ORDINANCE NO. 2019-41 AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CHAPTER 30, FIRE PROTECTION AND PREVENTION,BY AMENDING SECTION 30-84 ENTITLED "INTERNATIONAL FIRE CODE ADOPTED;AMENDMENTS" AND AMENDING SECTION 30-118 ENTITLED "LIFE SFETY CODE ADOPTED"; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. * * * * * * * * * * WHEREAS, the City Council of the City of Friendswood, Texas (the "City") seeks to promote the public health, safety, morals and general welfare of the municipality and the safe, orderly and healthful development of the City; and WHEREAS,the City Council finds that it is in the City's best interest to amend the Code of Ordinances, Chapter 30, Fire Protection and Prevention by adopting the 2018 Editions of the International Fire Code and the Life Safety Code; and WHEREAS, the City Council finds and determines that the following amendment will promote the public health, safety and welfare of the citizens of the City. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. That the foregoing recitals are hereby found to be true and correct and are hereby adopted by the City Council and made a part hereof for all purposes as findings of fact. The City Council hereby further finds and determines that the rules,regulations,terms,conditions, provisions and requirements of this ordinance are reasonable and necessary to protect the public health, safety and welfare of the citizens of the City. Section 2. That Chapter 30 of the Code of Ordinances entitled "Fire Protection and Prevention" is hereby amended by amending Section 30-84,to read as follows: "Sec. 30-84.—International Fire Code adopted; amendments. Sec. 30-84. - International Fire Code adopted; amendments. The International Fire Code, 2018 Edition, including appendices B through N, Excluding J, as published by the International Code Council, Inc., an authentic copy of which has been filed with the city secretary, is hereby adopted and made a part of this division, except as follows: (1) Section 101.1 is hereby amended to read as follows: 101.1 Title. These regulations shall be known as the Fire Code of the City of Friendswood, Texas, hereinafter sometimes referred to as "this code." (2) Section 108 is hereby amended to read as follows: 108 Board of appeals. The city zoning board of adjustment and appeals shall act as the fire and life safety code board of adjustment and appeals. (3) Section 110.4 is hereby deleted in its entirety. (4) Section 508.5.1 is hereby amended to read as follows: 508.5.1 Where required. Where a portion of the facility or building hereafter constructed or moved into or within the jurisdiction is more than 300 feet from a hydrant on a fire apparatus access road, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains shall be provided where required by the code official. (5) Section 903.2 is hereby amended to read as follows: `903.2 Where required Approved automatic sprinkler systems in new buildings and structures shall be provided in the locations described in this section, when the gross square footage of the building or structure exceeds 11,999 square feet, or when the area under one roof is capable of having two or more floors above or below grade with any one floor exceeding 5,999 square feet. (6) Section 5001.7 is hereby amended to read as follows: Section 5001.7. Required Specialized Engineered Plans. All group H occupancies shall be designed with the assistance of an engineer specializing in fire protection, licensed in the State of Texas. Section 3. That Chapter 30 of the Code of Ordinances entitled "Fire Protection and Prevention" is hereby amended by amending Section 30-118, to read as follows: "Sec. 30-118.—Life Safety Code adopted. Ord No.2019-41 2 Sec. 30-118. - Life Safety Code adopted. The 2018 Edition of the Life Safety Code, including all appendices thereto, as published by the National Fire Protection Association, Inc., an authentic copy of which has been filed with the city secretary, is hereby adopted and made a part of this division, except as follows: Section 24.3.5.1. is deleted from Chapter 24, One- and Two-Family Dwellings, Extinguishment Requirements. Section 4. In the event any clause phrase,provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Section 5. This ordinance shall become effective from and after its date of passage in accordance with law. PASSED AND APPROVED on first reading this 4th day of November,2019.
