Home My WebLink About ZBOA Decision 01/09/1979 MINUTES OF A PUBLIC HEARING HELD BY THE FRIENDSWOOD ZONING BOARD OF ADJUSTMENT January 9 , 1979 The meeting was called to order by the Acting Chairman George Rummel, with the following members present : Regular Members : George Rummel Ray Nelson William Dykes Alternate Members : Andy Knight Elvia Salyer City Manager Jim Morgan designated alternates Andy Knight and Elvia Salyer as voting members of the Board of Adjustment for this meeting. The proceedings were as follows : SUBJECT: A request by Walter L. Staron to build a heated enclosed swimming pool for theraputic swimming pool to be used on a daily basis year round by daughter Suzanne who has schleraderma. After discussion and presntation of plans , George Rummel moved, and Ed Dykes seconded that a variance to the City ordinance on rear setback be approved pending written notification by the neighbor immediately to the rear of Mr. Staron stating that the neighbor has no objection to Mr. Staron' s structure or the structure ' s placement. The motion passed unanimously. SUBJECT: A request by Robert Laguarta for a variance to the City' s sign ordinance. After a presentation by Mr. Laguarta and a general discussion including counseling by the City Attorney John Olson , Mr. Dykes moved and Ray Nelson seconded that --the Board take the matter under advisement until another meeting can be scheduled, but in any event the meeting will be held not later than the week of February 5 , 1979 . The vote was : Ray Nelson , George Rummel, William Dykes and Andy Knight in favor and Elvia Salyer against . The motion carried. Ed Dykes moved and Andy Knight seconded that the meeting be adjourned. Mr. La Guarta: At a special meeting of the Friendswood Board of Adjustment held on Tuesday, January 16 , 1979 , a motion was made and passed that your application for a variance of a sign approx- imately 72 square feet in size be granted. This sign is to be erected at Roberts Auto Parts , 306 Friendswood Drive, i Friendswood, Texas . Included in the granting of this variance is a proviso that I the bottom of the sign be eight ( 8) feet from the ground grade level. This letter is a notice of the Board of Adjustment decision. Closed Executive Session under Section 2 (2) Article 6252-17 of Vernon' s Texas Civil Statues 2 . Report from the City Attorney, John Olson, regarding Ordinance No. 323 (signs) 3 . Consideration of and action, if deemed appropriate, on the application for a variance on sign size by Mr. Robert LaGuarta at Roberts Auto Parts 4 Regular Members Present: Bruce Foster, Chairman George Rummel, Secretary Hal . Taylor Alternates Present: Andrew Knight ; Mrs . Elvia Salyer The meeting was called to order by Mr. Foster at 7 : 45 p.m. in th'e Friendswood Council Chambers . Mr. Foster appointed Mr. Andrew Knight and Mrs . Elvia Salyer as voting alternates for this meeting in the absence of two regular members: Dykes and Nelson. The Chairman, Mr. Foster, ordered the meeting into a closed Exec- utive Session as the first order of business . This session was held in the Mayor' s office. Bobbie Henry, City Secretary, John Olson, City Attorney, and George Calk, City Building Inspector were present at this closed session in addition to the regular members and alternates . After the Executive Session, we all returned to the Council Chambers . The Board members agreed that the Robert La Guarta case be taken up where we left off on January 9 , 1979 . This request by Mr. La Guarta for a variance on a sign with 72 square feet has been under consid- eration since August 9 , 1977 . Mr. Rummel made the motion, seconded by Mrs . Salyer, that a vari- ance be granted to Mr. La Guarta to erect this sign at Roberts Auto Parts with the proviso that the bottom of the sign shall be eight ( 8) feet from the ground grade level. After a short discussion, this motion was passed unanimously byll the board. In the last order- of business , . Mr. John Olson, City -Attorney, explained the new Sign Ordinance , No . 323 , effective December 18, 1978 . From here on out, all decisions on sign applications for signs not erected before the effective date of December 18 will be judged by Ordinance 323 . -2- ,a Motion made by Taylor, seconded by Salyer, that the meeting be adjourned. We feel their request sets a particularly bad precedent and that if followed by signs of similar magnitude will create the kind of ugly jungle along our main thoroughfare that we believe the majority of Friendswood's citizens would strongly oppose. We feel that the existing restriction of signs to five by ten allows merchants adequate display of their messages and at the same time preserves some modicum of the beauty and good taste we hope to maintain in our downtown area. It was a wise decision and one we fervently hope will be adhered to. • Thank you for your interest in preserving the appearance of our community. Laguarta, 226 St. Cloud, is building the Robert Auto Parts building at 306 Friendswood Drive. The Building Inspector (and Zoning Administrator) has refused the plans for a 12 x 36 ft. sign. Laguarta says that the permitted 5 x 10 ft. would be far inadequate; that a 10 x 15 ft. would be minimum. His written statement reads as follows : "The sign will be lit from the bottom edge of the sign in an upper direction by mercury vapor light. The sign will be on light poles and made of exterior marine plywood. It will also be boxed in on all sides except the bottom. It will be tenrfeet from the bottom of the sign to the ground. There will be four all-weather mercury vapor lights on the sign; twoiper• side. The color will be a chrome yellow (same color as highway signs) with black letters . The electricity! on the sign will be 220 . There will also be no other signs added to these signs at a later date. " Robert E.
