HomeMy WebLinkAboutOrdinance No. 2020-37ORDINANCE NO.2020-37 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2019-38, PASSED AND APPROVED OCTOBER 7, 2019, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2019-2020 BY APPROVING "BUDGET AMENDMENT X" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2019- 20209,; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2019-38, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2019-2020"; and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; I WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2019-2020; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2019-2020," is hereby amended for municipal purposes as shown on "Budget Amendment X" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2019-2020" attached hereto. Said Budget Amendment X shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and `B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts. ATTEST: ' FRIE/y '• Melinda Welsh, TRMC • U :v• City Secretary : Ord No. 2020-37 2 City of Friendswood Budget Amendment Summary `Fiscal Year 2019 — 2020 Budget Amendment X September 14, 2020 PEG Channel Equipment Maintenance, $8,890. Appropriate PEG Channel funds for equipment to be used for city wide media productions and for recording equipment to be serviced. The funding source will be restricted general fund balance reserves from PEG Channel revenue. 2. Parks & Recreation Donation $1,000. Appropriate a donation received from Mary Ann Taft on July 27, 2020. The donation will go towards the purchase of a metal park bench in memory of Gwen Taylor that will be placed in Stevenson Park around the tennis courts. Funds will be appropriated to the Parks and Recreation Department's Parks division operating equipment budget. 3. Parks & Recreation Dog Park Donation $500. Appropriate a donation received from ExxonMobil Foundation. The donation will go towards the Dog Park and will be used in fiscal year 2020. Funds will be appropriated to the Parks and Recreation Department's Parks division operating equipment budget. 4. Parks & Recreation Centennial Park, $28,000. Appropriate funds to have an inspection and survey performed on the concrete block wall that separates Centennial Park and Lakes of Falcon Ridge subdivision. The services will be performed by Moghaddam Engineering, Inc and shall not exceed $28,000. The funding source for this service will be unassigned general fund balance. 5. Park Land Dedication Fund, $6,000. Appropriate funds to clear the underbrush on the property 220 Shadwell. Land will be prepped to relocate the disc golf course from 1776 Memorial Park. The funding source will be from the Park Land Dedication Fund. 6. Library Book Sales, $413. Appropriate Library book sale revenue to the Library department. The funds will be appropriated to the Library's operating equipment budget to be used in fiscal year 2020. 7. Police Department Replacement Vehicle, $58,179. Appropriate funding to replace Police unit P298. The vehicle was scheduled to be replaced in 2020 but was deferred. Recently the vehicle has had mechanical issues in which the repair costs are substantial. Also, the miles on the vehicle are over 100,000. The funding source will be from the Vehicle Replacement Fund. 1 of 3 8. Police Department Replacement Vehicle, $47,188. Appropriate funding to replace Police unit P412. The vehicle was in a single vehicle accident on August 23, 2020. The insurance company TML-IRP, has deemed the vehicle a complete loss. The funding source will be from the Vehicle Replacement Fund. When the insurance proceeds are received, the funds will be appropriated back to the Vehicle Replacement Fund. 9. Police Department Vehicle Insurance Reimbursement, $644. Appropriate insurance reimbursements received from TML-IRP. Funding will be appropriated to the Police Department Patrol division vehicle maintenance account for repairs made to unit P402. 10. Public Works Lift Stations, $264,080. Appropriate water & sewer working capital for lift station repairs. The city received funds from TML-IRP to make repairs to lift stations 1,2,4,5,13,17,18,19,22,24,25,27,28, and 31 due to damages caused by Hurricane Harvey. The funding source will be funds received in 2018 and 2019 from TML-IRP. 11. Texas Water Development Board Buy-out Program Grant, $578,359. Appropriate advance funding for the appraisal and purchase of 1 Whittier Drive through the Texas Water Development Board Buy-out Program grant. The City was awarded a grant through FEMA and Texas Water Development Board in January 2020. The funding source will be unassigned general fund balance and will be reimbursed once grant funding has been received from the State agency. 12. Forest Bend Detention Pond, $208,716. Appropriate advance funding for services related to Forest Bend Detention Pond. The City applied for and was awarded a grant through the 2017 Community Development Block Grant — Disaster Recovery with Harris County. At the August 3, 2020 council meeting, Council approved a contract with RPS Engineering Incorporated. Funds will be appropriated in the amount of $3,594 for advertising the RFQ and $205,122 for the contract with RPS. The funding source will be unassigned general fund balance and will be reimbursed once the grant funding has been received from the State agency. 13. HMGP Buyout Grant $3,548. Appropriate grant funds received from the Hazard Mitigation Grant Program for Hurricane Harvey buyout properties. The City received $3,548.25 for 75% of the title policies for the following properties: 16614 Oxnard ($733), 5303 Shady Oaks Lane ($734) and 13 Haverford ($2,081). Advance funding to purchase these properties was originally approved at the February 3, 2020 and March 2, 2020 City Council meetings. Therefore, these funds will be appropriated back to unassigned general fund balance. 14. Hurricane Harvey Buyout Lots, $202,096. Appropriate advance funding to demolish three homes through the Hazard Mitigation Grant Program and one home through the Texas Water Development Board Grant Program. These four properties were purchased through the grants. The funding source will be unassigned general fund balance and will be reimbursed once grant funding has been received from the State agencies. 2 of 3 15. Friendswood Lakes Boulevard, $935,902. Appropriate funding to pay a portion of the City's share for the Friendswood Lakes Boulevard inter -local agreement with Galveston County. The Friendswood Lakes Boulevard project is a joint project with Galveston County Bond Program. Funding from other sources will be used to pay for the current invoice totaling $935,902. With other funding now available, the remaining amount of $775,300 from the original reserve amount of $1,000,000 in the general fund can be released back to unassigned general fund balance. 16. Parks & Recreation Tool CAT Loader, $63,057. Appropriate capital lease proceeds to purchase a Tool CAT Loader and bucket. At the April 6, 2020 council meeting, Council approved the substitution to purchase the loader instead of the dump truck included in the FY 2019-2020 adopted budget. Originating Department: Administrative Services Degree of importance: Significant SUMMARY / ORIGINATING CAUSE By its nature, our budget is an estimate of the revenues and expenditures needed to accomplish the City Council and Staff goals for the year. Throughout the year events occur that require adjustments to the budget. These adjustments may be needed for various reasons, such as the recognition of extraordinary revenues or expenditures, new projects that are authorized by Council or providing funding for expenditures resulting from extraordinary events like natural disasters. As the need arises, items for budget appropriations are accumulated and then submitted for approval at the City Council meeting each month. The budget adjustments covered by this ordinance comprise the tenth set for fiscal year 2019- 2020. We have attempted to provide as much explanation of the adjustments as possible through two sets of exhibits. Exhibit A provides a narrative explanation of each budget amendment. Exhibit B provides the detail of each accounting transaction. Ordinance and exhibits are reviewed and approved by the City Attorney prior to inclusion on a City Council meeting agenda.
