The Joint Public Hearing was called to order at 7:16pm with the following people in attendance: Chairman Kevin Holland Vice Chairman Mark McLean Commissioner David O’Farrell Commissioner Mark Tibbitts Commissioner Hassan Moghaddam Commissioner Jim Gibson Mona Miller, Planner City Council Morad Kabiri, Director of CDD Frank Manigold, Dep. Director of CDD Aubrey Harbin, Development Specialist Commissioner Nye was absent. 2. Receive comments from the public, both oral and written, regarding a request to vacate 20’ of public right-of-way out of a 40’ wide roadway easement of .190 acre of land, being out of and part of Lots 1 through 4, Block 1, The Forest Section Thirteen, on property located at 1002, 1004, 1006 and 1008 Majestic Lane, Galveston County, Friendswood, Texas. Kenneth Janis stated that he is in favor of the removal of the easement as it extends 20 feet into his property. No one opposed. 3. The Joint Public Hearing was adjourned at 7:18pm. FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS 2 January 23, 2012 P&Z Meeting Commissioner Hassan Moghaddam Commissioner Jim Gibson Mona Miller, Planner Frank Manigold, Dep. Director of CDD Aubrey Harbin, Development Specialist 2. Consideration and possible action regarding a request to vacate 20’of public right-of-way out of a 40’ wide roadway easement of .190 acre of land, being out of and part of Lots 1 through 4, Block 1, The Forest Section Thirteen, on property located at 1002, 1004, 1006 and 1008 Majestic Lane, Galveston County, Friendswood, Texas. Motion to Approve: McLean Second: Tibbitts Vote: 6 to 0 (unanimous) Motion Carried No negative comments were received at the Joint Public Hearing held immediately prior to this meeting. McLean clarified that this roadway is not shown on the Major Thoroughfare Plan for future improvements or widening. There was also mention of property owners in the area becoming landlocked; however, 20 feet of the roadway access will remain. 3. Consideration and possible action regarding the final plat of Ali’s Plat at San Joaquin, being 2.4873 acres situated in the I. & G. N. R. R. Company Survey, Abstract 622, out of a 76.67 acre tract as recorded under clerk’s file number 9518517, Galveston County, Friendswood, Texas Applicant withdrew the application. No action or discussion taken. 4. Consideration and possible action regarding the final plat of Captain’s Corner on Heritage, being 2.703 acres situated in Lot 4, Block 2, Friendswood Subdivision, Sarah McKissick League, Galveston County, Friendswood, Texas Motion to Approve: Second: McLean Vote: 0 to 6 (unanimous) Motion Failed Staff explained that this application is a short form final plat and requires action tonight because of the 30-day requirement per state law. Miller also explained that back-up materials were not provided to the Commissioners prior to the meeting because we were trying to let the applicant make the corrections and resubmit the plat. Chairman Holland also explained to the Commission that there are 16 outstanding staff comments. 5. The special meeting adjourned at 7:37pm.
