FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS JOINT PUBLIC HEARING The Joint Public Hearing was called to order at 7:15pm with the following people in attendance: Chairman Kevin Holland Commissioner Jim Gibson City Planner Mona Miller City Attorney Bobby Gervais Interim Director of CD Morad Kabiri Commissioner David O'Farrell Commissioner Michael Brown Dev. Coord. Aubrey Harbin Dep. Director of CD Frank Manigold City Council and Mayor Smith To receive comments from the public, both oral and written, regarding zone classification change requests as follows: A.For 5.139 acres in The Trails at Friendswood, located on Freedom Trail (previously Country Club Drive) at FM 528, from Single Family Residential (SFR) to Multi-Family Residential-Medium (MFR-M) B.For 4.693 acres in The Trails at Friendswood, located on FM 528 at Freedom Trail (previously Country Club Drive) from Multi-Family Residential -Medium (MFR-M) and Neighborhood Commercial (NC) to Community Shopping Center (CSC) C.For 4.291 acres in The Trails at Friendswood, located on Freedom Trail (previously Country Club Drive) at FM 528, from Single Family Residential (SFR) to Multi-Family Residential-Medium (MFR-M) Persons speaking in favor of the zone changes: Brett Nichols, Friendswood, Tx, stated that he is representing the owner and explained that they are asking for commercial zoning at the front of the property adjacent to FM 528 and multi­ family zoning to transition toward the detention pond which would serve as a buffer to the Single Family Residential zoning. He stated that the current zoning would allow 120 to 125 units and he is proposing 120 units. Persons speaking in opposition of the zone changes: Faye Roberson, Friendswood, Tx, stated that there is a 60-foot buffer between Windsor subdivision and the subject property, not 90 feet as previously stated. Ms. Roberson stated that she is opposed to all three zone changes. She explained that in February 2001, the owner requested a zone change from medium family residential to commercial and then changed it back to MFR. She stated that rezoning is wasting staff time and City tax dollars. She also stated that traffic from Windsor is a concern. She stated that the property owner keeps changing and is not doing anything with the property. Ms. Roberson also stated that a few weeks earlier, an 18 wheeler with large equipment was going through Sunmeadow subdivision and a car was wedged on the street because of the large trailer on the street. Norm Knight, Friendswood, Texas, stated that he is the president of the Boca Raton Home Owners Association. He explained that he is opposed to items A, B and C. He stated that across FM 528, Country Club Drive goes through his subdivision and that he is concerned with traffic, crime, property values and safety. He stated that he would like the property owner to work with surrounding subdivisions such as Boca Raton, Windsor and Sunmeadow to come up with a plan for the property. He also stated that he is concerned that the proposed Freedom Trail is going to be moved and not line up with Country Club Drive across FM 528. Chip Knowles, Friendswood, Tx, stated that he is opposed to items A, B and C because he does not have enough information. He said that he is worried that a CarMax, Wal-Mart, large restaurants will be built there. He also stated that he is concerned with overcrowding of schools. Paula Oddo, Friendswood, Tx, stated that she is the president of the Sunmeadow Home Owners Association and that she is opposed to the requests for zone change. She stated that this is one of many tweaks to the plan of the property adjacent to Sunmeadow subdivision. She stated that she would like to see a master plan with lot sizes. She said that Sunmeadow Subdivision has been in limbo for about eight years in regards to the development of this property. David Williams, Friendswood, Tx, stated that he is concerned with traffic, safety and security. He also asked about a master plan and stated that there have been several proposals for the development of the property. Burton Chapman, Friendswood, Tx, stated that his property backs up to FM 528. He explained that he purchased a home in Friendswood because of the lack of apartments. He stated that he would like a letter from Millennium development stating that apa1tments would not be built. Laura Higgins, Friendswood, Tx, stated that the town homes in Sunmeadow create on-street parking and make it difficult to get in and out of the subdivision. She stated that she does not trust the developer and that after Hunicane Ike, the property owners in Sunmeadow Subdivision worked hard to clean up their prope1ty, but the debris on the former golf course remains. Leah Jones, Friendswood, Tx, stated that she lives in Windsor Subdivision. She said that she is against the multi-family residential zoning because she does not want apaitments in her backyard. The Plann ing and Zoning portion of the Joint Public Hearing was adjourned at 7:43pm. 2 l1 ( l l SPECIAL MEETING (second floor conference room, immediately following Joint Public Hearing) 1.The special meeting was called to order at 7 :4 7pm with the following people in attendance: Chairman Kevin Holland Commissioner Jim Gibson City Planner Mona Miller Dep. Aubrey Harbin 2.Communication from the public/committee liaisons Brett Nichols explained that in regards to the location of the proposed Freedom Trail, he met with TXDOT and Freedom Trail will line up with the existing Country Club Drive across FM 528. He also explained that the Texas New Mexico easement between the subject prope1ty and Windsor Subdivision is 90 feet. He explained that TNM found power poles that they did not know existing and they are in the process of verifying the measurement. Chip Knowles stated that the same easement continues through Boca Raton and is only 60 feet. He questioned where the extra 30 feet is. Brett Nichols said that TNM is in the process of verifying the easement. Charlotte Jones, Friendswood, Tx, stated that she lives in Boca Raton and that she would like to see a green area with a wall along FM 528. She stated that there is no need for more commercial and Friendswood does not need anymore cleaners, nail salons or fast food establishments. Laura Sanders, Friendswood, Tx, stated that she is concerned with kids crossing FM 528, which adds to safety concerns. Chip Knowles stated that the school district does not allow kids to walk to school in that area because of the hazard of crossing FM 528. He also stated he is not sure what the interest is in selling this subject property as commercial if there are adjacent commercial prope1ties that are not selling. 3.Consent Agenda: a.Approval of Minutes for the November 17, 2008 special meeting b.Approval of Minutes for the December 4, 2008 regular meeting Motion to Approve: Brown Second: Gibson Vote: 4 to O (unanimous) Motion Carried 4.Consideration and possible action regarding a zone classification change for 5.139 acres, in The Trails at Friendswood, located on Freedom Trail (previously Country Club Drive) at FM 528, from Single Family Residential (SFR) to Multi-Family Residential -Medium (MFR-M) 3 Motion to table items 4, 5 and 6: Gibson Second: O'Farrell Vote: 4 to O (unanimous) Item Tabled Chairman Holland read the definition of the Multi-Family Residential Medium zoning for clarification to commissioners and citizens. There was some discussion regarding the density that would be allowed in the MFR-M zoning category.
