HomeMy WebLinkAboutGC CC Order 1960-11-01 - Articles of Incorporation f 1 1 RE: FRIENDSWOOD INCORPORATION BE IT REMEMBERED: That on the /5f day of l✓olit Af 9! , 1960, there came on to be considered the re�rns of an election eld on October 15, 1960 in the Town of Friendswood, to determine whether or not it should be incorporated under the provisions of Chapter 11, Title 28, Revised Civil Statutes of Texas 1925, as amended : And it appearing affirmatively : (a ) That said election was regularly Ordered upon proper Petition for same; (b ) That such election was regularly held in accordance with the laws applicable thereto and with the Order of the County Judge of Galveston County, Texas calling such election; (c ) That the returns of said election were on the 17th day of October, 1960 regularly made to the County Judge of Galveston County, Texas as by law provided; (d ) That at such election 143 votes were cast in favor of incorporation of the Town of Friendswood and 26 votes were cast against it; and, (e ) The proposition to incorporate the Town of Friendswood carried by a majority vote of qualified voters voting at said election : NOW, THEREFORE, it is found and it is hereby ORDERED, ADJUDGED and DECREED that the inhabitants of said Town of Friendswood be, and they are, incorporated as the Town of Friendswood and that said Town is described by metes and bounds as follows : BEGINNING at the point on the Galveston County side of Clear Creek where the common line between the Jas. F. Perry and IInily F. Austin Survey, and the Sarah McKissick Survey both in Galveston County, Texas, intersect said creek; THENCE in a southwesterly direction along said line between said two surveys to the most southerly corner of Lot 21, (same being the most easterly corner of Lot 20 ), of the Hoidale & Coffman Subdivision of the Perry & Austin Survey or League; THENCE in a northwesterly direction along the common line between said Lots 21 and 20 extended (along which line runs the Old McClure Road now known as Melody Lane ) to the most northerly corner of Lot 18 (same being the most easterly corner of Lot 17 ) of the Hoidale & Coffman Subdivision; THENCE in an southwesterly direction along the common line between Lots 17 & 18 and Lots 3 & 4 of said Hoidale & Coffman Subdivision and continuing along a straight line extended to the northeasterly line of F.M.Road No. 518; THENCE Southeasterly along F.M.Road No . 518 to the most northerly corner of the Sarah V. Pearson 26.9 acre tract of land out of the Perry & Austin League, same being also the most easterly corner of the C.A.Eignus Estate 306 acre tract of land cornering at the inter- section of F.M. Road No. 518; THENCE in a southwesterly direction to the most westerly corner of the Eignus Subdivision out of the C. A.Eignus Estate land in the Perry & Austin League; THENCE in a southeasterly direction along the southwest line of the Eignus Subdivision to the point where it intersects the common line between the Perry & Austin Survey and the Sarah McKissick Survey (along which common line Choate Road is located; THENCE in a southwesterly direction along said common line (Choate Road ) between the Perry & Austin Survey and the Sarah McKissick Survey to the most westerly corner of Lot 2 (same being also the most northerly corner of Lot 3 ) in Block 1 of Friendswood Subdivision of the Sarah McKissick Survey; THENCE Gegt-lntA� in a southeasterly direction along the common line between said Lots 2 & 3 of said Friendswood Subdivision as such line is extended to the intersection of the northwest line of F.M. Road No . 528, same being the point of intersection of F.M.Road No. 528 with F.M.Road No. 518; THENCE in a northeasterly direction along the northwest line of F. M. Road 528 to its intersection with the Old Friendswood-League City Road, that point being the most southerly corner of Shell Dnployees Recreation Assn.45.97 acre tract of land and the most southerly corner of Lot 5 of the A. Voss Subdivision out of the Sarah McKissick Survey; THENCE in a northwesterly direction along the southwesterly line of said Lot 5 to the most westerly corner thereof (same being the most southerly corner of Lot 4 of said A. Voss Subdivision and the Keith J. Smith 35.03 acre tract of land ); THENCE in a northeasterly direction along the southeasterly line of the said Keith J. Smith tract of land (same being the northwesterly line of Shell Dnployees Recreation Assn. 45.97 acre tract to Clear Creek; THENCE up Clear Creek with its meanderings in a general North and northwesterly direction to the Point of BEGINNING. It is further ORDERED that a true copy of this Order, together with the plat attached thereto be recorded in the Deed Records of Galveston County, Texas. T.,GAL' ON 0.,TEXAS ey 3 e u y NVVtM1rtllJiM Nt , G CLAWSON, JENNINGS & CLAWSON Ih, ATTORNEYS AT LAW 458 SAN JACINTO BUILDING rT� PHONE CA 7-6128 HOUSTON 2.TEXAS NOTICE OF ELECTION OF CITY OFFICERS FOR THE CITY OF FRIENDSWOOD, TEXAS TO THE DULY QUALIFIED ELECTORS OF THE CITY OF FRIENDSWOOD, TEXAS: Notice is hereby given that an election will be held at the Tax Office of the Friendswood School District in the Friendswood High School Building in the corporated town of Friendswood, Galveston County, Texas, between the hours of 7 :00 A.M. an d 7 :00 P.M. on the 14th day of January, 1961, for the following purpose and none other: "ELECTION OF A MAYOR AND FIVE ALDERMEN AND A MARSHAL FOR THE SAID CITY OF FRIENDSWOOD, TEXAS", under the authority and all as set forth in the order calling said election, which order is dated the 14th day of November, 1960, and reads as follows : ELECTION ORDER FOR CITY OFFICERS FOR THE TOWN OF FRIENDSWOOD THE STATE OF TEXAS COUNTY OF GALVESTON WHEREAS, pursuant to the election order signed and entered on September 22, 1960 an election was duly and legally held on the 15th day of October, 1960, for the purpose of determining whether the Town of