As you know, the legislature changed the law on the assessment of impact fees in developing areas. Our Impact Fee Ordinance has been modified to meet the requirements of that new law. As a result of those modifications, the Finance Department has developed a list of individuals and companies due a refund. That list is attached for your review. You will notice that the total refund is in the amount of $227,484.38. These impact fee refunds have been developed by Lynn Bucher and extensively reviewed by Roger Roecker and our City Attorney John Olson. We are ready for you to authorize the refunds. John Olson has indicated this does not require ordinance action, just simply a vote recorded in the minutes. The list includes many companies and individuals who have paid a single fee to the City and are receiving a refund of the amount overpaid. It also includes several companies which have paid multiple impact fees; the largest of this group being Brighton Builders with a refund due in the amount of $108,904.98.- Fees totalling $532,993.00 were collected during the fiscal years 1.987-88, 1988--89 and 1989-90. There are three entries noted by a single asterisk. These are fees collected for sprinklers and pools. Since there is no impact fee currently in place for these, the entire amount is being refunded. There is also one item highlighted with a double asterisk. This fee is related to a park within the City. Since the impact fee study does include parks in its calculation of equivalent connections, a policy decision is needed as to whether to hold this fee or return it to the payer. 1 AGENDA ITEM My Council Date City of Friendswood Summary of Deferred Impact Fee Refunds Fiscal Years 87-88, 88-89, and 89--90 Builder/Owner Amber Custom Homes American Craftsman Homes Atlantis Homes Bacliff Service Donald Barcak Brighton Builders John Clark CLS Construction David Offenburger Watson Dupont/Desiree Custom Homes Dick Pools Dittrich Homes Dynasty Homes, Inc.
