Dea.r Mr. Lindsay:
Although the Planning Commission voted favorably on your
request for variance on the plat of 'Quaker"s Landing, See-
tion 2, at the 11 February 1971 meeting, further reading
of the FrIendswood Zoning Ordnance 132 Indicates that the
Commission Is not authorized to grant a variance. Written
application for zoning variances must be made to the Board
of Adjustment, and a public hearing must be held before a
variance can be granted. Please- refer to Section 11, gars.
graph3 of City Ordnance 132 for the exact proeedure. Ap-
plication may be made through the Major-1,.s Office$ City of
Friendswood.
The Commission membeirs sincerely regret the erroneous
action of 11 February, and will Inform the Board of Adjust-
ment of its favorable reaction to .your organization's
request for va dance.

have requested a variance in the City of Friendswood "Zoning -
Ordinance as follows: -
To change ;the rear set-back on platted lots along
Clearview 'Drive from the required 25 feet to 10 feet.
In compliance with procedure as set forth in the Zoning Ordinance,
a public hearing will be held by the Friendswood Planning and '
Zoning Commission at the Friendswood :City Hall -at. 8:00 p m,=:on
Friday, March 19, 1971, at which time adjoining property, .owners _ k

to protest this variance.

Gentlemen:

You have requested an opinion concerning the procedure to be
followed by Norwood Homes in requesting a variance from the
zoning ordinance. May I recommend the following:
The zoning ordinance sets forth the procedure for
requesting variances in Section 11, 3, a, subsections
(1) , (2) , (3) , and (4) . The ,applicant must state i
in his application that .none of the four points in 1
the above section will be violated by the requested
variance. Rather than set forth these points in
detail, I simply refer your attention to that- section
of the ordinance. I am sending a copy of the- ordinance j
to Norwood Homes to the attention of Mr. Don Lindsay
and a request that he prepare his written application
with these exceptions in mind.

Dear Mr. Cline:
Subject: Request for Variance in Friendswood Ordinance No. 132 (Quakers
Landing, Section II)
When Norwood Homes, Inc. developed Quakers Landing, Section I, the rear build-
ing line set-back requirement was ten feet. At that time, the Quakers Landing
brick and wrought iron entry fence was constructed on that building set-back
line.
Friendswood Ordinance No. 132 now requires a 25-foot rear building set-back.
Norwood Homes is requesting that a variance to the ordinance be granted so that
we can continue the fence along the same ten-foot building line parallel to
Clearview Avenue. Norwood Homes, Inc. guarantees full compliance to Section
II, 3, a, Subsections (1) , (2) , (3) and (4) of the above-mentioned zoning ordi-
nance. Any consideration given this matter will be highly appreciated.
