AN ORDINANCE REQUIRING IDENTIFICATION TAGS FOR AND INOCULATION OF CANINE ANIMALS:
PROHIBITING THE RUNNING AT LARGE OF BITCHES IN HEAT; AUTHORIZING THE IMPOUNDING OF
CANINE ANIMALS THAT ARE UNTAGGED OR WHO RUN AT LARGE; PROVIDING FOR POUND FEES;
AUTHORIZING THE DESTRUCTION OF IMPOUNDED CANINE ANIMALS; PROHIBITING THE INTENTIONAL
RELEASE OR DUMPING OF CANINE ANIMALS; AND PROVIDING A PENALTY FOR THE VIOLATION HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS:
ARTICLE I
Identification Tags
It shall be unlawful for the owner or custodian of any canine animal to main-

ain, keep, harbor or bring any canine animal within the corporate limits of the city
without having first secured an identification tag from the City Clerk or any person

authorized by the City Clerk to issue the same, which tag shall be securely attached
to such animal. That all tags shall expire one year from the date of issuance
provided that the date of issuance of license shall be the same as the date of /
inoculation as herein after provided.
ARTICLE II
Inoculation Against Rabies
The City Clerk or other authorized person shall issue an identification tag
to any person representing himself to be the owner or custodian of a canine animal
which is kept, harbored or maintained within the corporate limits of the City, but
no such tag shall be issued unless and until satisfactory evidence shall have been
presented that such animal has been fully inoculated against rabies by a veterinal-

rian licensed and duly authorized to practice veterinary in the State.
ARTICLE III
Fee
A fee of One and no
A00 ($1.00) Dollar shall be assessed for each identifica-
tion tag issued by the City Clerk under the provisions of this ordinance. The
City Clerk or other authorized person shall issue a receipt for such fee and shall
keep a copy of the same which shall be available for inspection. The receipt shall
state the name of the person receiving an identification tag, his address, a
description of the animal for which a tag is issued and the date of inoculation. II
ARTICLE IV I

Bitches in Heat
It shall be unlawful for any person responsible for the keeping of any
female canine animal to allow such animal to run at large or to be kept in any
manner which shall create or become a nuisance to any person or persons while
such female canine animal is in heat.

ARTICLE V
Impounding of Untagged Canine Animals
It shall be the duty of the Rabies Control Officer or other personnel of
the Health Department of the City charged with the responeibility :of',the_erifgrce-
ment of this Ordinance, or any policeman or peace officer to capture and impound
any bitchcin :heat running at large within the city limits, or any animal found
in the City limits that does not have attached to it the identification tags

required by this Ordinance. The owner of such animal may claim and take possession
thereof within seventy-two (72) hours of the impoundment of such animal by pay-
ing a pound fee of $5.00 and in addition $1.00 per day as board for each day such
animal shall have been impounded. In addition, if said animal has not been
vaccinated for rabies and the owner or custodian thereof does not have a cer-
tificate showing that said animal has been vaccinated within the past twelve
(12) months, then such animal can be redeemed only after it has been vaccinated and
identification tags procured as hereinabove provided. In the event such animal
is not claimed by its owner or custodian within seventy-two hours after impound
ment, it shall be the duty D£ the Health Department or any police officer to
destroy such animal in a humane fashion. In the event such animal shall bear
an identification tag at the time impounded, it shall be the duty of the person
impounding the same to immediately notify the owner thereof. '
ARTICLE VI
Dumping Canine Animals
It shall be unlawful for any person to intentionally release or dump

• a canine animal, and to abandon the same within the corporate limits of the
City of Friendswood, Texas.
ARTICLE VII
Required Observation of Caninine Animals That Have Bitten Persons
If any canine animal shall have bitten any person, then such animal shall
be voluntarily confined by the owner or custodian thereof for a period of ten
(10) days. In the event such animal is not voluntarily confined then the same j
shall be impounded by the Health Department, police or peace officer for ob-
servation for a period not to exceed ten (10) days. A fee of $ l d 0 per day

shall be charged the owner or custodian of said animal for each and every day the
same is held for confinement and observation if impounded. If such fee is not so
paid, then the animal shall be destroyed in a humane fashion.
ARTICLE VIII
Exceptions
The licensing provisions of this ordinance shall not apply to the following:
(a) Canine animals under the age of six (6) months if kept within an
enclosure.

(b) Canine animals brought to the City exclusively for the purpose of
entering same in any dog show or exhibition, and which are actually
entered in and kept at said show for exhibition.
(c) Canine animals kept exclusively for breeding, or in kennels when
kept in cages or pens in both instances. However such animals shall
be required to be inoculated against rabies at least once yearly as
hereinabove provided for animals required to be licensed hereunder.
ARTICLE IX
Penalty
Any person who shall violate the provisions of this ordinance shall upon
conviction be fined in an amount not less than $5.00 not more than '$
ARTICLE X
Savings_ Clause
Should any section, provision or part of this ordinance be declared to
be unconstitutional and void by any court of competent jurisdiction, such
decision shall in no way effect the validity of any of the remaining parts o£,this
ordinance, unless the part held unconstitional or void is inseparable from and
indispensable to the operation of the remaining parts. The City Council hereby
declared that it would have passed those parts of this ordinance which are valid
and omitted any parts which may be unconstitutional if it had known that such
parts were unconstitutional at the time of the passage of this ordinance.
ARTICLE XI
