HELD ON MONDAY, FEBRUARY 3, 2020, AT 06:00 PM AT FRIENDSWOOD CITY HALL

5. WORK SESSION
A. Capital Improvement Projects and Drainage Update
Mayor Pro-Tem Branson opened the discussion regarding Capital Improvement Projects and
drainage update. Director of Engineering/City Engineer Jildardo Arias and Deputy Director of
Engineering Samantha Haritos presented a PowerPoint presentation regarding progress made on
Capital Improvement Projects and drainage since October 2019. Mr. Arias reported on Capital
Improvement Projects, 2018-2019 street maintenance program, 2019-2020 street maintenance
program, Blackhawk Boulevard Phase ll, city-wide traffic study, Lift Station No. 23, current Harris
County projects, and current Texas Department of Transportation (TxDOT) projects. Ms. Haritos
gave the drainage update regarding the coordination of partnering with other entities including
Harris County Flood Control District, Galveston County Consolidated Drainage District, Rice '
University Study, Galveston County, Houston-Galveston Area Council, and Lower Clear Creek and
Dickinson Bayou Federal Study (League City study). Staffs agenda is to continue identifying
partnership opportunities, procure up-to-date hydraulic and hydrology models, and currently working
with other departments to improve in-house mapping capabilities using Geographical Information
Systems (Arc-GIS). Short-term drainage projects include a project the city is partnering with
Galveston County Drainage District at Imperial Estates, Forest Bend Detention project funded by a
Community Development Block Grant— Disaster Recovery Grant for$3.5 Million, and the Clear
Creek Community Church (Whitcomb Property) terracing project. State Proposition No. 8 passed in
November 2018 providing $793 Million for a Flood Infrastructure Fund, and a possible opportunity
for the city to obtain free grant money for a large planning study such as a Master Drainage Plan.
Discussion took place between Mayor-Pro Tem, Council, and Staff regarding the $4 Million for
street repair projects are funded with sales tax dollars, Staff is investigating a pilot program for
pavement preservation, and Staff would like the city to have a representative on Houston-Galveston
Area Council's Flood Mitigation and Flood Control Committee.
With concurrence of Council, Mayor Pro-Tem Branson moved to Agenda Item 8, Special
Recognition and Acknowledgements.
6. CLOSED EXECUTIVE SESSION
A. Communications from the Public regarding Executive Session topics. '

8. Special Recognition and Acknowledgements
A. Platinum Scenic City Designation presented by Scenic Houston Finance Chair Derrick I
' Mitchell
Scenic Houston Finance Chair Derrick Mitchell stated it is his pleasure to present the Platinum
Scenic City Designation certificate to the City of Friendswood. The city has been recognized as one
of twenty-two Texas cities awarded as recipients through the City Certification Program. The city
made an impressive jump from the previous bronze status. Following the award, the city has
installed new "Certified Scenic City Platinum" signage at some of the main entrances into the city.
With concurrence of Council, Mayor Pro-Tem Branson moved to Agenda Item 12, Communications
from Committees and Special Reports.
9. Public Hearing
To receive comments from the public, both oral and written, regarding:
A. To review the City of Friendswood Infrastructure application for the Community
Development Block Grant- Disaster Recovery (CDBG-DR) funds for Hurricane Harvey l and
the allocation of$2,691,517 to the city for infrastructure projects. The U.S. Department of
Housing and Urban Development (HUD) allocated the State of Texas $5.024 Billion in
CDBG-DR funding through the Texas General Land Office (GLO). Of which, the HGAC has
developed a MOD to allocate more than $240 million of funding to local cities. I

oral and written, regarding to review the City of Friendswood Infrastructure application for the
Community Development Block Grant- Disaster Recovery (CDBG-DR) funds for Hurricane Harvey
and the allocation of$2,691,517 to the city for infrastructure projects. The United States

