HELD ON MONDAY, DECEMBER 2, 2019, AT 05:00 PM AT FRIENDSWOOD CITY HALL

Mayor Foreman called the meeting to order.

Dwane Ruiz, Friendswood resident, addressed Council and stated he would like to request
Council pass an ordinance that would not allow parking along Leisure Lane, seeing a lot of right-
hand turns to bypass the intersection at FM 518 and FM 528, creating a one-lane street at best,
concerned ongoing activity at Virgata Commons is a parking issue for the neighborhood and
emergency vehicles access.
With concurrence of Council, Mayor Foreman moved to Agenda Item 813, Presentation of a
donation check from Scott Gordon and family to the City of Friendswood in Honor of Cole Gordon.
5. WORK SESSION
A. Comprehensive Plan
Mayor Foreman opened the discussion regarding the Comprehensive Plan. City Manager Morad '
Kabiri stated Council has previously discussed an update to the city's Comprehensive Plan at
Council retreats, and during this work session Community Development Director/City Planner
Aubrey Harbin will present to Council Staff's proposal on how to accomplish the update. Ms.
Harbin presented a PowerPoint presentation regarding the Comprehensive Plan. The purpose of
comprehensive planning is to improve the physical environment of the community as a setting for
human activity, promote public interest of the community at large, facilitate the democratic
determination and implementation of community policies on physical development, affect political
and technical coordination of community development, inject long range considerations into the
determination of short-range actions, and to bring professional and technical knowledge to bear on
the making of political decisions concerning the physical development of the community. State law
requires that cities have a comprehensive plan. The requirements for a comprehensive plan
include provisions on land use, transportation, and public facilities. The comprehensive plan can
be a single plan or a coordinated set of plans organized by the different categories. The plan is
used to coordinate and guide the establishment of development regulations. A comprehensive
plan should establish procedures for the adoption of the plan, establish procedures for
amendments to the plan, and establish the type of plan (map based, functional, policy, or
sector/neighborhood plans). Cities are allowed to determine the relationship between the
comprehensive plan and its development regulations. The City of Friendswood's current
Comprehensive Plan was last updated in 1998 and pieces of the Comprehensive Plan have been
updated overtime. The land use portion was updated in 2008, should be used to base zoning
decisions, approved zone changes should be amended on the map, identifies residential and '
commercial areas, and guides growth. The transportation portion was updated in 2018 and is
used as the city's major thoroughfare map. The public facilities portion was updated in 2010,
includes parks and recreation facilities and public buildings and facilities, portion is outdated and
wording needs to be updated, and does not include Centennial Park. A chart was shown

