AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FRIENDSWOOD,TEXAS,
APPENDIX C — "ZONING," BY AMENDING THE ZONING
CLASSIFICATION TO ASSIGN SINGLE FAMILY
RESIDENTIAL (SFR) AS THE ZONING DISTRICT FOR
.1738 ACRES OF VACATED RIGHT-OF-WAY; AND TO
ALLOW A SPECIFIC USE PERMIT (SUP) FOR NAICS USE
#8131 RELIGIOUS ORGANIZATIONS AS AN OVERLAY
ON THE FOLLOWING PROPERTIES: .1738 ACRES OF
VACATED RIGHT-OF-WAY — SINGLE FAMILY
RESIDENTIAL (SFR); 111 E. HERITAGE DRIVE, 2.983

PROVIDING FOR AMENDMENT OF THE OFFICIAL
ZONING MAP; PROVIDING A PENALTY IN AN AMOUNT
NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION
OF ANY PROVISION HEREOF; AND PROVIDING FOR
SEVERABILITY.

WHEREAS, First Baptist Church of Friendswood is the Owner of the following tracts:
111 E. Heritage Drive — 2.983 acres Lot 1, Block 1 Final Plat of First Baptist Church of
Friendswood; 202 E. Heritage Drive —2.98 acres described as Lot 1, Block 2 Final Plat of First
Baptist Church of Friendswood; 209 S. Friendswood Drive— 1.0528 acres being a portion of Lot
2, Block 2 of the Friendswood Subdivision recorded in Plat Record 7, Map No. 20 of the
Galveston County Map Records, situated in the Sarah McKissick League, Abstract Number 151;
201 E. Heritage Drive - .4223 acres of land being all of that certain called Lot 1 of Harper
Subdivision, an unrecorded subdivision the Sarah McKissick Survey, Abstract No. 151; 204 and
206 E.Heritage Drive- .8151 acres of land,being all of that certain called.8151 acre tract of land,
conveyed by deed recorded under Galveston County Clerk's File No. 2007037162; 208 E.
Heritage Drive - .8913 acres of land being all of that certain called .9117 acre tract of land,
conveyed by deed recorded under Galveston County Clerk's File No. 2007037164; and vacated
right-of-way - .1738 acres out of Lot 1, in Block 2 of Friendswood Subdivision, a subdivision
according to the map or plat thereof recorded under Volume 254, Page 37, also known as an
unrecorded portion of E. Heritage Drive, all properties being located in City of Friendswood,
Galveston County, Texas, and identified as the `Property'; and
WHEREAS,the Planning and Zoning Commission and the City Council have conducted,
in the time and manner required by law and the City Code of Ordinances,public hearings on such
request, allowing all persons attending to be heard on the question of whether the changes of the
uses being requested would affect the public health, safety, or general welfare of the citizens of
Friendswood; and
WHEREAS, the Planning and Zoning Commission has filed its written report with City
Council, which recommends approval of the application, subject to any certain conditions made
the subject of said recommendation; and
WHEREAS, the City Council deems it appropriate to grant such request, subject to
applicable regulations, restrictions, exceptions and conditions; and
WHEREAS, City Council has determined that all public notices have been posted and
published, all required hearings on this matter have been held, and that this Ordinance complies

with the applicable provisions of the City Charter, City Code and all other applicable laws;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby
found to be true and correct and incorporated by reference, including the representations of
Applicant, (as referenced in its application for SUP),the final report from the Planning&Zoning
Commission, and the minutes of City Council, which City Council is specifically relying upon in
granting this SUP, as provided hereafter.
Section 2. The Friendswood City Code,Appendix C, "Zoning," Section 3, "Provision
for Official Zoning Map," is hereby amended, rezoning 'the Property' to assign Single Family
Residential (SFR) as the zoning district for .1738 acres of vacated right-of-way; and to allow a
Specific Use Permit (SUP) for NAICS Use #8131 Religious Organizations as an overlay on the
following properties: .1738 acres of vacated right-of-way—Single Family Residential(SFR); 111
E. Heritage Drive, 2.983 acres - Downtown District (DD); 209 S. Friendswood Drive, 1.0528
acres—Downtown District(DD); 201 E. Heritage Drive, .4223 acres -Multi-Family Residential-
Low Density (MFR-L); 204 and 206 E. Heritage Dr., .8151 acres — Single Family Residential
(SFR); 208 E. Heritage Drive, .8913 acres - Single Family Residential (SFR) , and to replace the
Specific Use Permit on the property located at 202 E. Heritage Drive, 2.98 acres - Single Family
Residential/Specific Use Permit (SFR/SUP 2001-09) for Family Life Center, to be governed for
all purposes and conditions as depicted in Exhibit "B," (all of which are incorporated by
reference),but otherwise consistent and subject to the current Zoning Code,and related conditions
contained herein. This Specific Use Permit is specifically conditioned upon Owner's full
compliance with the following use and development regulations:
1. Building Height:
The combined building height of the proposed sanctuary, ornamental tower, and ornamental cross
located at 111 E. Heritage Drive shall comply with the maximum height allowed within the
Downtown District(DD), as amended.
2. Alternative Landscaping:
The alternate landscape plan is approved. The landscaping shall be installed as depicted on page
SUP 2.10, Landscape Plan/Tree Survey/Mitigation Study.