Fire Marshal Brian Mansfield explained that due to further assessment done on one of the
infrastructure projects, due to flood maps and other items, the city's application had to be changed.
The reason for another Public Hearing is the Texas General Land Office was gracious enough to
allow the city to make the requested change. Houston-Galveston Area Council (excluding Harris
County) has developed a Method of Distribution to distribute $240 Million in Community
Development Block Grant— Disaster Recovery funds for Galveston County cites devastated by
Hurricane Harvey. The City of Friendswood has been allocated $2,691,517 in infrastructure
projects. Staff is awaiting notice from Galveston County that the county has met the Low to
Moderate Income (LMI) requirement before proceeding. Projects would include flood control,
restoration of publicly owned infrastructure, demo or construction of public homes and commercial
buildings, and code enforcement.
Mayor Pro-Tem Branson asked if anyone would like to speak.
Phil Ratisseau, Friendswood resident, stated the Citizen Advisory Team has stayed together and
continues to be involved, this is an excellent opportunity for the city, and citizens should fully
support.

David Allen, Friendswood resident, addressed Council and stated he knows there is a lot of heavy
rollers in the room, provided a handout about the virus spreading in China, origin of the virus is in
Wuhan which has a biolab, is an engineered virus, can find info on www.newswars.com, there is a
biolab in Galveston, and read an article from 2005 regarding the opening of the University of Texas
Medical Branch Galveston Biolab.
11. City Manager's Report '
A. Keep Friendswood Beautiful Tree Giveaway Results

City Manager Morad Kabiri reported that the Annual Tree Giveaway sponsored by Keep
Friendswood Beautiful (KFB) was held at City Hall, on January 18, 2020. A total of 200 trees were
given away to Friendswood residents within 30 minutes and residents were lined up as early as
6:00 AM. The city appreciates the efforts of KFB and the city's Parks and Recreation Department
towards making this event a huge success.
B. Hurricane Harvey Update
The City Manager reported that Staff continues to move forward with the Hazard Mitigation Grant
Program buyout program. Since the January Council meeting, the city has partially closed on three
properties of the fourteen remaining in the program. Staff recently received word that Federal
Emergency Management Agency (FEMA) has obligated funding for the Texas Water Development
Board Flood Mitigation Assistance grant project to acquire four Severe Repetitive Loss Properties
along Clear Creek and Cowards Creek. Conditional approvals have been granted from the
Community Development Block Grant— Disaster Recovery Program for both the Blackhawk Facility
and the Forest Bend flood mitigation project. Staff is working toward the procurement of
professional services for architectural, engineering, and environmental activities associated with
these projects once Harris County Commissioners Court authorizes the city to proceed.
Applications through the Texas General Land Office on property acquisition/critical infrastructure are
still awaiting approval. United States Congressman Pete Olson and Randy Weber have been
contacted to enlist help with FEMA on all projects and initiatives.
' The City Manager reported that the City of Friendswood was recently recognized by Friendswood
Chamber of Commerce as the Business of the Year to recognize the City of Friendswood's 125th
Anniversary. The city appreciates the Chamber of Commerce and everyone involved in making
Friendswood what it is.
With concurrence of Council, Mayor Pro-Tem Branson moved to Agenda Item 13, Discussion and
Possible Action.
12. Communications from Committees and Special Reports
A. Annual Report from the Animal Shelter Advisory Committee
Animal Shelter Advisory Committee Chair Dr. Donald Stran presented the annual report from the
Animal Shelter Advisory Committee.
Mayor Pro-Tem Branson recessed the meeting at 6:58 PM, and reconvened the meeting at 7105
PM.

13. Discussion and Possible Action

with Coastal Bend Property Development, LP. and Contractor.

**Councilmember Scott moved to approve an Economic Development Agreement with Coastal '
Bend Property Development, LP. and contractor.
The motion was seconded and approved 6-0.
B. Discussion and possible action regarding approving an inter-local cooperation contract with
Texas Department of Public Safety Galveston County for Failure to Appear (FTA) Program
of the Friendswood Municipal Court.

