The Public Hearing was called to order at 7:00pm with the following people in attendance: Chairman David O’Farrell Vice Chairman Arthur Triplette Commissioner Mark McLean Commissioner Jim Nye Commissioner Craig Lovell Commissioner Sally Branson Commissioner Rich Borghese Nick Haby, PIO/Planning Manager Aubrey Harbin, City Planner 2. Receive comments both oral and written regarding a Partial Replat of Sterling Creek Section 1 to convert Reserve C to a Single Family Residential Lot, .291 acres of land being known as Unrestricted Reserve C of Sterling Creek, an addition in the City of Friendswood, Galveston County, Texas, according to the map or plat thereof recorded in the plat record 2012A, Map Nos. 44 and 45 of the Map Records of Galveston County, Texas Adam Hill, Sterling Builders, stated the Reserve was intended to put a gazebo on at a later date. He said $18,000 worth of park fees were paid to the City and once the Reserve was built into a park area, receipts were to be provided to the City per James Toney, Director of Parks and Recreation. Mr. Hill said sometime after the fees were paid, City Council voted to change the way park fees were allocated so when Mr. Hill told the City he was ready to build the park, those fees were no longer available because they were spent elsewhere. 3. The public hearing adjourned at 7:02pm. Regular Meeting 1. The Regular Meeting was called to order at 7:02pm with the same people in attendance. 2. Communication from the public/committee liaisons (To comply with the provisions of the Open Meetings Act, the Commission may not deliberate on subjects discussed under this agenda item. Consent Agenda A. Approval of the minutes for the meeting held: 1) June 18, 2015 Motion to approve: Branson Second: Lovell Vote: 6 to 0 (Triplette abstained) Motion Carried 4. Consideration and possible action regarding a Partial Replat of Sterling Creek Section 1 to convert Reserve C to a Single Family Residential Lot, .291 acres of land being known as Unrestricted Reserve C of Sterling Creek, an addition in the City of Friendswood, Galveston County, Texas, according to the map or plat thereof recorded in the plat record 2012A, Map Nos. 44 and 45 of the Map Records of Galveston County, Texas Motion to approve: Branson Second: Triplette Vote: 7 to 0 (unanimous) Motion Carried 5. Consideration and possible action regarding a preliminary plat of Arbor Gate at West Ranch Section One being 9.7 acres of land out of the John Dickinson Survey, A-9 and being a portion of Lots 78 through 80 and 99 through 102 of the Slone Subdivision, a Subdivision plat filed for record under Volume 3, Page 61A (Volume 254A, Pg. 6) of the Galveston County Map Records, City of Friendswood, Galveston County, Texas Motion to approve subject to compliance with staff comments: McLean Second: Borghese Vote: 7 to 0 (unanimous) Motion Carried Triplette asked if there was anything different about this section. Harbin stated this was just another West Ranch section; located on the east side of West Blvd. 6. Consideration and possible action regarding a preliminary plat of Arbor Gate at West Ranch Section Three (A Gated, Private Subdivision) being 34.8 acres of land out of the John Dickinson Survey, A-9, and being a portion of Lots 99 through 104, 121, 125 and 139 through 142 and all of Lots 122 through 124 of the Slone Subdivision, a Subdivision Plat filed for record under Volume 3, Page 61A (Volume 254A, Pg. 6) of the Galveston County Map Records, City of Friendswood, Galveston County, Texas Motion to approve subject to compliance with staff comments: Triplette Second: Branson Vote: 7 to 0 (unanimous) Motion Carried 7. Consideration and possible action regarding a final plat of West Ranch School Site a subdivision of 12.07 acres of land located in the John Dickinson Survey, A-9, also being a portion of lots 148-152 of the Slone Subdivision as recorded under Volume 3, Page 3 July 2, 2015 P & Z Meeting 61A, GCMR, Galveston County, City of Friendswood, Texas Motion to approve subject to compliance with staff comments: Borghese Second: McLean Vote: 7 to 0 (unanimous) Motion Carried McLean asked if the school site was zoned Single Family Residential and asked if the school district will need a zone change. Harbin stated Commercial Shopping Center (CSC) is on the plat which will require a zone change to allow a school use. She said the PUD states West Ranch will dedicate the land to the school district once 750 residential permits have been issued. McLean said he was making a point that the school will need to file for a zone change and come before the Commission with a site plan in the future. Lovell asked what type of school was planned. Harbin said an elementary school was proposed. Lovell said he hoped there was a traffic plan to discourage congestion. Harbin stated the school district will be responsible for the traffic design. She also mentioned there are no build lines on the plat because the orientation of the building has yet to be decided. O’Farrell asked if the site plan will be reviewed by the Police Department. Harbin stated yes but schools are protected by law with some exemptions. Haby said the City has monthly meetings with the school districts which the Police Department and the Fire Marshal’s Office attend. O’Farrell asked if the City would have any recourse if they oppose the school’s plan to que school traffic. Haby stated the school districts and the City have always had a good working relationship. He said ultimately, the City does not have the authority to enforce traffic designs on the school district. O’Farrell asked Haby to see if the City Attorney had any further information. McLean stated the appropriate time to delve further into school traffic would be when the site plan comes before the Commission. 8. Consideration and possible action regarding future Planning and Zoning Commission meeting dates Harbin said the next regular meeting would be held Monday, July 13th at 7:00. 9. Communications from the Commission McLean advised the Commission to watch out for plugged wells on plats. O’Farrell said he appreciated hearing the backstory of why the change was made to Sterling Creek Section 1. 10. Reports A. Council Liaison – Rockey reminded the Commission of the Gathering being held on the 4th of July. 4 July 2, 2015 P & Z Meeting B. Staff – Harbin said the DRC report was emailed out. O’Farrell suspended the rules by acclimation to allow public comment (Agenda Item 2). Harbin reminded the Commission this can only be input by the public and the Commission cannot discuss. Tony Anon, resident, said City Council approved a first reading of a zone change for the Whitcomb property and the second reading is scheduled for July 13th. He said CEDC wanted City Council to obtain a new recommendation from the Planning and Zoning Commission. He said CEDC wanted to know if P&Z felt the same. Harbin told the applicant that staff could discuss with him after the meeting. 11. The meeting was adjourned at 7:21pm.
