ORDINANCE NO.2010-17
AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS,
ORDINANCE NO.2004-20, PASSED AND APPROVED THE 7TH DAY OF
FEBRUARY, 2005, SAME BEING AN ORDINANCE AMENDING
APPENDIX C OF THE FRIENDSWOOD CITY CODE, (APPENDIX C
BEING THE ZONING ORDINANCE OF THE CITY) WHICH
APPROVED A PLANNED UNIT DEVELOPMENT (PUD) DISTRICT ON
THE PROPERTY BEING DEVELOPED AS THE MASTER -PLANNED
COMMUNITY OF WEST RANCH, BY ADDING 20.445 ACRES TO THE
PLANNED UNIT DEVELOPMENT DISTRICT, BY AMENDING
SECTION 9 OF SAID ORDINANCE TO INCREASE THE ALLOWABLE
HOME SITES FROM 1,500 TO 1,540; AND BY ADDING A NEW
SECTION GOVERNING SIGNAGE GUIDELINES FOR ALL SIGNAGE
TO BE IMPLEMENTED INTO WEST RANCH; REZONING THE
ADDITIONAL 20.445 ACRES OF LAND FROM SFR TO PUD-CLUSTER
HOMES; PROVIDING OTHER MATTERS RELATING TO THE
SUBJECT; PROVIDING A PENALTY OF AN AMOUNT NOT TO
EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION
HEREOF; AND PROVIDING FOR SEVERABILITY.
WHEREAS, pursuant to City of Friendswood, Texas, Ordinance No. 2004-20, the City
Council authorized the rezoning of a certain land encompassing the master -planned community
of West Ranch to Planned Unit Development (PUD); and
WHEREAS, Autumn Creek Development, Ltd., the owner of such development, has
requested an amendment to such PUD, to add an additional 20.445 acres of land, to increase the
allowable home sites to 1,540 and to add signage guidelines for the PUD; and
WHEREAS, the change in boundaries requires a change in zoning of three separate
tracts (Tract 9, Tract 10, and Tract 11) totaling 20.445 acres from Single Family Residential
District (SFR) to Planned Unit Development —Cluster Homes (PUD —Cluster Homes) District;
and
WHEREAS, the Planning and Zoning Commission and the City Council have
conducted, in the time and manner required by law and the Zoning Ordinance of the City, a
public hearing on such request; and
WHEREAS, the Planning and Zoning Commission has recommended approval of the
proposed amendments and the City Council deems it appropriate to grant such request, subject to
certain regulations, restrictions, and conditions; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. City of Friendswood, Texas, Ordinance No. 2004-20, passed and approved
the 7th day of February, 2005, and being AN ORDINANCE AMENDING APPENDIX C OF
THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF
FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY
ADOPTED THE 19TH DAY OF NOVEMBER 1984, AND BEING THE ZONING
ORDINANCE OF THE CITY, BY CHANGING THE ZONING CLASSIFICATION OF A
CERTAIN 404.5 ACRE TRACT OF LAND FROM SINGLE-FAMILY RESIDENTIAL (SFR)
TO PLANNED UNIT DEVELOPMENT (PUD) — CLUSTER HOMES, SUCH TRACT BEING
KNOWN AS TRACTS 1 AND 5 OUT OF THE JOHN DICKINSON LEAGUE ABSTRACT 9,
IN THE CITY OF FRIENDSWOOD, GALVESTON COUNTY, TEXAS, BY CHANGING