14. Resolutions
Consideration and possible action regarding the following:
A. Resolution No. R2020-01: A resolution of the City Council of the City of Friendswood,
Texas, designating the Mayor as the City's representative in seeking eligible grant funds
under General Victim Assistance Direct Services Program; and authorizing the submission
of such grant application to the Criminal Justice Division of the Office of Governor.
**Councilmember Scott moved to approve Resolution No. R2020-01 —A resolution of the City '
Council of the City of Friendswood, Texas, designating the Mayor as the City's representative in
seeking eligible grant funds under General Victim Assistance Direct Services Program; and
authorizing the submission of such grant application to the Criminal Justice Division of the Office of
Governor.
The motion was seconded and approved 6-0.
B. Resolution No. R2020-02: A resolution of the City of Friendswood, Texas, authorizing aerial
spraying over Friendswood by the Galveston County Mosquito Control District for the
County-Wide Mosquito Control Program.

C. Resolution No. R2020-03: A resolution of the City Council of the City of Friendswood,
Texas, amending and replacing Resolution No. R2019-24 with this resolution; authorizing
and approving the 2018 Community Development Block Grant— Disaster Recovery (CDBG- '
DR); designating authorized officials and approving and implementing a citizen participation
plan.

Council of the City of Friendswood, Texas, amending and replacing Resolution No. R2019-24 with
' this resolution; authorizing and approving the 2018 Community Development Block Grant— Disaster
Recovery (CDBG-DR); designating authorized officials and approving and implementing a citizen
participation plan.
The motion was seconded and approved 6-0.
15. Ordinances
Consideration and possible action regarding the following:
A. Ordinance No. T2020-01: Second and Final reading of an ordinance repealing Ordinance
No. 97-20, Ordinance No. 2000-06, Ordinance No. 2003-17, that adopted and amended the
Municipal Court Building Security Fund and the Municipal Court Building Technology Fund.
**Councilmember Griffon moved to approve the Second and Final reading of Ordinance No. 2020-
01 —An ordinance repealing Ordinance No. 97-20, Ordinance No. 2000-06, Ordinance No. 2003-
17, that adopted and amended the Municipal Court Building Security Fund and the Municipal Court
Building Technology Fund.
The motion was seconded and approved 6-0.

B. Ordinance No. T2020-03: Second and Final reading of an ordinance amending Appendix B,
"Subdivision Ordinance," "Section III.k.3 — Sidewalks" to add exceptions to sidewalk
requirements for existing residential subdivisions; providing a penalty for violation in an
amount not to exceed $2,000, or as otherwise provided by law; repealing all ordinances or
parts of ordinances inconsistent or in conflict herewith; and providing for severability.
**Councilmember Rockey moved to approve the Second and Final reading of Ordinance No. 2020-
03 —An ordinance amending Appendix B, "Subdivision Ordinance," "Section I I I.k.3 — Sidewalks" to
add exceptions to sidewalk requirements for existing residential subdivisions; providing a penalty for
violation in an amount not to exceed $2,000, or as otherwise provided by law; repealing all
ordinances or parts of ordinances inconsistent or in conflict herewith; and providing for severability.
The motion was seconded and approved 6-0.
C. Ordinance No. T2020-04: Second and Final reading of an ordinance amending Appendix C
"Zoning Ordinance," "Sections 7. Schedule of District Regulations," "Section 7.5. Comr1 unity
Overlay District," and "Section 8. N. Downtown District Supplemental Requirements" to
change building material requirements per House Bill 2439; providing a penalty for violation
in an amount not to exceed $2,000, or as otherwise provided by law; repealing all
ordinances or parts of ordinances inconsistent or in conflict herewith; and providing for
severability.

