A "local government officer" is defined as a member of the governing body of a local governmental entity ; a director, superintendent , administrator, president , or other person designated as the executive officer of a local governmental entity ; or an agent of a local governmental entity who exercises discretion in the planning , recommending , selecting , or contracting of a vendor. This form is required to be filed with the records administrator of the local governmental entity not later than 5 p.m . on the seventh business day after the date on which the officer becomes aware of the facts that require the filing of this statement. A local government office r commits an offense if the officer knowingly violates Section 176.003 , Local Government Code . An offense under this section is a misdemeanor. Date requested for City Council consideration: June 7 , 2021 Date submitted: 04/22/2021 Prepared by: Glenda Faulkner, Executive -Secretary Subject: Discuss and take possible action on RFP 2021-03 for the concrete wall project between Centennial Park and Lakes of Falcon Ridge, Originating Department: Parks and Recreation Degree of importance: Choose an Option SUMMARY/ ORIGINATING CAUSE In June of 2020 representatives from the Lakes of Falcon Ridge Subdivision made contact with the City inquiring about the condition and safety of the existing 2729 linear feet of concrete block wall that separates the subdivision from Centennial Park and Friendswood Junior High. The City authorized Moghaddam Engineering, LLC to perform an engineering study to investigate the condition of the wall and provide recommendations to correct deficiencies, The Engineer's recommended option is to remove the entire wall, columns and concrete base and construct a new fence. In March of 2021 the City advertised a request for proposal to remove the existing 6' block wall and construct a new wall. The lone bid was submitted by Republic Wall and Fencing for the amount of $416,188.55 to remove and dispose of the existing concrete block wall and construct a new 6' "Verticrete" wall. Following the terms of the existing Partnership Agreement between the Lakes of Falcon Ridge Subdivision and the City of Friendswood, each entity agrees to equally share in the cost for replacement. The Lakes of Falcon Ridge HOA has agreed to move forward and will be invoiced $208,094 .27 should the item be approved by City Council. *The funding source for the City's portion of the expense will be unassigned General Fund balance. IMMINENT CONSEQUENCES / BENEFIT TO COMMUNITY The existing concrete wall is failing and is a potential safety hazard due to the lack of proper reinforcement. The wall exhibits tilting changes from 1 to 7 inches and cracking throughout that range . from 1 to 10 inches. RECOMMENDATIONS Approve the sole RFP from Republic Wall and Fencing and remove and replace the concrete block wall.