demonstrating the city's current Comprehensive Plan and updates that have been done. The
' city's Capital Improvement Plan, Downtown Improvement Plan, and City-Wide Traffic Study could
be included or referenced in the Comprehensive Plan. Staff is proposing for Staff to update the
basic information to get the Comprehensive Plan refreshed, and if needed in the future hire a
consultant to assist with new objectives and goals for the city, or add additional chapters to the
plan.
Discussion took place between Mayor, Council, and Staff regarding the consensus of Council was
for Staff to move forward with their proposal, and the next Council retreat will include a joint work
session with the Planning and Zoning Commission to discussion portions of the Comprehensive
Plan.
B. Police Department Extra Duty, Off Duty, Special Event Jobs
Mayor Foreman opened the discussion regarding Police Department extra duty, off duty, and
special event jobs. Friendswood Police Chief Bob Wieners presented a PowerPoint presentation
regarding the Police Department's extra job/off duty employment, and large special events. In the
current economic climate, off duty/extra employment among police officers has grown significantly,
particularly the demand for off duty police officers by outside employers. Private employers prefer
hiring off duty police officers over private security officers. The question of workers compensation
and liability coverage for incidents occurring during off duty employment is an issue. Ultimately,
coverage is determined based on the facts of each specific incident and if the officer was injured or
acted in the course of responding to a crime. Off duty response to a crime outside the' jurisdiction is not covered. Staffing at the police department combined with the increase in requests for off
duty/extra employment leave some off duty requests unfilled. This presents a significant problem
when events that have a city interest or are held at city owned facilities/parks and/or city
sponsored events do not have adequate coverage by Friendswood Police Officers. The benefits
of police department control of extra duty employment includes centralized control and
administration on the types of assignments permitted, staffing, scheduling and supervision, use of
equipment and clearly delineated officer duties and responsibilities. Police departments thatlhave
no direct control over secondary employment may run the risk of running up against the Fair Labor
Standards Act governing payment of overtime. If the officer has to use his law enforcement
powers, the time involved is considered "on the clock". The primary benefit to the city is the
increased police presence throughout the community at no expense to the city. City sponso fed
events currently funded in the Police Department budget include Fig Fest/car show, Halloween in
the Park, Christmas parade, Youth Sports parade, Fourth of July parade and fireworks,
Homecoming parade, Fall Haul, and Spring Sparkle. City sponsored events currently not funded
in the Police Department budget include Santa in the Park and Flap Jack Fun Run.
Discussion took plabe between Mayor, Council, and Staff regarding the consensus of Council was
if the required prerequisite number of officers is not obtained then officers will be required by!the
city to work and event holders would be required to cover the full weight of the cost. The current
hiring environment for officers is tough, department will be in a constant hiring mode, but are
currently staying ahead of the curve.

6. CLOSED EXECUTIVE SESSION
A. Communications from the Public regarding Executive Session topics. '
Mayor Foreman asked if anyone would like to speak regarding the Executive Session. No one
spoke.
B. Council may convene into Executive Session in accordance with the Texas Government
Code, pursuant to Section 551.071; Consultation with Attorney; to consult with its attorney
about pending litigation, Cause No. 18-CV-0108; Joseph Tostado v. City of Friendswood;
in the 122nd Judicial District Court of Galveston County, Texas, with possible discussion
and action related thereto in open session.
Council convened into Executive Session in accordance with Texas Government Code, pursuant
to Section 551.071 — Consultation with Attorney; to consult with its attorney about pending

8. Special Recognition and Acknowledgements ,
A. Presentation of the Five Star Spirit Award for the Third Quarter of 2019 to Kim Zrubek,
Library Reference and Adult Services Coordinator, Friendswood Public Library
City Manager Morad Kabiri presented the Five Star Spirit Award for the third quarter of 2019 to
Library Reference and Adult Services Coordinator Kim Zrubek with the Friendswood Public
Library. Ms. Zrubek was nominated by several residents and participants of the Apollo 50
Celebration for the outstanding job she did above and beyond her normal duties at the library. Ms.
Zrubek's actions truly embody the attributes of the Five Star Spirit Award being courteous,
competent, reliable, professional and enthusiastic. The city congratulates Ms. Zrubek on being the
recipient of the Five Star Spirit Award for the third quarter of 2019.
Library Reference and Adult Services Coordinator Kim Zrubek stated she accepts the award on
behalf of all the Friendswood Public Library Staff, thanked Harold and Carolyn Benson for their
efforts in the Apollo 50 Celebration event, and the 50th Splashdown Celebration Committee for
their vision.
With concurrence of Council, Mayor Foreman moved to Agenda Item 9, Communications from the
Public.
B. Presentation of a donation check from Scott Gordon and Family to the City of Friendswood '
in Honor of Cole Gordon
Mayor Foreman expressed his condolences to Scott and Heather Gordon on the death of their son

Cole Gordon.
' Scott Gordon stated his family is blessed to live in the City of Friendswood, expressed their
appreciation for the city's compassion, the family wanted to do something to honor their son Cole
Gordon, and there is a lot of love and compassion in Friendswood. As a token of their familyl's
appreciation, Mr. Gordon presented a check to the city to cover expenses for exterior lighting for
City Hall and the flags in front of Stevenson Park.
City Manager Morad Kabiri stated over the past years the Parks and Recreation Department has
purchased various shades in plastic to cover the exterior lights outside City Hall to honor various
events. Recently, with the Gordon family contribution, LED lights were installed, and the color can
be changed by using a remote control as opposed to Staff individually changing the lights. The
city appreciates the Gordon family donation, and expresses condolences for the loss of their'son.
With concurrence of Council, Mayor Foreman moved to Agenda Item 5A, Comprehensive Plan.