D. Ordinance No. T2020-05: Second and Final reading of an ordinance amending Appendix C,

Zoning Map of the city, incorporating approved changes in district boundaries and other
matters portrayed on the Official Zoning Map; providing a penalty for violation in an amount

ordinances in conflict herewith; and providing for severability.
**Councilmember Griffon moved to approve the Second and Final reading of Ordinance No. 2020-
05 — an ordinance amending Appendix C, "Zoning," Section 3. 'Provision for Official Zoning Map," to
update and adopt the Official Zoning Map of the city, incorporating approved changes in district
boundaries and other matters portrayed on the Official Zoning Map; providing a penalty for violation
in an amount not to exceed $2,000, or as otherwise provided by law; repealing all ordinances or
parts of ordinances in conflict herewith; and providing for severability.

E. Ordinance No. T2020-06: First and Final reading of an ordinance of the City Council of the
City of Friendswood, Texas, calling for the holding of a General Election on May 02, 2020, '
for the purpose of electing two (2) Councilmembers (Position Numbers 2 and 5); ordering a
Runoff Election on June 13, 2020, if necessary; and making other provisions related to the
subject.
**Councilmember Hanks moved to approve the First and Final reading of Ordinance No. 2020-06 —
an ordinance of the City Council of the City of Friendswood, Texas, calling for the holding of a
General Election on May 02, 2020, for the purpose of electing two (2) Councilmembers (Position
Numbers 2 and 5); ordering a Runoff Election on June 13, 2020, if necessary; and making other
provisions related to the subject.
The motion was seconded and approved 6-0.
F. Ordinance No. T2020-07: First and Final reading an ordinance of the City Council of the City
of Friendswood, Texas, calling for the holding of a Special Election on May 02, 2020, for the
purpose of reauthorizing the local sales and use tax at the rate of three-eighths (3/8) of one
percent (1%) to continue providing revenue for maintenance and repair of municipal streets;
and making other provisions related to the subject.
**Councilmember Rockey moved to approve the First and Final reading of Ordinance No. 2020-07—
an ordinance of the City Council of the City of Friendswood, Texas, calling for the holding of a
Special Election on May 02, 2020, for the purpose of reauthorizing the local sales and use tax at the
rate of three-eighths (3/8) of one percent (1%) to continue providing revenue for maintenance and
repair of municipal streets; and making other provisions related to the subject.

G. Ordinance No. T2020-08: First reading of an ordinance granting to CenterPoint Energy
Resources Corp., DBA CenterPoint Energy Texas Gas Operations, the right, privilege and
franchise to construct, install, extend, remove, replace, abandon, operate and maintain' its
facilities within the public rights-of-way of the City of Friendswood, Texas, for the
transportation, delivery, sale and distribution of natural gas; providing for a term of 30 years;
containing other provisions relating to the foregoing subject; providing for severability and
providing an effective date.
**Councilmember Griffon moved to approve the First reading of Ordinance No. T2020-08 —An
ordinance granting to CenterPoint Energy Resources Corp., DBA CenterPoint Energy Texas Gas
Operations, the right, privilege and franchise to construct, install, extend, remove, replace, abandon,
operate and maintain its facilities within the public rights-of-way of the City of Friendswood, Texas,
for the transportation, delivery, sale and distribution of natural gas; providing for a term of 30 years;
containing other provisions relating to the foregoing subject; providing for severability and providing
an effective date.
The motion was seconded and approved 6-0.
H. Ordinance No. T2020-09: First and Final reading of an ordinance amending City of
Friendswood, Texas, Ordinance No. 2019-38, passed and approved October 7, 2019, same
being an ordinance approving and adopting the City's General Budget for Fiscal Year 2019-
2020 by approving "Budget Amendment III" to the "Original General Budget of the City iof
Friendswood, Texas, for the Fiscal Year 2019-2020"; providing for supplemental
appropriation and/or transfer of certain funds; providing for severability; and providing other
matters related to the subject.
**Councilmember Hanks moved to approve the First and Final reading of Ordinance No. 2020-09 —
an ordinance amending City of Friendswood, Texas, Ordinance No. 2019-38, passed and approved
October 7, 2019, same being an ordinance approving and adopting the City's General Budget for
Fiscal Year 2019-2020 by approving "Budget Amendment III" to the "Original General Budget of the
City of Friendswood, Texas, for the Fiscal Year 2019-2020"; providing for supplemental
appropriation and/or transfer of certain funds; providing for severability; and providing other matters
related to the subject.
The motion was seconded and approved 6-0.
16. Communications from-the Mayor and Councilmembers
Councilmember Erenwert thanked the Engineering Department for the reports given to Council
during the work session. The reports provided were very informative.
' Councilmember Hanks stated she recently attended a Keep Friendswood Beautiful committee
meeting, great group of volunteers that work hard for the city, recently received a grant from HEB
Grocery (HEB), $6,500 awarded from HEB's corporate office to enhance Stevenson Park with a
fairy trail, will be educational, people are building the fairy houses, each will have a different theme,

