FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS The joint work session was called to order at 5:01 pm with the following people in attendance: Chairman Kevin Holland Commissioner Mike Huss Commissioner Ruben Garcia City Attorney Bobby Gervais City Council Dep. Director of CD Frank Manigold Vice Chairman Mark McLean Commissioner David O'Farrell Commissioner Hassan Moghaddam Planner Mona Miller Int. Director of CD Morad Kabiri Discussion with City Council regarding possible amendments to: A.Appendix C, Zoning Ordinance of the City of Friendswood Code of Ordinances, Section 20, Definitions, P. Home OccupationKabiri explained the process to this point. P&Z proposed three possible amendments for discussion including limiting traffic to 16 trips per day, adding verbiage prohibiting parking on the street and blocking sidewalks, and allowing two.non-residents to be employed at the home occupation. Chaiiman Holland stated that P&Z did have discussions about not allowing non-residents to be employed by the home business. McLean explained that was a complaint of a lot of citizens and opens up a lot of concerns. Councilman Rivera stated that he has received more calls on this than many other issues and does not see a need to amend the existing ordinance. Councilman Barr stated that he liked the proposed changes, but non-resident allowance may need to be removed. Police Chief Wieners added that HOA deed restrictions also regulate home occupations. Mayor Smith explained the differences in City ordinances and deed restrictions and that they are handled by different comis. B.Aliicle V of the City of Friendswood Code of Ordinances, Section 26-152, Definitions, Junked Vehicles 1 Kabiri explained the history of the item to date and explained that the current City ordinance conflicts with State law. Mayor Smith explained that City Council will be reviewing the nuisance ordinance soon, as well as visual nuisances. Councilman Hill asked if we can add a statement that in the opinion of the Code Enforcement Officer, the vehicles are irreparable. Gervais said it may be possible to expand the junked vehicle definition. The joint work session adjourned at 6:36pm. Director of CD Frank Manigold 2.Communication from the public/committee liaisons Jed Guillege asked that P&Z review a section of the Zoning Ordinance, specifically Section 8 B. Fences, walls and hedges. He asked that the ordinance be changed to allow one acre lots to build a fence in front of the building line. He stated that he thought the ordinance should be equal for all citizens, not just highway roads. He provided details of his personal experience with the building depai1ment and code enforcement. He was cited by Code Enforcement for fencing a 1.7 acre tract without a building permit and because the zoning ordinance does not allow it. Commissioner McLean acknowledged his request and asked staff to place the item on a future agenda for further discussion. 3.Consent Agenda: a.Approval of minutes for the March 23, 2009 special meeting b.Approval of minutes for the April 2, 2009 regular meeting Motion to Approve: McLean Second: Holland Vote: 6 to O (Unanimous) Motion Carried 4.Consideration and possible action regarding the final plat of West Ranch Reserve F, being a subdivision of 46.79 acres of land out of the John Dickinson Survey, A-15 & Sarah McKissick Survey, A-549 City of Friendswood, Harris County, Texas Motion to Approve: McLean Second: Garcia Vote: 0 to 6 (Unanimous) Motion Failed Miller explained that the plat was submitted as a short form final plat which cannot create easements. Staff reviewed the plat and provided comments; however, we received2 I comments from Hanis County Flood Control District requesting additional easements and ROW. The options for including the additional easements on the plat are either the preliminary/final plat process or record the easements by separate instrument and move forward with the sho1t form final plat process. The applicant did not have time to record the additional easements by separate instrument, and the Commission is required to act on the plat within 30 days because it is a final plat. McLean stated that the Commission should not approve the plat because is does not show all required easements. Moghaddam stated that the plat is incomplete. 5.Consideration and possible action regarding possible amendments to Appendix C, Zoning Ordinance of the City of Friendswood Code of Ordinances, Permitted Use Table, NAICS use #8111, Automotive Repair and maintenance Motion to Table: McLean Second: Holland Vote: 6 to O (unanimous) Item Tabled ' • l Miller explained that the intent of this proposed ordinance change is to eliminate the parking of wrecked cars waiting for service at auto body shops on the major thoroughfares of the City. She explained two options of changing the Zoning Ordinance. 1)Extend the definition of use #8111 and require Specific Use Permits in CSC zoning to ensure that screening is provided on the site. 2) In the Zoning Ordinance, the performance standards section #6 is specific to Auto Repair Garage and verbiage could be added to require screening of vehicles. Staff also provided the Commissioners a copy of the COD requirements, which would cover other concerns such as screening on major thoroughfares. Commissioner O'Farrell left at 7:08pm. 6.Consideration and possible action regarding May, 2009 Planning and Zoning Commission meeting dates Motion to move May 7 meeting to May 4: Holland Second: Moghaddam. Vote: 5 to O (unanimous) Motion Carried 7.Discussion regarding review and possible amendments to City of Friendswood, Code of Ordinances, entire Appendix C -Zoning Ordinance No action taken. 8.Discussion regarding "Boot Camp" topics McLean thanked Mona for putting the books together and asked the Commissioners to read over the information. Kabiri will give presentation on the information May 21, 2009. 3 9.Communications from the Commission None 10.Reports a.Council Liaison -None b.Staff-Miller reminded the Commissioners that there will be a JPH on May 4, 2009 11.The meeting was adjourned at 7:20pm.