10. City Manager's Report
A. Fall Haul Numbers
City Manager Morad Kabiri reported that the Keep Friendswood Beautiful Annual Fall Haul-A Day
had great attendance this year with 670 cars and trucks come through and participate in the
cleanup event. Waste Connections was reported to have hauled away 80 tons of garbage and
waste. A total of 9,300 plus pounds of electronics was collected for e-cycling, 18 bags of trash
picked up along FM 518, and 309 pounds of clothes were donated to Simple Recycling. Thel,
garage sale was also a success bringing in a little under$1,000 with all proceeds benefiting the
beautification of city facilities and parks. The items that were left over were taken to
' Goodwill. The Bay Area Wildlife Rehab picked up animal habitat items that were donated to
benefit the injured wild animals that make their home in Friendswood's green space. We want to
thank our Keep Friendswood Beautiful volunteers, our city Staff and Waste Connections for
making this great event possible.

B. Upcoming Holiday Events
The City Manager reported on the upcoming Community Holiday Events. Keep Friendswood '
Beautiful will host the Annual Downtown Holiday Lighting Contest, businesses are encouraged to
decorate for the holidays with lights and decor so everyone can enjoy the festive look of downtown
before and after the night of the parade and Santa in the Park. Judging will end on December 12,
2019, with the winners being announced in multiple categories during the evening program at
Santa in the Park. An exciting event is the 12th Annual Santa in the Park—"There's no place like
home for the holidays," sponsored by HomeTown Bank of Friendswood on December 14,
2019. There will be live musical entertainment, photos with Santa, a snow hill slide, carnival rides,
a petting zoo, and a Holiday Market with more than 70 booths. Following the lighting of the
Christmas tree, there will be a spectacular fireworks display synchronized to Christmas
music. The Friendswood Public Library will remain open during the annual Christmas parade to
provide access to restrooms and viewing of the parade from inside the building. On December 16,
2019, from 6:30 to 8:00 PM the library will host pictures with Santa and craft time. The Library
Book Sale will begin December 14, 2019, and will run through December 21, 2019, during regular
library hours. All proceeds from the book sale will go towards supporting library
programming. The library will also host a New Year's Eve Party for families on December 31,
2019, at 11:45 AM. Come celebrate with a dance party and a ball drop count-down at noon.
C. City of Friendswood Fairy Trail Grant for Keep Friendswood Beautiful
The City Manager reported that the plan for a nature-driven Friendswood Fairy Trail just got a little '
more magical, thanks to the award of a grant by H-E-B Grocery through Keep Texas Beautiful to
local volunteer organizations. Keep Friendswood Beautiful (KFB) is one of the 12 organizations
that will receive a portion of$25,000 aimed to help fund educational and programmatic projects
related to sustainability, recycling, litter prevention, beautification, or water conservation. Keep
Texas Beautiful calls the award a "Green Bag Grant". The City of Friendswood's share will be
$1,500. The fairy houses will be made of recycled or natural materials discarded locally. They will
be hidden or built in trees or other not so obvious places. Children will have access to a map with
an approximate location of the houses and legend with the name and background of each
character featured.
D. Hurricane Harvey Update
The City Manager reported Staff continues to move forward with the Hazard Mitigation Grant
Program buyout program. Site visits and appraisals have been completed for properties included
in the grant, and Staff is still awaiting final reports. Applications through the Texas General Land
Office on property acquisition/critical infrastructure are still pending. United States Congressmen
Pete Olson and Randy Weber have been contacted to enlist help with the Federal Emergency
Management Agency (FEMA) on all projects and initiatives. Staff met with representatives from '
Harris County Flood Control District to begin projects soon on the Harris County side of
Friendswood. Mayor Foreman, Mayor Pro-Tem Branson, and Staff met with Galveston County
Consolidated Drainage District regarding extending the current Clear Creek project to complete all
of Clear Creek from FM 528 to FM 2351.

