickerson League,
Galveston County, Texas, according to the map recorded in Volume 254-A, Page 6, in
the office of the County Clerk of Galveston County, Texas
Harbin/City Planner said the applicant was requesting a zone change from Single Family
Residential to Neighborhood Commercial on an undeveloped tract on FM 518. She said the
buyer was proposing a gas station and would be subject to the Community Overlay District
rules.
Mona Miller/Infiniti Realty said the sellers were elderly and lived out of town so she was
speaking on their behalf. Miller said the buyers were proposing Neighbor Commercial
zoning which was the most restrictive commercial zoning that would allow a gas station.
3. The Joint Public Hearing adjourned at 7:09pm.

1. The Regular Meeting was called to order at 7:12pm with the same people in attendance
minus the City Attorney.
*Chairman O’Farrell asked the Commission if they would be open to moving item 5 up on
the agenda to accommodate City Council.
Motion to move item 5 ahead of item 2: Branson

Vote: 7/0 Unanimous Motion carried
5. Consideration and possible action regarding a zone classification change from Single
Family Residential (SFR) to Neighborhood Commercial (NC) at S. Friendswood
Dr./Old Rd., 2.039 acres being Part of Lot 45, Slone Subdivision, out of the B.W. Camp
Rice Farms in the John Dickerson League, Galveston County, Texas, according to the map

Larry Tilger/adjacent owner said the area is already congested due to the proximity of the
Junior High School and he was concerned with having a gas station near his home.
Harbin explained the gas station, or any commercial property, would be required to install
an 8’ opaque fence with a 15’ landscape buffer and trees every 25’ along the property edge
that abuts residential. She said the main access would be gained via FM 518 but secondary
access could be through Old Road.
Annan asked if the proposed zone change was similar to the one recently approved on West
Parkwood Ave. Harbin said that zone change was also from residential to commercial with
surrounding residences.
O’Farrell asked Lovell if there was a noise ordinance in place to protect the adjacent
homeowner. Lovell said there was an existing noise ordinance. Harbin said Code
Enforcement could be contacted if there were noise issues.
Neel asked how wide the property was. Miller said the property was approximately 150-
feet wide. Lovell asked the neighbors where their homes were located. Tilger said his
house was 600-feet from FM 518 and two lots over from the subject tract. Campos said his
lot was undeveloped and on the opposite side of Old Road.
Borghese asked what types of uses were allowed in Neighborhood Commercial zoning.
Harbin read through the Permitted Use Table and gave several examples such as medical
offices. She said uses like automotive sales would not be allowed by right.
Miller explained her clients asked for Neighborhood Commercial (NC) zoning because it
would be less intrusive to the adjacent properties. She said the lot meets the NC size
requirements and that she and her clients had met with the City’s Development Review
Committee. She mentioned her clients would be required to obtain site plan approval from
the Planning and Zoning Commission, as well.

The potential buyers stated they are proposing a convenience store with gas pumps and
some retail lease space.
O’Farrell asked the potential buyers if they would be willing to apply for Planned Unit
Development (PUD) instead, to offer the neighbors assurances on what would be built.
Miller stated a PUD was for mixed use developments or really offensive uses and she did
not feel a PUD was appropriate for her client. She said a PUD would be an unnecessary
burden. Miller explained the lot was on a major thoroughfare and the closest neighbor was
pretty far away.
Lovell said he felt a commercial lot between two residential lots was out of character.

a. Replat of the Amending Plat of Creekwood Estates, Lots 8 & 9, Block 4, being a
1.246 acres tract of land out of the Creekwood Estates, being originally Lot 8 & 9 in
Block 4, a subdivision in Galveston County, Texas, according to the map or plat thereof
recorded in G.C.D.R. No. 2011039015, of the Deed Records of Galveston County,
Texas, and also being Lot Eight (8-A), in Block Four (4), of Amending Plat of Lots 8
and 9 Block No. 4 Creekwood Estates, a subdivision in Galveston County, Texas
according to the map or plat thereof, recorded in Plat Record 2013A, Map Number 62,
of the Plat Records of Galveston County, Texas
Harbin explained a residential replat requires that notices be sent to property owners within
200-feet of the subject property as well as publishing a notice in the newspaper. She said
the lot was originally platted as two lots then combined and sold; now the new owners want
to subdivide the lot again but into a different configuration than the original plat.
Tim Wood/owner said they needed to add a few feet to the proposed sewer easement.
Borghese asked if the pipeline onsite was still active and what it carried. Wood said it is an
active pipeline owned by Enterprise Pipeline but he was not aware of the product.
Neel asked why the compliance memo stated the build line needed to be moved. Harbin
explained because the lot was flag-shaped, the lot line needed to be far enough back to
where the lot met the minimum lot width required by ordinance.

7. Consideration and possible action regarding future Planning and Zoning Commission
meeting dates
Harbin said the next regular meeting was scheduled for December 15th at 7:00pm.
8. Communications from the Commission
Lovell said the Large Retail Subcommittee was polishing up their recommendation and
would bring it for consideration at the next meeting.
Branson said the Christmas tree lighting and mural unveiling were approaching and
encouraged the Commission to attend.
O’Farrell said photographs would be taken at the next meeting and suggested the
Commission dress for the occasion. O’Farrell also thanked the subcommittee for all their
hard work.
9. The meeting was adjourned at 7:50pm.
