HomeMy WebLinkAboutOrdinance No. 2020-10 ORDINANCE NO. 2020-10 AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 54, OFFENSES AND MISCELLANEOUS PROVISIONS, ARTICLE III., PROTECTION OF CITIZENS, EMPLOYEES, MUNICIPAL PROPERTY BY AMENDING SECTION 54-48 ENTITLED "INTERFERING WITH CITY OFFICERS AND EMPLOYEES";PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $500.00 FOR EACH VIOLATION; REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PUBLICATION AND AN EFFECTIVE DATE. * * * * * * * * * * * WHEREAS, the City Council of the City of Friendswood, Texas (the "City") is desirous of protecting its employees, visitors to the City, its citizens and municipal property; and WHEREAS, the City expects certain standards of conduct from its employees, and it has similar expectations that visitors and citizens will treat City employees in a like manner; and WHEREAS, the City Council wishes to make clear its intention to protect employees, finds and determines that the following amendment will promote the public health, safety and welfare of the employees and citizens of the City. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. That Chapter 54 of the Code of Ordinances entitled "Offenses and Miscellaneous Provisions",Article III., Protection of Citizens, Employees, Municipal Property,is hereby amended by amending Section 54-48, to read as follows: "Sec. 54-48.-Interfering with city officers and employees. (a) For the purposes of this section,an officer or employee includes any permanent or temporary employee of the City, interns, any work-study or educational program hires,the mayor, city council members and the members and alternate members of the boards, commissions and committees of the City. (b) No person shall carelessly or willfully interfere with, hinder or obstruct any officer or employee of the City who is engaged in,en route to or returning from the performance of official duties, whether such interference, hindrance or obstruction is by threat, assault, harassment or other behavior." Section 2. That a person who violates any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $500.00. Each day of violation shall constitute a separate offense. Section 3. That all other ordinances or parts of ordinances inconsistent or in conflict herewith are,to the extent of such inconsistency or conflict, hereby repealed. Section 4. That in the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood,Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Section 5. That this Ordinance shall become effective upon publication as required by the City Charter. PASSED AND APPROVED on first reading this 2nd day of March,2020.
