AN ORDINANCE AMENDING THE FRIENDSWOOD CITY CODE BY
STRIKING THEREFROM ALL OF SECTIONS 4- 1 AND 4-3 OF ARTICLE
I OF CHAPTER 4 , SECTION 4-48 OF ARTICLE IV OF CHAPTER 4,
ARTICLES V AND VI OF CHAPTER 4 , AND SECTION 7-7 OF
ARTICLE, I OF CHAPTER 7 , AND SUBSTITUTING THEREFOR NEW
SECTIONS 4-1 AND 4-3 OF ARTICLE I OF CHAPTER 4, SECTION
4-48 OF ARTICLE IV OF CHAPTER 4, ARTICLES V AND VI OF
CHAPTER 4, AND SECTION 7-7 OF ARTICLE I OF CHAPTER 7, AND
BY ADDING TO CHAPTER 4 A NEW ARTICLE VIII; PROVIDING FOR
THE ADOPTION OF THE 1991 EDITIONS OF THE STANDARD
BUILDING, MECHANICAL, PLUMBING, GAS, UNSAFE BUILDINGS,
AND FIRE PREVENTION CODES; PROVIDING FOR CERTAIN
AMENDMENTS TO SAID CODES; PROVIDING THAT WOOD SHINGLES OR
SHAKES SHALL BE PROHIBITED FOR ALL CONSTRUCTION EXCEPT
SINGLE FAMILY RESIDENTIAL, AND THEN ONLY IF TREATED WITH
FIRE RETARDANT MATERIALS; PROHIBITI14G THE USE OF STAPLES
FOR AFFIXING COMPOSITION SHINGLES; PROVIDING FOR THE
APPROVAL OF FOUNDATIONS BY REGISTERED PROFESSIONAL
ENGINEERS; PROVIDING STANDARDS FOR INSTALLATION OF
SUBFLOORING OVER JOISTS; PROVIDING PAVING CONCRETE •
STANDARDS; ADOPTING A SCHEDULE OF FEES; ADOPTING NATIONAL
FIRE PROTECTION STANDARDS RELATING TO OPERATION OF
AIRCRAFT FACILITIES; PROVIDING OTHER MATTERS RELATING TO
THE SUBJECT; PROVIDING A PENALTY OF $1,000 FOR EACH DAY
OF VIOLATION HEREOF; PROVIDING FOR SEVERABILITY; AND
PROVIDING THAT SAID ORDINANCE SHALL BECOME EFFECTIVE AS
OF THE 31ST DAY FOLLOWING ITS ADOPTION .
BE IT ORDAINED BY THE CITY COUNCIL OF' THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The Friendsw ood City Code is hereby amended by
striking therefrom Section 4-1 of Article I of Chapter 4 , which
provides as follows:
[Sec. 4-1. Building code - Adopted.
The 1985 Edition of the Standard Building Code,
including all appendices, as published by the Southern
Building code Congress International, Inc. , a copy of
which is attached hereto and made a part hereof for all
purposes, an authentic copy of which has been filed with
the city secretary, is hereby adopted and made a part of •
this chapter. ]
and substituting therefor a new Section 4-1 to provide as follows:

"Sec. 4-1. Building code - Adopted.
The 1991 Edition of the Standard Building Code,
including all appendices as published by the Southern
auildinq Code Congress International, Inc. , a copy of
which is attached hereto and made a part hereof for all
purposes, an authentic copy of which has been filed with
the city secretary, is hereby adopted and made a part of
this Chapter, except as amended pursuant to Section 4-3
below. "
Section 2 . Said Friendswood City Code is hereby further
amended by striking therefrom Section 4-3 of Article I of Chapter
4 , which provides as follows:
[Sec. 4-3 . Same - Amendments.
Section 706. 8 . The following Section 706. 8 is
hereby adopted and incorporated into and made a part of
Chapter 7 of the Standard Building Code:
• 706 .8 . Wood Shingles or Shakes - Multifamily Dwellings.
(a) Notwithstanding any other provision of this
code, no wood shingles or shakes shall be used in the
construction of any multifamily dwelling unless such wood
shingles or shakes have been fire-retardant treated as
provided by Uniform Building Code Standard No. 32-7, 1976
Edition.
(b) Existing multifamily structures which have wood
shingles or shakes which are not fire-retardant treated
may be repaired with wood shingles or shakes of a
comparable grade if such repairs are not substantial.
However, in no event shall repair of twenty-five (25) per
cent or more of the surface area of the nonfire-retardant
treated wood shingles or shakes be considered
unsubstantial. If, in the opinion of the building
official, the proposed or needed repairs constitute a
substantial replacement of existing nonfire-retardant
treated wood shingles or shakes, the following shall
apply:
(1) The replaced wood shingles or shakes shall be
fire-retardant treated; or
(2) The owners shall have the option of installing
Class "A, " Class "B, " or Class "C" roofing material
• over the existing nonfire-retardant treated wood
shingles or shakes, providing the existing roof and
structural system is adequate for modification.