12. Discussion and Possible Action
A. Discussion and possible action regarding disposition of Bid Number 2019-05 Lift Station
No. 23 (located at 2101 S. Friendswood Drive) Reconstruction
**Councilmember Rockey moved to approve the disposition of Bid No. 2019-05 for Lift Station No.
23 (located at 2101 South Friendswood Drive) reconstruction and award to R&B Group, Inc.
The motion was seconded and approved unanimously.
B. Discussion and possible action regarding disposition of Bid Number 2019-06 for 2019,
2020 Street Maintenance Program
**Councilmember Branson moved to approve the disposition of Bid No. 2019-06 for 2019-2020
Street Maintenance Program and award to Angel Brothers Enterprises.
The motion was seconded and approved unanimously.
C. Discussion and possible action regarding reappointments to the following boards and
commissions:
• Investment Committee to reappoint members Robert Bozka and Alan Rasmussen to
3 year terms expiring November 2022
• Keep Friendswood Beautiful to reappoint Tim Anderson, Patricia Steinke, Jeff
Smith, Susan Stephens, Shawn Potter and Ashley Mannschreck to 3 year terms
expiring November 2022
• Senior Citizens Advisory Committee to reappoint members Mona Palmer, Dori
Ochoa and Charlene Mizener to 3 year terms expiring November 2022
**Councilmember Branson moved to approve the reappointment of Robert Bozka and Alan
Rasmussen to the Investment Committee with terms to expire November 2022, reappointme it of
Tim Anderson, Patricia Steinke, Jeff Smith, Susan Stephens, Shawn Potter and Ashley
Mannschreck to Keep Friendswood Beautiful with terms to expire November 2022, and
reappointment of Mona Palmer, Doris Ochoa and Charlene Mizener to the Senior Citizens
Advisory Committee with terms to expire November 2022.
The motion was seconded and approved unanimously.

13. Resolutions

A. Resolution No. R2019-35: A resolution of the City of Friendswood, Texas, declaring
December 03, 2019, as Cline Elementary School Day in the City of Friendswood, Texas. '
**Councilmember Hanks moved to approve Resolution No. R2019-35—A resolution of the City of
Friendswood, Texas, declaring December 03, 2019, as Cline Elementary School Day in the City of
Friendswood, Texas.
The motion was seconded and approved unanimously.
Mayor Foreman introduced the Friendswood Student Education Outreach program and stated the
program would be continued at this meeting with Cline Elementary. The outreach program was
created to help students learn more about democracy and understand the value of community
service. Council wishes to support and foster leadership development in students.
Mayor Foreman thanked the teachers from Cline Elementary and Friendswood Independent
School District for participating in the program. The Mayor introduced the second graders that
would take Council's place on the dais, Mayor Kennedy Crites, City Secretary Faith Foreman, City
Attorney Vincent Ford, City Manager Brynn Hanks, Council Position No. 1 Brielle De La Fuente,
Council Position No. 2 Gavin Stanford, Council Position No. 3 Jack Mann, Council Position No. 4
Emily Hoffman, Council Position No. 5 Trenton Hustak, Council Position No. 6 Carter Hunter,
Council Position No. 7 Abigail Hrach, and Council Position No. 8 Ena Brunette.
Mayor Foreman turned the meeting over to the Cline Elementary students. '
Mayor Foreman stated refreshments would be served in the foyer.
Mayor Foreman announced that Council would convene into Executive Session after refreshments
were served for Cline Elementary.
Mayor Foreman recessed the meeting at 6:11 PM, and reconvened the meeting at 7:00 PM.
With concurrence of Council, Mayor Foreman moved to Agenda Item 6, Closed Executive
Session.
B. Resolution No. 2019-36: A resolution of the City Council of the City of Friendswood, Texas,
Galveston/Harris Counties casting 102 votes for electing person(s) to the Galveston
Central Appraisal District Board of Directors for 2020-2021.
**Councilmember Hanks moved to approve Resolution R2019-36 —A resolution of the City Council
of the City of Friendswood, Texas, Galveston/Harris Counties casting 102 votes for electing Don
Gartman to the Galveston Central Appraisal District Board of Directors for 2020-2021.
The motion was seconded and approved unanimously.
C. Resolution No. 2019-37: A resolution of the City Council of the City of Friendswood, Texas, '
Galveston/Harris Counties casting its ballot for the election of a person to the Board of
Directors of the Harris County Appraisal District for 2020-2021.

