WARD Superintendent November 30, 1973 i Mrs. Ivy Fossler, Chairman Board of Adjustments 917 Merriwood Friendswood, TX 77546 Dear Mrs. Fossler : The Board of Trustees of the Friendswood Independent School District would like to appeal to the Board of Adjustments to grant the school district a variance to build a bus service facility on its property location on the Junior High campus next to Woodlawn Street, due to a financial hardship. The School District owns all the property around the facility, and Mr. Floyd Brown, Sr. , the only land owner across from the proposed site, has verbally approved the location of the bus facility. The. bus service facility is in violation of the City' s zoning ordinance No. 174 which requires that the building be set back a minimum of 25 feet from the right-of-way line. The construction on the bus service facility had already been started when the violation was brought to our attention. Our school architect estimated an additional $3 ,000 to move the facility in order to conform with the present zoning ordinance. The reason for locating the facility at the present site was due to program and cost considerations. These include: (1) Using as little land as possible for the bus facility so as not to deprive the Junior High School students of an adequate , amount of land for their physical education program, and (2) Having a facility for buses close to the gas pump, the old Mrs. Ivy Fossler Page 2 November 30, 1973 bus garage where some equipment will be stored, and close to the Maintenance Department. The following members were present: Dick Warren, President Marilyn Lunney, __Vice President George Roy, Secretary Dr. Jack Bridwell Mrs. Ruby Ross Dr. John F. Ward, Superintendent of Schools Mr. Ted L. Thomas, Assistant Superintendent Mr. Charles Baumgardner, Director of Maintenance and Operations Absent: C. W. Cline, H. K. Speck Guests: Leah North; Carolyn Kelly CLOSING OF ROAD FISD #1 Mrs. Lunney made the motion, seconded by Mrs. Ross, to accept the recommendation of the administration that the road (FISD #;1), located adjacent to the Junior High campus, in the interest of, safety, be closed to any through traffic, effective December 21, 1973. Should a better or safer solution be found in the future, the Friendswood Independent School District reserves the right to pursue this alternative course of action. The following excerpt from the official minutes reflects the Commission' s action on this matter: "Motion -was made .by Raney, seconded by Shore, that a letter be sent to the School Distri.ct recommending that through traffic be permanently prohibited on ."FISD 1" regardless of the outcome of the bus barn. controversy for purposes of safety. M.ot.ion passed unanimously." (Present and voting were Spears., Raney, Shore, . . North. Absent were: Bost,. Phillips.] The general feeling of. the Commission was •that the through drive was -not necessary -and .that it-presented an unnecessary hazard to the children who had to .cross it -to get from the school to the playing field. Bost, Chairman Friendswood Planning and Zoning Commission 109 Willowick Friendswood, TX 77546 Dear Mr. Bost: At a special meeting held by the Friendswood Board of Trustees on December 18 , 1973; the -Board took action which closed the school' s street on the Junior High School campus to through traffic, effective December -21, 1973. The school district received street signs on Thursday, . January 3; 1974, to be placed at both ends of the street to notify all people that the street is closed. When these signs are in place, the 'through traffic will no longer be a safety problem in this area. However, if people do not observe this manner of closing the street, barricades will be placed at both ends of the street. We appreciate your concern in this matter and encourage you to continue your efforts to solve. other problems involving safety throughout .the City. Sincerely, Dickie K. (1) i MINUTES OF A MEETING OF THE FRIENDSWOOD BOARD OF ADJUSTMENT 4 ' December 17, 1973 ' - j 4 The following Board Members were present: Mrs. Ivy Fossler, Chairman Mr. Bruce Foster, Co-Chairman Mr. George Rummel , Secretary Mr. William E. Dykes Mrs . Bernice Box Mr. William H. Taylor Absent: Mr. Jesse H. Williams - The meeting was brought to order by Mrs . Fossler at 7 :45 P.M. Mrs. Fossler stated that the business to be acted upon was a variance in the set-back restriction of a building to be used to repair school buses for the Friendswood Independent School District on property owned by the School District. The location is on the corner of Woodlawn and a private access road known as `FISD l ." This private "street divides the school property between the Junior High School and the Athletic Field. Several School Board members and employees of the School District were present to present their case. They advised that the foundation was already in place and' hook- ups had been made'-to the building for water and'-sewer at an, estimated expenditure of $$900.00 to $1000.00. The exact property line seems to .be in doubt as this property has not been surveyed for many years, but it is estimated that the foundationlis one (1 ) to two (2) feet from the Woodlawn Street ,right-of-way, which is in violation of 'the building code. ' For some reason the Friendswood Planning Commission never re- viewed the plat plan because of the way it was filed,.. -Mr. Jones did approve the building permit. The reasons given for locating the building so close to thelWoodlawn right-of-way were (1 ) best possible use of the land (2) there is a 2000 gallon gas tank and pump at this location and in order to squeeze the building between this pump and the Woodlawn right-of-way it had to be extended onto the easement. { Mrs. Leah North, a member of the Friendswood Planning Commission, filed a complaint against this location for safety and aesthetic reasons. The building creates ;,a "blind corner" because of its closeness to Woodlawn, which could cause traffic accidents. FISD 1 is a one way street at, certain times of the day but can be; and is, used for traffic going both way when these one way restriction periods do not apply. The proximity of the building to Woodlawn sets it out about 25 feet closer to ;the street than the Junior. High Building, which will ruin the appearance of the property and bring it too close to the homes across the street. The school representatives said that the property facing this building is owned by Mr. Floyd Brown. Mr. Brown had been consulted and had no objections to this location. They also said that moving the building as suggested by Mr. Foster would cost ,con- siderable money that the School Board did not have and also take up some land 'now used as an athletic field. '"a , �, r i , '•i i ,1, r t � � '� , , 'Board of Adjustment Minutes Meeting of December 17, 1973 Page 2 representatives .said the danger of accidents could be overcome by (1 ) blocking the private road "FISD 1 " off entirely to any traffic or (2) making this street one way at all times with traffic to flow off of Woodlawn onto FISD 1 . Motion was made by Rummel , seconded by Taylor, that the variance be granted. An 'amend- ment to the motion was made by Foster, seconded by, Box, that the School Board meet and pass necessary regulations regarding traffic on FISD 1 to ensure that its use by vehicles be such that accidents would not occur at this "blind corner". The amendment was passed unanimously by the Board of Adjustment. The Potion was passed unanimously by the Board of Adjustment. A request was made to Dr. John Ward, who was present, that the Board of Adjustment be advised of the action taken by the School Board. He agreed to do so. Mrs. =ossler advised that the Board of Adjustment would meet on January 7, 1974 to consiler a request by Mr. Glines to operate a barber shop in his home, which is in a residential location.
