JOINT PUBLIC HEARINGS
MONDAY, NOVEMBER 3, 2008

The meeting was called to order at 7:15pm with the following people in attendance:
Chairman Kevin Holland
Commissioner David O'Farrell
Commissioner Hassan Moghaddam
Development Coordinator Aubrey Harbin
Int. Dir. Of CD Morad Kabiri
Commissioner Jim Gibson
Commissioner Ruben Garcia
City Planner Mona Miller
Building Official Frank Manigold
1.Discussion with City Council regarding amendments to the City's Utility Impact Fee
Study
Kabiri explained that the state requires cities to update their impact fees every five years
and that the proposed amount of $3100 would compensate for approximately half the cost
of the future capital improvement projects. He also stated that staff supports the increase
and that impact fees of surrounding cities are more that this proposed amount.
Chairman Holland stated that the build out population in the impact fee report is 57,400
and that the Local Government Cod_e says that the fees cannot be increased because the
City already has capacity. Kabiri explained that the fees can be increased install the
infrastructure to deliver the water.
Mayor Smith asked when a developer/builder becomes vested in the impact fee amount
and Kabiri said that they become vested when a preliminary plat is submitted. Mayor
Smith said he would like to do some research to determine if the amount of the impact
fee influences builders to build on larger lots.

7:00 PM -JOINT PUBLIC HEARING (COUNCIL CHAMBERS)
The joint public hearing was called to order at 7 :32pm with the same people in attendance.
To receive comments from the public, both oral and written, regarding proposed amendments to
Appendix C of the Zoning Ordinance, specifically:
1.Amending Appendix C, Zoning Ordinance of the City of Friendswood Code of
Ordinances, regarding permitting Other Amusement and Recreation Industries in
Light Industrial and Industrial zoning districts without a specific use permit
None
The joint public hearing was adjourned at 7:33pm.
SPECIAL MEETING {IMMEDIATELY FOLLOWING JOINT PUBLIC HEARING,
COMMUNITY DEVELOPMENT CONFERENCE ROOM, SECOND FLOOR)
1.The special meeting was called to order at 7:35pm with the same people in attendance with
the exception of Int. Dir. of CD Morad Kabiri.
2.Communication from the public/committee liaisons
None
3.Consideration and possible action regarding Zone change request for 4.6212 acres on
FM 2351 from SFR to Business Park (tabled 10-20-08)
Motion to approve: Gibson
Second: Moghaddam
Vote: 5 to O (unanimous) Motion Carried
There was some discussion that the BP zone would be a good buffer between the CSC
and residential zonings on each side of the property. Staff also explained that newspaper
notifications were published and owners within notifications were mailed to property
owners within 200 feet. The owner notification on the adjacent property went to the
former owner because they are still listed as the owner of record on the Galveston County
Tax Records.
4.Consideration and possible action regarding possible amendments to Appendix C, Zoning
Ordinance of the City of Friendswood Code of Ordinances, Permitted Use Table, to
permit Other Amusement and Recreation Industries in Light Industrial and Industrial
zoning districts without a specific use permit
Motion to approve: Moghaddam
Second: Gibson
Vote: 5 to O (unanimous) Motion Carried
Commissioners verified with staff that no adult entertainment businesses are allowed in2

this zoning category and that this action is to correct and unintended consequence.
5.Consideration and possible action regarding possible amendments to the City's Utility
Impact Fee Study
Motion to approve the impact fee study with the recommended increase: Holland
Second: Gibson
Vote: 5 to O (unanimous)