Consideration and possible action regarding the following:
A. Ordinance No. T2019-41: (Title: Second and Final reading of an ordinance amending Sec.
30-84 and Sec. 30-118 of the Code of Ordinances pertaining to the International Fire Code
and Life Safety Code, respectively) An ordinance amending the Code of Ordinances,
Chapter 30, Fire Protection and Prevention, by amending Section 30-84 entitled
"International Fire Code Adopted; Amendments" and amending Section 30-118 entitled
"Life Safety Code Adopted"; providing for severability and an effective date.
**Councilrriember Griffon moved to approve the Second and Final reading of Ordinance No. 2019-
41 —An ordinance amending the Code of Ordinances, Chapter 30, Fire Protection and Prevention,
by amending Section 30-84 entitled "International Fire Code Adopted; Amendments" and
amending Section 30-118 entitled "Life Safety Code Adopted"; providing for severability and an
effective date.
' The motion was seconded and approved 6-1 with Councilmember Scott opposed.
B. Ordinance No. T2019-42: (Title: Second and Final reading of an ordinance amending the
zoning classification for a tract or parcel containing 43.0673 acres of land, more or less,
being a portion of a called 194.21 acre tract described as Tract "A" as conveyed to
Yellowstone Hill Country Ranching, LLC, in Clerk's File Number 2010059686 of the
Galveston County Deed Records, Galveston Countv, Friendswood, Texas, along the future
Friendswood Lakes Boulevard, as more fully described herein, to change Single Family
Residential (SFR) to Multi Family Residential — Garden Home District (MFR-GHD)) AN
ordinance amending the Code of Ordinances of the City of Friendswood, Texas, Appendix
C —"Zoning," by amending the zoning classification for a tract or parcel containing 43.0673
acres of land, more or less, being a portion of a called 194.21 acre tract described as Tract
A as conveyed to Yellowstone Hill Country Ranching, LLC, in Clerk's File Number
2010059686 of the Galveston County Deed Records, Galveston County, Friendswood,
Texas, along the future Friendswood Lakes Boulevard; amending the zone classification
from Single Family Residential (SFR) to Multi Family Residential — Garden Home District
(MFR-GHD); providing for amendment of the Official Zoning Map; providing a penalty in an
amount not to exceed $2,000 for each day of violation of any provision hereof; and

C. Ordinance No. T2019-43: (Title: Second and Final reading of an ordinance amending
Chapter 86, "Utilities" of the Code of Ordinances of the City of Friendswood by amending
Sections 86-30 through 86-34, amending the Water Conservation Plan; and providing
other matters relating to the subject) An ordinance of the City of Friendswood amending
Chapter 86, Utilities, Sections 86-30 through 86-34; amending the Water Conservation
Plan for the City of Friendswood to promote responsible use of water; providing a
severability clause; providing a penalty for each day of violation of any provision hereof;
providing for the disconnection of water service for noncompliance with the provision of
Water Conservation Plan; and providing an effective date.
**Councilmember Branson moved to approve the Second and Final reading of Ordinance No.
2019-43 —An ordinance of the City of Friendswood amending Chapter 86, Utilities, Sections 86-30
through 86-34; amending the Water Conservation Plan for the City of Friendswood to promote
responsible use of water; providing a severability clause; providing a penalty for each day of '
violation of any provision hereof; providing for the disconnection of water service for
noncompliance with the provision of Water Conservation Plan; and providing an effective date.
The motion was seconded and approved unanimously.
D. Ordinance No. T2019-44: (Title: Second and Final reading of an ordinance adopting the

