The Regular Meeting was called to order at 7:01pm with the following in attendance: Chairman Mark McLean Commissioner Chris Brown Commissioner Arthur Triplette Commissioner David O’Farrell Commissioner Jim Gibson Commissioner Jim Nye Aubrey Harbin, City Planner Nick Haby, PIO/Planning Manager Becky Summers, Dev. Coordinator Xochyt l Greer, City Attorney Steve Rockey, Council Liason Absent: Tibbitts 2. Communication from the public/committee liaisons (To comply with provisions of the Open Meetings Act, the Commission may not deliberate on subjects discussed under this agenda item. However, the Commission may direct such subjects be placed on a later regular Commission agenda for discussion and/or possible action.) None 3. Consent Agenda A. Approval of the minutes for the meeting held: 1) June 2, 2014 Motion to approve: O’Farrell Second: Triplette Vote: 6/0 Unanimous Motion carried 4. Consideration and possible action regarding a final plat of Arbor Gate at West Ranch Section 4 (Private Street Subdivision), being a subdivision of 16.17 acres of land out of the John Dickinson Survey, A-9, City of Friendswood, Galveston County, Texas, also MINUTES OF A REGULAR MEETING HELD THURSDAY, JUNE 19, 2014 AT 7:00 PM CITY HALL COUNCIL CHAMBERS 910 S. FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS 2 June 19, 2014 P & Z Meeting being a portion of lots 138 through 142 and 154 through 158 of the Slone Subdivision, a subdivision plat filed for record under Volume 3, Page 61A (Vol. 254A, Pg. 6) of the G.C.M.R. Motion to approve pending compliance with staff comments: O’Farrell Second: Brown Vote: 6/0 Unanimous Motion carried Harbin stated this is the first private subdivision in West Ranch. 5. Consideration and possible action regarding a final plat of Austin Chase at West Ranch Section 1, being a subdivision of 17.52 acres of land out of the John Dickinson Survey, A- 9, City of Friendswood, Galveston County, Texas, also being a portion of lots 137, 138 and 153 through 160 of the Slone Subdivision, a subdivision plat filed for record under Volume 3, Page 61A (Vol. 254A, Pg. 6) of the G.C.M.R. Motion to approve pending compliance with staff comments: Brown Second: Triplette Vote: 6/0 Unanimous Motion carried 6. Consideration and possible action regarding Appendix C Zoning Ordinance Section 8.N. Downtown District supplemental requirements Motion to approve: O’Farrell Second: Triplette Vote: 6/0 Unanimous Motion carried Haby explained City Council gave direction for the Commission and staff to change the ordinance to remove the Downtown amenity requirements from all side streets in the Downtown District. McLean asked staff if they felt City Council’s direction had been followed to which Haby stated he did. In addition, the Commission has suggested 6’ concrete sidewalks on side streets. 7. Consideration and possible action regarding Appendix C Zoning Ordinance Section 6. Non-conforming uses, structures and lots Motion to approve: O’Farrell Second: Gibson Vote: 1/5 Motion Failed Motion to amend stating the language meets City Council direction but the Planning and Zoning Commission does not support the change: McLean Second: Gibson Vote: 6/0 Unanimous Motion carried Haby stated the language has been clarified and changed to follow City Council direction. Non-conforming structures may stay without enlarging the structure. Any new sections added to a non-conforming structure must meet current city ordinances. 3 June 19, 2014 P & Z Meeting Harbin explained there is more than one way to lose non-conformity including abandonment and destruction due to fire or neglect, etc. The Commission discussed various scenarios of what this change would allow to which Brown stated Council has given specific direction and suggested the Commission vote since it is over their heads already. McLean motioned to amend the original motion. Gibson seconded. The language proposed meets Council direction but the Commission does not support it. Nye stated most cities have language that mirrors the current ordinance and voiced that this change will make Friendswood have one of the lowest standards around. 8. Consideration and possible action regarding a site plan for Pro-Surv Professional Office Building located at 211 Laurel Motion to approve conditionally: O’Farrell Second: Brown Vote: 6/0 Unanimous Motion carried Harbin stated the site plan complies with the proposed changes to the Downtown District supplemental requirements. The applicant, Mr. Lesak, expressed he did not anticipate this much discussion and thanked the Commission for all their help. 9. Consideration and possible action regarding Appendix C Zoning Ordinance Section 11. The Board of Adjustment – Powers and Duties Harbin explained the Special Exception section states a denied site plan is required and suggested that statement be removed. Staff needs direction from the Commission and will incorporate the change into the Zoning Ordinance rewrite instead of piece mailing corrections. McLean directed staff to make the change. 10. Consideration and possible action regarding Appendix C Zoning Ordinance Section 20. Definitions Harbin stated staff is wanting to clean up several definitions. McLean directed staff to do so. 11. Consideration and possible action regarding future Planning and Zoning Commission meeting dates: Motion to move the regular meeting to July 14th due to JPH: Brown Second: Triplette Vote: 6/0 Unanimous Motion Carried Nye said he will be unable to attend due to work. 12. Communications from the Commission 4 June 19, 2014 P & Z Meeting The Commission thanked Commissioner Jim Gibson for his 12 years of service on P&Z. The meeting was followed by a farewell including the presentation of a plaque. 13. Reports A. Council Liaison – Councilman Rockey thanked Commissioner Gibson for his time on P&Z. He applauded the non-conforming issue vote and opined that is the proper role of P&Z, to assist City Council in making informed decisions. B. Staff - Haby congratulated Gibson on his 12-year tenure. Harbin expressed staff’s pleasure in working with Commissioner Gibson over the years. Harbin stated the DRC report for May has been sent. She mentioned two JPH and two zone changes are coming up. 14.
