The meeting was called to order at 7pm with the following people in attendance: Chairman Kevin Holland Commissioner David O'Farrell Commissioner Mike Huss Commissioner Hassan Moghaddam Mona Miller, City Planner Morad Kabiri, Dir. of CDD Jim Hill, City Councilmember Vice Chairman Mark McLean Commissioner Jim Gibson Commissioner Ruben Garcia Bobby Gervais, City Attorney Aubrey Harbin, Development Specialist Frank Manigold, Deputy Dir. of CDD 2. Communication fiom the public/committee liaisons ('To comply with provisions of the Open Meetings Act, the Connnission inay not deliberate on subjects discussed under this agenda item. However, the Coinniission inay direct such subjects be placed on a later regular Comiission agenda for discussion and/or possible action) Jackie Gibson, Friendswood, questioned whether or not the new application submitted for the hotel site plan this week was received under the SUP requirements. She quoted the Texas Local Government Code Section 245 and stated that the new site plan application should fall under the new ordinance which requires a SUP for a hotel (Accommodations) in the CSC zoning district. She asked that the Commission request a ruling from the City Attorney in this matter. Charles Prendergast, Friendswood, stated that the citizens need someone to tell them why or why not the new hotel site plan was not submitted under the SUP requirement and that the Commission can expect a room full of people here waiting for an answer to that question. He stated in regards to Item 10 on the agenda, which has to do with notifying property owners when development is pending on lots adjacent to schools, residences, churches, and would impact security and safety of the citizens, he stated that the Commission needs to come up with something to address this issue. He stated that he feels Accommodations use should be removed from CSC completely. He stated that it is not compatible and that it was changed before this Commission, but that now is the time to fix it. Don Seyfert, Friendswood, stated that in regards to Item 5, he closed on the land swap with the developer two to three weeks ago and all of the involved parties signed the plat at that time. He stated that he learned today that some revisions have been made to the plat and that he has not had a chance to review the revised version. He stated that he did not see any major issues on the plat and would probably sign it, but wanted to make the Commission aware. 3. Consent Agenda: A. Approval of minutes for the April 5, 2010 special meeting Motion to Approve: Moghaddam Second: Gibson Vote: 7 — 0 (unanimous) Motion Carried 4. Consideration and possible action regarding the final plat of The Dominion at Friendswood Lakes, being 9.801 acres out of Lot 19, David Fahey Subdivision of the Mary Fabreau Survey (Volume 118, Page 417, M.R.G.C.), Abstract 69, Friendswood, Galveston County, Texas. Motion to approve with staff comments: McLean Second: Garcia Vote: 7 — 0 (unanimous) Motion Carried 5. Consideration and possible action regarding the final plat of Slone Subdivision Lots 51 & 52, being 10 acres of land out of the John Dickinson Survey, A-9 City of Friendswood, Galveston County, Texas and also being a partial resubdivsion of all of Lots 51 and 52 of the Slone Subdivision as recorded in Volume 3, Page 61A (Vol. 254A, Pg. 53), G.C.M.R. Motion to approve with condition of owner approval: Gibson Second: Garcia Vote: 7 — 0 (unanimous) Motion Carried 6. Consideration and possible action regarding the final plat of West Ranch West Lake Section One (formerly known as The Lakes at West Ranch Section 2), being 20.04 acres of land out of the John Dickinson Survey, A-9 City of Friendswood Galveston County, Texas and also being a partial resubdivision of a portion of Lots 88-92 and 109-113 of the Slone Subdivision as recorded in Volume 3, Page 61A (Vole 254A, Pg. 6) G.C.M.R. Motion to approve with staff comments: Gibson Second: Garcia Vote: 7 — 0 (unanimous) Motion Carried 7. Consideration and possible action regarding the commercial site plan for Dunn Bros. Coffee to be located at 201 S. Friendswood Drive. Motion to approve with staff comments: Garcia Second: O'Farrell Vote: 7 — 0 (unanimous) Motion Carried 2 Gibson stated that this property is located in the DD zone and part of the thought process for downtown is the desirability of shared parking and that this site does not proposed shared parking, He suggested that the dumpster be moved and this parking area and the adjacent parking area of the bank be connected. O'Farrell stated that he is pleased with the amount of parking on this site and thinks that the current parking requirements will help the City in the future. 8. Consideration and possible action regarding the commercial site plan for Disiere Office Park to be located at 205 E, Edgewood Drive. Motion to approve with staff comments: O'Farrell Second: Huss Vote: 7 --- 0 (unanimous) Motion Carried Gibson stated that there appears to be a lot of staff comments. Kabiri explained that staff received a resubmittal and all of the comments have been addressed with the exception of the TxDOT approval and that is being worked on. 9. Consideration and possible action regarding possible amendments to Appendix A — Sign Ordinance of the City of Friendswood Code of Ordinances Motion to approve: Moghaddam Second: Garcia Vote: 7 — 0 (unanimous) Motion Carried Gervais explained that the ordinance adds a definition of handheld sign which includes sandwich signs and costumes. He stated that the proposed ordinance prohibits handheld signs on public right-of-way or public property; permits handheld signs on private property visible from the street and have to obtain a permit and a letter of permission from the property owner if they are not on their own property. This proposal does not apply to political signs, which are addressed in Chapter 216 of the Local Government Code. It also requires vehicles with signage to be parked in a legitimate parking space. 10. Consideration and possible action regarding possible amendments to Appendix C -- Zoning Ordinance of the City of Friendswood Code of Ordinances, Section 15, Amendments, regarding public Bearing and notification procedures forordinances, amending, supplementing, or changing the boundaries of any district or any regulation/permitted use table. Motion to approve: Gibson Second: Holland Vote: 7 - 0 (unanimous) Motion Carried Gervais explained that State law requires a public hearing for any changes in a district or a regulation in addition to a newspaper notification published 15 days prior to the date of the hearing. He stated that a change in zoning classification requires a notice be mailed to property -owners within 200 feet of the subject property. Gervais explained that the previous discussion by P&Z was to notify property owners within 200 feet when changes were made to the Permitted Use Table, which is more that what the State requires for a change in regulation. There was further discussion about the definition of changes in a district or regulation and the wording and intent of the proposed ordinance. Gibson requested that the Subdivision Ordinance be brought to the Commission for discussion regarding notification of surrounding property owners when plats are proposed on properties with plats not approved by a governmental entity. 11. Consideration and possible action regarding future Planning and Zoning Commission meeting dates Miller reminded the Commission that the next regular meeting will be Thursday, May 20 and a JPH on Monday, June 7 at 7pm. The June P meeting will be discussed at the May 20 meeting. 12. Communications from the Commission O'Farrell thanked everyone for all the work on drainage project in the downtown area which is spurring development in the area as well. 13. Reports a. Council Liaison -- Councilman Hill stated that he appreciated O'Farrell's remarks. He stated that he attended the groundbreaking at Hometown Sank. He said it has been four years of hard work and things are beginning to happen downtown. He also added that this morning in the Galveston County Court, the David White lawsuit against the City of Friendswood was dismissed. b. Staff -none 9. The meeting was adjourned at 7:26pm.