**Councilmember Rockey moved to approve the Second and Final reading of Ordinance No.
2019-44—An ordinance amending the Code of Ordinances of the City of Friendswood, Texas,
Chapter 14, Building and Building Regulations by adopting the 2018 International Building Code,

E. Ordinance No. T2019-46: (Title: First and Final reading of an ordinance adopting Budget
Amendment I to the Original General Budget of the City for Fiscal Year 2019-2020 to
provide for supplemental appropriation and/or transfer of certain funds) An ordinance
amending City of Friendswood, Texas, Ordinance No. 2019-38, passed and approved
October 7, 2019, same being an ordinance approving and adopting the City's General
Budget for Fiscal Year 2019-2020 by approving "Budget Amendment I" to the "Origina
General Budget of the City of Friendswood, Texas, for the Fiscal Year 2019-2020';
providing for supplemental appropriation and/or transfer of certain funds; providing for
severability; and providing other matters related to the subject.
**Councilmember Scott moved to approve the First and Final reading of Ordinance No. 2019;46 —
An ordinance amending City of Friendswood, Texas, Ordinance No. 2019-38, passed and
approved October 7, 2019, same being an ordinance approving and adopting the City's General

and Vehicles, by regulating hours of movement of oversize vehicles on certain streets) An
ordinance amending the Code of Ordinances, Chapter 82 — "traffic and vehicles," by adding
Section 82-10, regulating hours of movement of oversize vehicles and adding a definition
for "oversize vehicle'; adding Section 82-11, prohibiting certain oversize vehicles in the
Downtown District; adding Section 82-12, requiring permitted oversize vehicles to contact
the police department at least 24 hours prior to movement of an oversized vehicle within
the city; providing a penalty clause; repealing all ordinances or parts of ordinances
inconsistent or in conflict herewith; providing for severability and an effective date.

15. Communications from the Mayor and Councilmembers '
Mayor Foreman wished everyone a Merry Christmas, and stated Santa in the Park is December
14, 2019, come out and see Santa ride down the sled hill and watch fireworks. The next Council
meeting will be January 6, 2020, due to the National College Championship game on January 13,
2020.
Councilmember Erenwert thanked Mayor Foreman for starting the Friendswood Student Outreach
program, and stated it is a fun experience and hopes Council will continue the program for many
years to come.
Councilmember Griffon wished everyone a Merry Christmas and stated his birthday is Christmas
Day. He announced that the Texas Land Office is hosting a Houston Public Hearing for the state
action plan on how to distribute $4.297 Billion in Community Development Block Grant Mitigation
Funds.
Councilmember Hanks wished everyone Happy Holidays, and stated she believes the city is going
in the right direction.
Councilmember Branson wished everyone a Merry Christmas and Happy Holidays, and stated the
annual Friendswood Historical Society tree lighting at the Brown Museum is on December 3,
2019. The Friendswood Independent School District's museum will host a tree lighting on '
December 11, 2019. There are a lot of upcoming holiday events throughout the city.
Councilmembers Rockey and Scott stated they had nothing to report.

A. Approving the disposal and replacement of Emergency Medical Service Ambulance No. 49
B. Approving the partial closure of Castlewood, Cedarwood Drive, Spreading Oaks,
Woodlawn, W. Heritage, and Laurel Drive for an extended period of time for the City's
Flapjack Fun Run
C. Accepting the October 2019 Property Tax Report
D. Approving the minutes of the November 4 and November 18, 2019, City Council Meetings.
