I '� t �� I I t�� I I 1 I I '� I!� I �� � > I 1 I I ��) '� I t�) I I III (��► ill" •1 � i �� � ll) K v Y wIt1IIEII�IEA�, the City of Friendswood, Texas ("City") is an electric utility customer of Texas -New Mexico Power Company ("TNIVIP" or "Company") with an interest in the rates and charges of TNIi�IP; a.nd Cities") is a coalition of similarly situated cities served by TNTVIP that have joined together to efficiently and cost effectively review and respond to electric issues affecting rates charged in TNIVIP's service area in matters before the Public Utility Commission ("Commission") and the courts; and wIHIIEI�IE.A�9 on or about April 5, 2021, TNIVIP filed with the Commission an Application for Approval to Amend its Dlstrlbutloll Cost recovery Factor ("DCRF"), 111 Commission Docket No. 51959, seeking to increase distribution rates by $13,959,505 million annually; and wk�IIEII�.�EA�, the City of Friendswood will cooperate with TNMP Cities in coordinating their review of TNIVIP's DCrF filing with designated attorneys and collsultA.11ts, prepare a VommVll response, negvi,late �r�dit�i ti'ie Cv nipaiiy necessary litigation, to resolve issues in the Company's filing; and and direct any w�1ER��.S, a1I electric utility customers residing in the City will be impacted by this ratemaking proceeding if TNIVIP's Application is granted; and w��EREAS, working with the TNMP Cities to review the rates charged by TNMP allows members to accomplish more collectively than each city could do acting alone; and retained original jurisdiction over electric utility rates deny TNMP's DCRF. Secti®n 1. That the City is authorized to participate with TIVl�iIP Cities in Commission Docket No. 51959. Secti®n 2. That, subject to the right to terminate employment at any time, the City of Friendswood hereby authorizes the hiring of the law firm of Lloyd Gosselink Rochelle &Townsend, P.C. and consultants to negotiate with the Company, make recommendations to the City regarding reasonable rates, and to direct any necessary administrative proceedings or court litigation associated with an appeal TNIVIP's DCRF application. Section 3. That the rates proposed by TNVP to be recovered through its DCRF charged to customers located within the City limits should be denied. within the City. `t' , i i �.
