MINUTES OF A
SPECIAL MEETING
MONDAY, AUGUST 4, 2008

1.The meeting was called to order at 7:25pm with the following people in attendance:
Chairman Kevin Holland
Commissioner Jim Gibson
Commissioner Hassan Moghaddam
City Planner Mona Miller
Vice Chairman Mark McLean
Commissioner Ruben Garcia
Commissioner David O'Farrell
Admin Secretary Rhonda Baker

2.Discussion with the City Council regarding:
a.Amendments to the Zoning Ordinance regarding Non-conforming Uses
b.
and Structures
Morad Kabiri explained the proposed amendments. City Council agreed
that allowing a property to exist as a non-conforming use or structure for
twelve months rather than the previous allotted six months was a good
idea and asked P&Z to move forward with their recommendation.
Moving the parking table from the Design Criteria Manual to the
Zoning Ordinance and parking requirements
Morad Kabiri explained that this item proposes to move the parking table
from the Design Criteria Manual to the Zoning Ordinance since the
parking recommendations are based on the type of use. Chairman Holland
explained that the parking table was previously in the Zoning Ordinance,
but then it was moved to the DCM. There was some discussion regarding
the amount of flexibility the City can exercise if the table remains in the
DCM.Mayor Smith suggested possibly needing both a minimum
requirement and flexibility. Kabiri explained that staff is working on
numbers to replace the TBD categories that are cunently in the parking
table. The recommendation was made for P&Z to workshop this item.

c.Landscape requirements for commercial tracts deeper than 300 feet
Morad Kabiri explained that this item was generated by a recent proposal
to rezone a 17 .88 acre tract of land. An advantage of requiring more
landscaping is aesthetics and a disadvantage is requiring more of the
property for landscaping. In general, Council agreed that the City would
like increased landscaping on large commercial tracts, but present only as
a guideline.
d.Design Criteria Manual
Morad Kabiri explained that currently the Design Criteria Manual is still
an ordinance. City Council motioned to rescind it as an ordinance, but the
only way to rescind an ordinance is to write a new one to replace it with.
Kabiri explained that staff and P&Z have been reviewing the DCM and
have established a list of recommended changes to make the DCM strictly
engineering standards, but that a clause would be included that in case of
any conflict, the Zoning and Subdivision Ordinances would prevail. The
recommendations will to go to P &Z first, and then be forwarded to
Council. Mayor Smith stated that he likes the idea of giving P&Z and
ZBOA practicality. Councilman Mike Barker said the DCM was meant to
be rescinded and it should be rescinded.

18.922 acres at 1700 W. Parkwood (FM 528), from Single Family Residential (SFR)
to Community Shopping Center (CSC)
Motion to remove from table: Gibson
Second: Moghaddam
Motion to recommend zone change to CSC: O'Farrell
Second: Garcia
Vote: 5 to 1 (McLean opposed) Motion Carried 2

There was some discussion regarding increased landscaping requirements on commercial
tracts deeper than 300 feet. Owner of prope1ty will be required to comply with ordinance
that is in effect when application for site plan approval is submitted for project.
3.Consideration and possible action regarding Zone classification change request for 7.926

Vote: 6 to O (Unanimous) Motion Carried
Commissioners verified that the ownership issue discussed at the last public hearing was
cleared up; Brett Nichols verified that the property with the trees is owned by the owner,
Mr. Tiejde. Commissioners asked that the owner take the sunounding homeowners'
concerns into consideration when developing the prope1ty.
