ORDINANCE NO. 2019-47
AN ORDINANCE AMENDING THE CODE OF
ORDINANCES, CHAPTER 82 — "TRAFFIC AND
VEHICLES," BY ADDING SECTION 82-10, REGULATING
HOURS OF MOVEMENT OF OVERSIZE VEHICLES AND
ADDING A DEFINITION FOR "OVERSIZE VEHICLE";
ADDING SECTION 82-11, PROHIBITING CERTAIN
OVERSIZE VEHICLES IN THE DOWNTOWN DISTRICT;
ADDING SECTION 82-12, REQUIRING PERMITTED
OVERSIZE VEHICLES TO CONTACT THE POLICE
DEPARTMENT AT LEAST 24 HOURS PRIOR TO
MOVEMENT OF AN OVERSIZED VEHICLE WITHIN THE
CITY; PROVIDING A PENALTY CLAUSE; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES
INCONSISTENT OR IN CONFLICT HEREWITH;
PROVIDING FOR SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS,the City Council of the City of Friendswood("Council")finds that it is in the
best interest of the public health, safety and general welfare to restrict travel of certain vehicles
utilizing FM 2351, FM 518 and FM 528; and
WHEREAS, oversized vehicles being moved through the City often cause two or more
lanes to be closed in one direction, thereby creating considerable traffic back up at the busiest
times of the day in the City; and
WHEREAS, the need for traffic control in the City of Friendswood, Texas is of such
importance to the safety of the residences of the City that regulation of timing of oversized vehicles
through the streets and roads in the City is necessary to reduce the interference with the regular
flow of traffic in the City; and
WHEREAS, imposing curfew movement restrictions on oversize vehicles preserve and
protect aesthetics, functionality and integrity of S. Friendswood Drive(FM 518 between FM 2351
and Winding Way), the City's Downtown District, and neighboring businesses and religious
properties; and
WHEREAS, the Friendswood Police Department must be informed of the movement of
oversized vehicles through the City at least 24 hours in advance of entering the city limits of the
City of Friendswood, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
Section 1. That the facts and matters set forth in the preamble of this Ordinance are hereby
found to be true and correct.
Section 2. That the City of Friendswood Code of Ordinances, Chapter 82 "Traffic and
Vehicles" is hereby amended by adding Sections 82-10 through 82-12 to read as follows:
Sec. 82-10.—Restrictions on hours of movement of certain oversize vehicles.
(a) In this section "oversize vehicle" means a vehicle or vehicle-trailer combination
that exceeds 14 feet in width, 14 feet in height, or 110 feet in length.
(b) No oversize vehicle may be operated on a public street within the city between the
hours of 6:00 a.m. to 9:00 a.m. or 3:00 p.m. to 7:00 p.m., Monday through Friday of any week.
The restriction on hours of movement within the city shall be a condition of any permit issued to
authorize the movement of oversize vehicles within the city.
Sec. 82-11.—Prohibiting certain oversize vehicles in the Downtown District.
It is unlawful for any person to operate any oversize vehicle exceeding 14 feet in height in
the designated Downtown District; specifically, between FM 2351 and Winding Way on FM 518
(S. Friendswood Drive)both northbound and southbound.
Sec. 82-12. —Requirement to notify law enforcement.
(a) Any permitted oversize vehicle entering the City of Friendswood must give notice
to the Friendswood Police Department at least 24 hours in advance.

(b) Notification is accomplished by calling the 24 hour non-emergency dispatch center
at 281-996-3300 and providing a contact name, contact phone number, estimated time of arrival
in the City and route permitted to travel.
Section 3. That any person who shall willfully, intentionally, or with criminal negligence
violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be fined in an amount not to exceed $2,000.00. Each day of violation
shall constitute a separate offense.
Section 4. That all ordinances or parts of ordinances in conflict or inconsistent with this
Ordinance are hereby expressly repealed.
Section 5. That in the event any clause, phrase, provision, sentence, or part of this
Ordinance or the application of the same to any person or circumstances shall for any reason be
adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect,
impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part
declared to be invalid or unconstitutional;and the City Council of the City of Friendswood,Texas,
declares that it would have passed each and every part of the same notwithstanding the omission
of any such part this declared to be invalid or unconstitutional,whether there be one or more parts.
Section 6. That this Ordinance shall become effective from and after its date of passage
and its publication, as provided by law.
