ORDINANCE NO 2021-17 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO 2020-35, PASSED AND APPROVED SEPTEMBER 14, 2020, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2020-2021 BY APPROVING "BUDGET AMENDMENT VIII" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2020-2021", PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS, PROVIDING FOR SEVERABILITY, AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT WHEREAS, by Ordinance No 2020-35, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2020-2021 ", and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes, and WHEREAS, Section 8 04 of The City Charter provides for amendments after adoption of the budget, and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2020-2021, NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS Section 1 The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2 The `Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2020-2021," is hereby amended for municipal purposes as shown on "Budget Amendment VIII" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2020-2021" attached hereto Said Budget Amendment VIII shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and "B" and made a part hereof for all purposes. Section 3 In the event any clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional, and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts. No 2021-17 2 EXHIBIT "A" City of Friendswood Budget Amendment Summary Fiscal Year 2020 — 2021 Budget Amendment VIII June 7, 2021 1 Parks & Recreation TML-IRP Vehicle Insurance Reimbursement, $16,650. Appropriate insurance reimbursements received from TML-IRP to replace Parks & Recreation unit CS09 Funding will be appropriated to the Vehicle Replacement Fund for the purchase of a new, replacement vehicle 2. Vehicle Replacement Fund, $23,415. Appropriate funding to replace Parks & Recreation unit CS07 Recently the vehicle was involved in an accident and was totaled by TML-IRP Available funding in the VRP will be used in conjunction with insurance proceeds to purchase the new, replacement vehicle 3. Park Land Dedication Fund — Dumpster Enclosure, $11,764. Appropriate funds to purchase a dumpster enclosure The new enclosure will secure dumpsters located at the Sportspark. The funding source will be from the Park Land Dedication Fund 4 Information Technology — Uninterruptible Power Supply for City Hall, $19,289. Appropriate funds to purchase an Uninterruptible Power Supply (UPS) for City Hall Also known as a Battery Backup System, this is a critical piece of technology infrastructure that provides battery power between the system going from shore power to generator The funding source will be unassigned general fund balance 5. Vehicle Replacement Fund, $6,999. Appropriate additional funding needed for replacement of a Parks & Recreation vehicle The total amount over budget is $5,999 However, auction proceeds from the sale of the old vehicle will be used to supplement the cost of the new vehicle Remaining funds will come from the Vehicle Replacement Plan unassigned fund balance 6. 2017 CDBG-DR (Harris County) Grant Reimbursement, $31,745, Appropriate grant funds received from the 2017 CDBG-DR Harris County grant program for Forest Bend Detention Pond The City received $37,745 for engineering expenditures Advance funding for engineering services was originally approved at the September 14, 2020 City Council meeting Therefore, the funds will be appropriated back to unassigned general fund balance 7 Texas Water Development Board Flood Mitigation Grant Reimbursement, $1,698,513.