WHICH ARE WITHIN THE CITY LIMITS OF THE CITY; PROVIDING FOR THE

AMENDMENT OF THE CITY'S OFFICIAL ZONING MAP; PROVIDING FOR
SEVERABILITY; AND PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED
$2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF, is hereby
amended as set forth below. Words being deleted are indicated by brackets, as follows. -
"[deleted]." Words being added are indicated by underline, as follows: ",underline."
The 20.445 acres described in sections 4, 5 and 6 of this ordinance shall be added to the area
constituting the Planned Unit Development (PUD) on the property being developed as the
master -planned community known as West Ranch, approved by Ordinance No. 2004-20, said
ordinance and all related maps, boundary descriptions, and land plans shall be updated to show
this added acreage. Section 8 is hereby amended as follows:
"Section 8. This Ordinance shall in no manner amend, change,
supplement, or revise any provision of any ordinance of the City of
Friendswood, save and except the change in zoning classification of said
404.5, 240.195 47.35, and 20.445 acres to Planned Unit Development
(PUD) — Cluster Homes, as described above."
Section 3. Section 9 providing for allowable home sites is hereby amended as
follows:
"Section 9. The Council further finds it appropriate to impose certain
conditions on this change in zoning, and that the following conditions
shall be imposed on the land uses within the PUD: No more than 1,540
total home sites will be permitted on the tracts rezoned herein, more
particularly described in Exhibits "A," ccB," 44C , " and "D" attached
hereto. For purposes of the limitation contained in this Section, the three
tracts rezoned herein and described in Exhibits "A." 4413," "C and
"D" will be considered as one tract; that is, no more than total
home sites will be permitted on the three tracts as a whole."
Section 4. That the City of Friendswood, Texas, Ordinance No. 84-15, as amended,
originally adopted the I 9th day of November, 1984, same being Appendix C of the Friendswood
City Code, and also being the zoning ordinance of the City, is hereby amended by changing the
zoning classification of that certain 9.525 acre tract consisting of all of Lots 117 & 118 of the
Partial Replat of Slone Subdivision Galveston County, Friendswood, Texas, and the adjacent
public right-of-way dedicated by said plat, a metes and bounds description of which is attached

hereto and made a part hereof as Exhibit "D" ("TRACT 9"), from Single Family Residential
(SFR) to Planned Unit Development District — Cluster Homes (PUD — Cluster Homes). The
Zoning District Map of the City of Friendswood shall be revised and amended to show the
designation of said 9.525 acres, as described and as provided above, with the appropriate
reference thereon to the number and effective date of this Ordinance and a brief description of
the nature of the change.
Section 5. That the City of Friendswood, Texas, Ordinance No. 84-15, as amended,
originally adopted the I 9th day of November, 1984, same being Appendix C of the Friendswood
City Code, and also being the zoning ordinance of the City, is hereby amended by changing the
zoning classification of that certain 4.920 acre tract consisting of all of Lot 103 of Slone
Subdivision, Galveston County, Friendswood, Texas, a metes and bounds description of which is
attached hereto and made a part hereof as Exhibit "D" ("TRACT 10"), from Single Family
Residential (SFR) to Planned Unit Development District — Cluster Homes (PUD — Cluster
Homes). The Zoning District Map of the City of Friendswood shall be revised and amended to
show the designation of said 4.920 acres, as described and as provided above, with the
appropriate reference thereon to the number and effective date of this Ordinance and a brief
description of the nature of the change.
Section 6. That the City of Friendswood, Texas, Ordinance No. 84-15, as amended,
originally adopted the I 9th day of November, 1984, same being Appendix C of the Friendswood
City Code, and also being the zoning ordinance of the City, is hereby amended by changing the
zoning classification of that certain 6.000 acre tract consisting of all of Lot 51 and a portion of
Lot 52 of the Slone Subdivision, Galveston County, Friendswood, Texas, a metes and bounds
description of which is attached hereto and made a part hereof as Exhibit "D" ("TRACT I V),
from Single Family Residential (SFR) to Planned Unit Development District — Cluster Homes
(PUD — Cluster Homes). The Zoning District Map of the City of Friendswood shall be revised
and amended to show the designation of said 6.000 acres, as described and as provided above,
with the appropriate reference thereon to the number and effective date of this Ordinance and a
brief description of the nature of the change.
Section 7. A new section 14 shall be added to read and provide as follows:

"Section 14. The "West Ranch Planned Unit Development Signage Guidelines
2010" attached as Exhibit E shall govern the materials, form and font and location
of all signage to be implemented into West Ranch,"
Section 8. Any person who shall violate any provision of this Ordinance shall be
deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed
$2,000.00. Each day of violation shall constitute a separate offense.
Section 9. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or
provision hereof other any part or provision hereof other than the part declared to be invalid or
unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the omission of any and every part
of the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, or whether there be one or more parts.