Chapter 23 . Chapter 23 is hereby deleted. ]
and substituting therefor a new Section 4-3 to provide as follows :
Sec. 4-3 . Same - Amendments.
The 1991 Edition of the Standard Building Code as
adopted in Section 4-1 above is hereby amended as
follows:
1 Section 706. 9. The following Section 706.9 is
hereby adopted and incorporated into and made a part of
Chapter 7 of the Standard Building Code-
706.9. Notwithstanding any other provision of
this code to the contrary no wood shingles or shakes
phall be used in the construction of anv structure except
single family residential structures and then only when
treated by an approved fire retardant All plans shall
indicate the roofing materials to be used
() Section 706. 10. The following Section
706.10 is hereby adopted and incorporated into and made
a_part of Chapter 7 of the Standard Building Code:
706. 10. Composition shingles may not be secured
with staples.
1 Section 1313. The following Section 1313 is
hereby adonted and incorporated into and made a part of
Chapter la. of the Standard Building code:
1313 . Approval By Registered Professional
Engineer.
1313 .01. All foundations are to be approved by a
Registered Professional Engineer. All plans must be
submitted with original wet seals applied
(d) Section 1705. 2, The following is hereby
adopted and incorporated into and made a part of Chapter
17 of the Standard Building Code as added to Section
1705. 2 •
1705. 2. . . . In addition to the requirements of this
code subflooring over Joists must be applied with
continuous beads of glue and be screwshank nailed. "
(e)_ Section 1.602 . 9 . The following Section
1602. 9 is hereby adopted and incorporated into and made
a part of Chapter 16 of the Standard Building Code •

1602 . 9 . Paving concrete shall consist of 3 ,000
p.s. i. rating (5 sack or design mix) reinforced with 6"
x 6" #6 wire mesh as a minimum.
Section 3 . Said Friendswood City Code is hereby further
amended by striking therefrom Section 4-48 of Article IV of Chapter
4 , which provides as follows:
[Sec. 4-48. Standard Plumbing Code - Adopted.
The "Standard Plumbing Code, " 1985 Edition,
including appendices, as published by the Southern
Building Code Congress International, Inc. , a true and
correct copy of which is attached hereto as Exhibit "B"
and made a part hereof for all purposes, and a true and
correct copy of which is on file with the city secretary,
is hereby adopted save and except any provision thereof
in conflict between the "Examination Plumbing Code and
Study Guide: and the "Standard Plumbing Code, " the
"Examination Plumbing Code and Study Guide" shall
prevail. ]
and substituting therefor a new Section 4-48 to provide as follows:
Sec. 4-48 . Standard Plumbing Code - Adopted.
The 1991 Edition of the Standard Plumbing Code,
including all appendices , as published by the Southern
Building Code Conaress International. Inc. , a copvi of
which is attached hereto and made a part hereof for all
Purposes, an authentic copy of which has been filed with
the city secretary, is hereby adopted and made a part of
this chapter, except to the extent any such provision
thereof conflicts with the "Examination Plumbing Code and
Study Guide," in which case the provisions of said
"Examination Plumbing Code and Study Guide" shall
prevail .
Section 4 . Said Friendswood City Code is hereby further
amended by striking therefrom Article V of Chapter 4, which
provides as follows:
[ARTICLE V. MECHANICAL CODE
Sec. 4-56 . Mechanical code.
• (a) Adopted; amendments. The 1985 edition of: the
Standard Mechanical Code as published by the Southern
Building code Congress, a copy of which is attached

hereto and made a part hereof for all purposes, and
authentic copies of which have been filed with the city
secretary, is hereby adopted and made a part of this
section and shall govern and be observed and followed in
the installation, alteration, repair, replacement,
maintenance, equipment, appliances, fixtures, Fittings
and/or 4ppurteriance to all mechanical systems including
ventilating, heating, cooling, air conditioning and
refrigeration systems, incinerators and other energy
related systems in the City of Friendswood, with the
following exception:
(1) Section 106. 3 of the 1976 edition of the
Standard Mechanical Code relating to fees
shall rot apply with the corporate limits of
the City of Friendswood, Texas.
(b) Permit fees. The following schedule of permit
fees is hereby adopted and made a part of this section
and shall govern and be observed and followed in the
collection of fees for permits issued pursuant to this
section:

(c) Mechanical officer. The city building
inspection or the City of Friendswood, Texas, is hereby
designated and appointed mechanical officer of the City
of Friendswood, Texas.
(d) Penalty. Any person violating any provision of
this section shall, upon conviction, be fined not less
than five dollars ($5. 00) nor more than two hundred
dollars ($200. 00) , and each day of violation shall
constitute a separate offense. ]
and substituting therefor a new Article V to provide as follows:
ARTICLE V. MECHANICAL CODE
Sec. 4-56 . Mechanical Code.
The 1991 Edition of the Standard Mechanical Code,
including all appendices , as published bV the Southern
Building Code Congress International, Inc. , a copy of
which is attached hereto and made a part hereof for all
purposes an authentic copy of which has been filed with
the city secretary, is hereby adopted and made a part of
this chapter.
Sec. 4-57 , Penalty for violation. •
Any person who shall violate any provision of this
article shall be deemed guilty of a misdemeanor and, upon
conviction, shall be filed in an amount not to exceed one
thousand dollars (S1 000 001 Each day of violation
shall constitute a separate offense.
Section 5. Said Friendswood City Code is hereby further
amended by striking therefrom Article VI of Chapter 4 , which
provides as follows:
[ARTICLE VI . GAS
Sec 4-67. Gas code.
The 1985 Edition of the Standard Gas Code, including
appendices, as published by the Southern Building Code
Congress International, Inc. , a copy of which is attached
hereto and made a part hereof for all purposes, an
authentic copy of which has been filed with the city
secretary is hereby adopted and made a part of this
Code. ]
and substituting therefor a new Article VI to provide as follows: •

ARTICLE VI. GAS CODE
Sec. 4-67 . Standard Gas Code.
The 1991 Edition of the Standard Gas Code, including
all appendices,_as published by the Southern Building
Code Congress International , Inc. , a copy of which is
attached hereto and made a part hereof for all purposes
an authentic copy of which has been filed with the city
secretary, is hereby adopted and made a part of this
chapter.
Sec. 4-68. Penalty for violation.
Any person who shall violate any provision of this
article shall be deemed guilty of a misdemeanor and upon
conviction, shall be filed in an amount not to exceed one
thousand dollars ($1 000 001 Each day of violation
shall constitute a separate offense.
Section 6. Said Friendswood City code is hereby further
amended by adding to chapter 4 a new Article VIII to provide as
• follows:
ARTICLE VIII. Standard Unsafe Building Code
Sec. 4-90. Standard Unsafe Building Code.
The 1991 Edition of the Standard Unsafe Building
Code including all appendices as published by the
Southern Building Code Congress International. Inc. . a
copy of which is attached hereto and made a part hereof
for all purposes, an authentic copy of which has been
filed with the city secretary, is hereby adopted and made
a part of this code.
Section 4 . 91. Penalty for violation.
Any person who shall violate any provision of this
article shall be deemed guilty of a misdemeanor and upon
conviction, shall be filed in an amount not to exceed one
thousand dollars (S1, o0o.00) Each day of violation
shall constitute a separate offense
Section 7 . Said Friendswood City Code is hereby further
amended by striking Section 7-7 of Article I of Chapter 7 , which
• provides as follows:

other standards relating to fire
prevention.
The following codes and standards relating to fire
prevention, copies of which are attached hereto and made
a part hereof for all purposes, and authentic copies of
which have been filed with the city secretary, are hereby
adopted and incorporated herein as if set forth verbatim:
(a) 1985 Edition of the Standard Fire Prevention
Code, including appendices, as published by
the Southern Building Code Congress
International , Inc. save and except Sections
1 . 05 and 402 . 1, and Chapter 30 thereof;
(b) 1985 Edition of the "NFPA 407 Standard for
Aircraft Fuel Servicing, " as published by the
National Fire Protection Association;
(c) 1984 Edition of the "NFPA 40a Standard for

Section 8 . Any person who shall violate any provision of this
Ordinance shall be deemed guilty of a misdemeanor and, upon
conviction, shall be fined in an amount not to exceed $1 , 000. Each
day of violation shall constitute a separate offense.
Section 9. In the event any clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same
to any person or circumstance shall for any reason be adjudged
invalid or held unconstitutional by a court of 'competent •
jurisdiction, it shall not affect, impair, or invalidate this
Ordinance as a whole or any part or provision hereof other than the
part declared to be invalid or unconstitutional; and the City
Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the
omission of any such part thus declared to be invalid or
unconstitutional , whether there be one or more parts.
Section 10. Effective date. This Ordinance shall become
effective on the 31st day following the date of its adoption.
