ORDINANCE NO.2006-01 AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY CHANGING THE ZONING CLASSIFICATION OF A CERTAIN 2.0195 ACRE TRACT OF LAND LOCATED AT 3500 FM 528 FROM NEIGHBORHOOD COMMERCIAL ("NC") TO PLANNED UNIT DEVELOPMENT (PUD); PROVIDING FOR THE GRANTING OF A SPECIFIC USE PERMIT FOR USE OF SUCH PROPERTY FOR MINI-WAREHOUSE PURPOSES AND THE INCIDENTAL USE THEREOF FOR CARETAI�RS QUARTERS; PROVIDING CERTAIN CONDITIONS AND LIMITATIONS; PROVIDING FOR THE AMENDMENT OF THE CITY'S OFFICIAL ZONING MAP; PROVIDING OTHER MATTERS RELATING TO THE SUBJECT; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. * * * * * WHEREAS, Best Storage Friendswood L.P., is the owner ("Owner") of a 2.0195 acre tract of land, more or less, which tract is located within the corporate limits of the City and is presently zoned Neighborhood Commercial ("NC") pursuant to the City's Zoning Ordinance, as amended; and WHEREAS, the Owner has filed an application with the City requesting a change in the zoning classification of the 2.0195 acre tract, same being more particularly described in Exhibit "A" attached hereto and for all things made a part hereof, to Planned Unit Development (PUD) District, and has further applied for the issuance of a Specific Use Permit authorizing the use of said 2.0195 acre tract for Mini-Warehouse purposes, including the authority to use a portion of the tract for incidental caretakers quarters; and WHEREAS, the Planning and Zoning Commission and the City Council have conducted, in the time and manner required by law and the City's Zoning Ordinance, a public hearing on such requests; and WHEREAS, as a result of the said public hearing and the recommendation of the Friendswood Planning and Zoning Commission, the City Council finds that such use is not detrimental to the community, and is in conformance with the Zoning Ordinance; and WHEREAS, the Planning and Zoning Commission has recommended approval of the application and the City Council deems it appropriate to grant such request; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The zoning classification of that certain 2.0195 acre tract of land (hereinafter the "Property"), located at 3500 Farm to Market Road 528, same being Reserve "A," Block 1, of the Schultz Centre, as filed of record at F. C. No. 368038, Harris County Map Records, and same being more particularly described and depicted in Exhibit"A" attached hereto and for all things made a part hereof, is hereby changed, respectively, from Neighborhood Commercial District to Planned Unit Development (PUD) District. Section 3. A Specific Use Permit allowing use of the Property for Mini-Warehouse purposes, as well as the incidental use of the Property for Caretakers Quarters, subject to the terms and conditions set forth below, is hereby granted. Section 4. The Specific Use Permit granted hereby shall be subject to the following conditions: 1. The caretaker's residence shall be and remain incidental to the primary use of the facility as a self-storage mini-warehouse. 2. The caretaker's quarters shall be limited to one (1) residential structure containing not more than nine-hundred (900) square feet. 3. Not more than three (3) persons shall be permitted to reside in the caretaker's quarters at any one time. 4. The hanging of laundry outside the caretaker's quarters in a place visible from any adjoining property is prohibited. 5. The caretaker's quarters shall have not more than two (2) cars, both of which shall be in working condition, parked on the property at any one time. ORD 2006-01 2 6. Construction and use of facilities shall be in accordance with the application, including all plans attached thereto, all as set forth in Exhibit "B" attached hereto and made a part of this Ordinance for all purposes. Section 5. The Zoning District Map of the City of Friendswood shall be revised and amended to show (i) the designation of the Property as "Planned Unit Development," and (ii) the Specific Use authorized hereby for the Property, as provided in Sections 3 and 4 hereof, with the appropriate references thereon to the number and effective date of this Ordinance and a brief description of the nature of the changes. Section 6. Any person who shall intentionally, knowingly, recklessly, or with criminal negligence, violate any provision of this Ordinance, shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 7. In the event any clause,phrase,provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood,Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts.