3. Proposed Phasing:
The phasing is approved as part of the Master Plan for the church to guide 20+ years of future
development, and the expected timing or sequence of phases are subject to change based on the
church's need.
Phase 1 A June 2020 - Improvement and expansion of parking at the corner of 518/E.

Phase 1 B October 2020 -New Welcome Center Addition and South Church Expansion(111

Phase 2 Administration building renovation and expansion(209 S. Friendswood Dr.)
Phase 3 New storage building and parking (201 E. Heritage Dr.)
Phase 4 Church North expansion, interior renovation and adjacent site improvements (111
E. Heritage Dr.)
Phase 5 Removal of Building A and completion of education building expansion (111 E.
Heritage Dr.)
Phase 6 Family Life Center addition and adjacent parking expansion(202 E. Heritage Dr.)
Section 3. The Zoning Map of the City of Friendswood shall be revised and amended
to show the designation of the Property,as described and as provided in Section 2 above,with the
appropriate reference thereon to the number and effective date of this Ordinance, and a brief
description of the nature of the change.
Section 4. This Ordinance shall in no manner amend, change, supplement, or revise
any provision of any ordinance of the City of Friendswood, save and except the amendments
permitted herein of said Property as described in Section 2 hereof
Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or
provision hereof other than the part declared to be invalid or unconstitutional;and the City Council
of the City of Friendswood, Texas, declares that it would have passed each and every part of the
same notwithstanding the omission of any and every part of the same notwithstanding the omission

of any such part thus declared to be invalid or unconstitutional, or whether there be one or more
parts.
Section 6. Any person who shall willfully, intentionally, or with criminal negligence
violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be fined in an amount not to exceed $2,000.00. Each day of violation
shall constitute a separate offense.

1)Allow either or both Joseph Mitchell Wright and wife,Artha T.Wright,to live on
the property until they die or until they no longer wish to remain in the house. If,for
example,they wish to move into a place of assisted living;
2)Allow a member of the immediate family to occupy the trailer home on tract B-Two
(B-2) as long as either Joseph Mitchell Wright or Artha T. Wright are living in the
home. Occasional parking of RV allowed;
3)Life Interest Property to include both Tract B-Two(B-2)and Tract B-Three(B-3).
Privacy of Wright family to be protected;
4)The First Baptist Church of Friendswood to hold the title to the two(2) tracts of
land and be responsible for taxes;
5)At present there is a house on Tract B-Two (B-2) and a trailer home on Tract B-
Three(B-3). Improvements can be made as needed,but no additional living space is
to be added. Joseph Mitchell Wright to be responsible for appropriate insurance and
for all maintenance of the existing houses and improvements,plus any improvements
which may be made to the property;
6)First Baptist Church of Friendswood to be allowed to seek re-zoning of both tracts
to a category suitable for appropriate use by the church; and
7)First Baptist Church of Friendswood to be allowed to make limited improvements
to the property, such as paving, as long as they do not impair the Wright family's
access and use of the homes. Such improvements to be mutually agreeable to Grantor
herein and First Baptist Church of Friendswood. Specifically,it is likely that a paved
parking area will be added during the term of the Life Interest.
This restrictive covenant shall be a covenant running with the land and shall be binding on each of the
parties hereto and their heirs,executors,administrators,legal representatives,successor and assigns.
Grantor, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty, grants,sells, and conveys to Grantee the property,together with all and
singular the rights and appurtenances thereto in any wise belonging,to have and hold it to Grantee,
Grantee's legal representatives, heirs, executors, administrators, successors and assigns forever,
