COMMISSION, HELD MONDAY, MARCH 19, 2007, AT 7:00 PM, IN THE CITY HALL
COUNCIL CHAMBERS, LOCATED AT 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD,
TEXAS
1.Call Joint Public Hearing to order
The meeting was called to order at 7: 17 pm with the following present:

2.Receive comments from the public, either oral or written, regarding the following:
A.Zone Classification change for a tract of land containing 5.293 acres, being in the Mary
Sloan Survey, A-184, property located on FM 528 adjacent to Sumneadow Subdivision,
south of Country Club Drive, Galveston County, TX, from Neighborhood Commercial
(NC) and Multi-Family Residential -Medium (MFR-M) to Conununity Shopping Center
(CSC).
B.Zone Classification change for a tract of land containing 9.071 acres, being in the Mary
Sloan Survey, A-184, property located on FM 528 adjacent to Suruneadow Subdivision,
between Cypress Point Drive and Sumneadow Boulevard, Galveston County, TX, from
Single Family Residential (SFR) to Community Shopping Center (CSC).
C.Zone Classification change for a tract of land containing 17.847 acres, being in the Mary
Sloan Survey, A-184, prope1ty located northwest of FM 528 adjacent to Sunmeadow
Subdivision, at the end of Country Club Drive, Galveston County, TX, from Single
Family Residential (SFR) to Multi-Family Residential -Medium (MFR-M).
D.Zone Classification change for a tract of land containing 39.384 acres, being in the A.H.
Jackson Survey, A-128, property located at 1700 FM 528, near Friendswood Lakes
Boulevard, Galveston County, TX, from Single Family Residential (SFR) to Conununity
Shopping Center (CSC). (Manning Estate)
Brett Nichols, agent for Millenium Development, spoke in support of the zone change requests.
He stated that they are requesting commercial zoning because they believe that is what the City
wants.
Barbara Richardson spoke in opposition to the requests. She expressed her concern for the
proposed development encroaching on her property and drainage problems that might occur.
Jacquelyn Burkett, President of the Sunn1eadow Homeowner's Association, explained that she is
concerned about the green space at the entrance of the subdivision and the requested zone change
impacting home values.

Charles Miller, resident of Sunmeadow, stated that his home backs up to the property that is
currently the 17'11 hole of the golf course. He sited concerns with decreasing home values and
additional vacant strip centers in Friendswood.
Chris Leslie explained that he tried to gather information on how much commercial square
footage the City currently has and how much of that is vacant. However, he was unable to get
that information. He encouraged Council to get this information prior to approving more
comm ercial zoning.
Jean Henkly stated that she lives near the 17'11 green. She added that her home has never flooded;
however, her yard is now beginning to hold more water. She expressed concern that adding
concre te for commercial use would cause flooding.
Faye Roberson spoke in opposition to all of the zone changes. She encouraged the developer to
work with the Community Development department and the Planning and Zoning Commission
to develop an overall development plan for the project.
Jeri Jobe reiterated the fact that the City does not need more strip centers. She explained that she
currently lives next to a convenience store and liquor store. She stated that no matter how well a
store is managed, there are still problems with the patrons. She suggested a park be built on hole
# 17 and smaller homes or town homes for the property on Country Club. Ms. Jobe also
expressed her concerns with flooding and a maintenance district.
Ned Sheryl, questioned whether there would be residential on the thirty nine acre tract. He also
asked if the zoning would revert back to residential if the commercial development did not work
out. He encouraged the Council to not allow access to this development tlu·ough Windsong.
Dan Tidwell stated his concerns about drainage. He explained that Windsong subdivision is on
well and septic systems. He expressed additional concerns regarding a stop light and allowing
access to their neighborhood.
Tonuny Blake, a Windsong resident, explained that he has lived in his home for twenty five
years. He questioned whether Millenium Development had purchased the sixty foot drainage
right of way and why he was not given the option to purchase it. He sited concerns regarding
flooding and the golf cart route.
Lisa Hernensky expressed her concerns with the nine acre tract developing as Commercial. She
stated concerns for the school children's safety, increased traffic, higher incidents of crime,
drainage problems and decreased home values.
Al Kelly spoke in opposition to Items B, C and D. He sited concerns for redeveloping one hole
of the golf course, the density of the proposed multi-family and the amount of commercial being
requested on the thirty nine acre tract.
Scott Robertson of Windsor Estates, explained that he currently backs to green space. He added
that he does not want to look at a shopping center. He pointed out that the current shopping
centers are only at thirty percent or less capacity.

Randy Dean stated that he has lived in Sunmeadow for twenty four years. He reiterated that
Friendswood does not need another shopping center. He encouraged the developer to keep all of
the golf cotll'Se out of the redevelopment plan until the plan is approved. He stated that he is
probably okay with the multi-family rezoning depending on what they are proposing there. Mr.
Dean also asked if it was possible to approve rezoning with limits and whether a time limit can
be placed on the zoning.
Dan Tidwell explained that there is a huge, high pressure gas line (16,000 PSI) that runs between
Windsong and the thirty nine acre tract.
Commissioner Holland asked Brett Nichols to come forward and answer a few questions. In
response to the question of why to rezone without a development plan, Mr. Nichols explained
that they want to rezone now in order to determine how to develop. In regards to the drainage
questions mentioned, Mr. Nichols stated that once they get the property rezoned, they will hire
an engineer to perform a drainage study.
Mr. Nichols explained that they have asked for commercial zoning on the thirty nine acre tract
primarily because it fronts FM 528 and the proposed Brittany Bay Boulevard. He stated that
they may build casitas across the back of the tract. He added that Council Member Peden asked
that the five acre tract be rezoned. In addi tion, Mr. Nichols stated that a portion of the seventeen
acre tract is in the flood zone, so it is almost an even swap. He explained that hole #17 has
always been planned for commercial use with a narrow section for Par 3 or Par 4.
When asked about the drainage easement near the thirty nine acre tract, Mr. Nichols explained
that it was never conveyed to the drainage district; therefore, they purchased it. Commissioner
Bertrand clarified that, as far as they were aware, Millenium was showing only property that they
currently own. Mr. Nichols agreed.