Friendswood should be incorporated for municipal purposes, with the corporate limits described in said election order and in the petition for incorporation; and WHEREAS, in said election 143 votes were cost "for corporation " and 2( votes were cast for "no corporation "; and, WHEREAS, pursuant to the election returns duly and legally made to me as County Judge of Galveston County, Texas, by the proper election officers, I did on the 1st day of November, 1960, which was within twenty days after the receipt of the returns of said election, enter an Order declaring the results of said election and make an entry upon the records of the Commissioners Court of said County that the inhabitants of said Town of Friendswood, Texas are incorporated for municipal purposes within the boundaries thereof, said entry designating said boundaries thereof; and, WHEREAS, a certified copy of said Order and its entry together with a plat of said Town were duly and legally entered of record in the proper Deed Records of said County; and WHEREAS, the corporate limits of said Town of Friendswood situated in Galveston County, Texas are as follows : BEGINNING at the point on the Galveston County side of Clear Creek where the common line between the Jas .F. Perry and Raily F. THEREFORE, be it known that I, Theodore R. Robinson, County Judge of Galveston County, Texas, do hereby order an election to be held on the 14th day of January, 1961 at the Tax Office of the Friendswood High School District in Friendswood High School Building within the Town of Friendswood, Texas, for the following purpose and none other : "ELECTION OF A MAYOR AND FIVE ALDERMEN AND A MARSHALL FOR THE SAID TOWN OF FRIENDSWOOD, TEXAS" . Every person who has attained the age of twenty-one years and who has resided within the corporate limits of said City for the six months next preceding the date of said election and is a qualified voter under the laws of this State shall be entitled to vote at said election. No person shall be eligible to any of said offices unless he possesses the requisites provided for voters at such election; and that the form of ballot and the casting of votes with respect thereto shall be such as to comply with law. Any person or persons eligible to hold any of said offices desiring to have his name or names placed on the official ballot shall file his sworn application with the County Judge of Galveston County at least thirty days prior to the election day. EXCEPT that the names of the candidates for the respec- tive offices who shall file their names as canidates as herein provided shall also be printed on official ballot, the form of the ballot to be used for voting shall contain the following printed words and lines : OFFICIAL BALLOT FOR MAYOR FOR ALDERMEN ^ Vote for Five only FOR MARSHAL No voter shall vote for more than one person for Mayor and for no more than five persons for Aldermen and for no more than one person for Marshal. All absentee votes cast at such election shall be cast by a paper ballot . Paper ballots for the casting of all absentee votes as prescribed and provided by the laws of the State of Texas shall be provided and used for the casting of all absentee votes and such ballots used in such election for the casting of all absentee votes shall conform to all requirements of the State of Texas governing the same . All of said ballots shall contain the words and lines set forth and provided for in the immediately next preceding paragraph of this Order and all absentees shall vote thereon as provided in said next preceding paragraph of this Order and all absentees shall vote thereon as provided in said next preceding paragraph. E.V.Stevenson is hereby appointed presiding Officer of said election and he shall select two Judges and four Clerks to assit him in holding the election . Said election shall be held and governed by the general laws of Texas and due returns thereof made by the said election officers to me as provided by law. The Sheriff of this County shall give notice of said election by posting a notice thereof at three public places in the said incorporated Town of Friendswood, Texas, for twenty days prior to the' date of said election. ROBINSON, COUNTY JUDGE OF GALVESTON COUNTY: The undersigned, all being qualified voters or electors as defined in Article 1137 of the Revised Civil Statutes of the State of Texas, each of us being more than 21 years of age, residing within the limits of the proposed town of Friendswood as is shown by the attached plat thereof for at least six (6 ) months prior to the date of the filing of this Application, being desirous of incorporating said area to be known as FRIENDSWOOD, under the laws of the State of Texas relating to the incorporation of towns and villages as set out in Chapter XI, Title 28, of the Revised Civil Statutes of Texas, 1925, and all Amendments thereto, do hereby petition you to make your Honorable Order for the holding of an election on a day that will be therein stated and at a place that will be therein designated within said town or village for the purpose of submitting the question of incorporation of said area to a vote of the people, and that you appoint an Officer to preside at said election, which said Officer shall select two (2 ) Judges and two (2 ) Clerks to assist in holding said election, all as is provided for in Article 1136 of the Revised Civil Statutes of the State of Texas; and in support of said Petition respectfully represent that said area that it is desired to so incorporate lies wholly within Galveston County, Texas and is out of the Sarah McKissick League and James F. Perry and Deily M. Austin League that it is desired to so incorporate contains more than two hundred (200 ) and less than ten thousand (10, 000) inhabitants and has a superficial area of not more than two (2 ) square miles and the boundaries of same being as shown on said plat attached hereto.