adults and children will be able to stop and look at them, will be unveiled and open to the public the
first part of June 2020. Councilmember Hanks congratulated Staff on the recognition of '
Friendswood Chamber Commerce Business of the Year, nice start to the celebration of 125 years.
Councilmember Rockey stated Friendswood Historical Society President Ann Whittaker is retiring
from the board, and a reception will be held in honor of Mrs. Whitaker on February 11, 2020, at 6:00
PM at the Friendswood Public Library. At the January Council meeting he mentioned a tripping
hazard in the parking lot at Stevenson Park, and noticed today it is being fixed. He has been cast in
another play called "August Osage County", plays a drunk poet, cast is outstanding, an adult play
with adult language, and encourages everyone to come see the play at the Purple Box Theater.
Mayor Pro-Tem Branson thanked her fellow councilmembers and city Staff for their support during
the meeting, stated the Mayor will be back in town tomorrow, and she is excited.
Councilmembers Griffon and Scott stated they had nothing to report.
17. Consent Agenda
Consideration and possible action regarding the following:
A. Ratify the Mayor's signature on a contract transferring ownership of retired K-9 Officer Ajay
from the Friendswood Police Department to Officer Brandon Blair
B. Approve the purchase of a vac-truck and skid steer for the Public Works Department '
C. Approving a Memorandum of Understanding (MOU) with Clear Creek Community Church to
define limits and perform drainage modeling of possible drainage project
D. Approving water line, sewer line, lift station, and drainage easements on FM 528 from Clear
Creek Community Church
E. Approving the disposal of two decommissioned police vehicles through Houston Auto
Auction
F. Approve the December 2019 Tax Report
G. Approving the minutes of the January 6, 2020, Council Meeting
**Councilmember Scott moved to approve all items on the Consent Agenda as presented: A. Ratify
the Mayor's signature on a contract transferring ownership of retired K-9 Officer Ajay from the
Friendswood Police Department to Officer Brandon Blair. B. Approve the purchase of a vac-truck
and skid steer for the Public Works Department. C. Approving a Memorandum of Understanding
(MOU) with Clear Creek Community Church to define limits and perform drainage modeling of

Councilmember Griffon asked to remove Consent Agenda Item C. Approving a Memorandum of
Understanding (MOU) with Clear Creek Community Church to define limits and perform drainage
modeling of possible drainage project.

contract transferring ownership of retired K-9 Officer Ajay from the Friendswood Police Department
to Officer Brandon Blair. B. Approve the purchase of a vac-truck and skid steer for the Public Works
Department. D. Approving water line, sewer line, lift station, and drainage easements on FM 528
from Clear Creek Community Church. E. Approving the disposal of two decommissioned police
vehicles through Houston Auto Auction. F. Approve the December 2019 Tax Report. G. Approving
the minutes of the January 6, 2020, Council Meeting.
The amended motion was seconded and approved 6-0.
**Councilmember Hanks moved to approve Consent Agenda Item C. Approving a Memorandum of
Understanding (MOU) with Clear Creek Community Church to define limits and perform drainage
modeling of possible drainage project.
The motion was seconded and approved 6-0.
With concurrence of Council, Mayor Pro-Tem Branson moved to Agenda Item 6, Closed Executive
Session.