INTRODUCTION
The control of signs is particularly important to the visual harmony of west Ranch. In general,
signage is prohibited which (by its location, size, shape, color, lighting, subject or sound) may be
harmful to the appearance of the locality, public street, site or view, or constitute a threat to road
traffic.
Signs definitions are as follows:

1. PRIMARY ENTRY MONUMENT
a. Form
Primary Entry Monument typically consists of three parts'. tower, terrace walls and/or
entry sign wall.
b. Quantity
Not to exceed three (3) Primary Entry Monuments, See Appendix A for approximate
locations. Note that sign locations are only diagrammatic and may need to be adjusted
and moved as the developer sees fit for future land development.
c. Dimensions
Tower
The maximum height of the tower including the roof and base is not to exceed thirty feet
(30'- 0') and the overall width of the tower is not to exceed sixteen feet (16' — 0".). The
logo should not exceed thirty (30) square feet. Each face of the monument must be
identical with the exception of any logos. Logos may only be on two (2) sides of the
structure and must be identical.

The entry sign wall shall consist of a stone wall and sign panel. The wall shall be stone
veneered base with a stone cap. The sign wall shall be a steel panel with cut logo. Font
to be "Copperplate."

Column & Logo
The columns shall be stone veneered base with a stone cap not to exceed six inches (6").
Each face of a Neighborhood Column must be identical with the exception of any logos
and elements to incorporate water. Logo must be proportional to entire column and
aluminum or steel. Logos and/or water feature elements may only be located on two (2)
sides of the structure and must be identical. All foundations and footings of the base shall
be designed, signed and sealed by a licensed structural engineer.

b. Quantity
Each major neighborhood and recreational center will be allowed one (1) Neighborhood
Marquee. See Appendix A for approximate locations* note that sign locations are only
diagrammatic and may need to be adjusted and moved as the developer sees fit for future

The maximum height of the Marquee sign is eight feet (8' — 0) and the maximum width
of a ground -mounted sign is eight feet (8' - 0"). The reader board height is to be five feet
(S'- 0'?) and a width of seven feet (T — 0"). The sign panel and logo shall not exceed

d. Materials
Base
The base shall consist of a foundation, stone veneer., cast stone cap and cast stone panel
with street address. All foundations and footings of the base shall be designed, signed
and seated by a licensed structural engineer.
Reader Board and Frame
The reader board shall be double sided, illuminated, with a header. The reader board
shall have a Lexan door• for the changeable copy. The reader board is to be framed by an
aluminum bar and be polyurethane painted finish. There should be no visible fasteners;
seams should be kept to a minimum. All means of attachments are to remain concealed.
Each face of a sign must be identical. The letters, logo or message area may not cover
more than 70% of the length or height of the sign face.
Frame &Logo
Frame & logo for marquee sign is to be aluminum or steel. All exposed surfaces and
edges must be primed and painted. All fasteners are to be non -corrosive nails or screws.
All posts should be sufficient strength and durability to withstand local wind loads and
remain stable throughout the duration of the construction period. All footings should
extend four feet (4') below grade in sharp sand or compacted earth.

The maximum overall height for construction signs is limited to nine feet (9'- 0"). The
sign panel and logo shall not exceed thirty two (32) square feet on each side.

fiberglass, or aluminum. All temporary site information signs will be designed to last the
length of their intended use without significant fading, peeling, blistering, warping,

strength and durability to withstand local wind loads and remain stable throughout the
