HomeMy WebLinkAboutOrdinance No. 2005-29 (Title: An ordinance providing that ad valorem tazes imposed by the City on residential homestead of person who is disabled or a person 65 years of age or older may not be increased while such homestead remains the residence homestead of that person or that person's spouse) ORDINANCE NO.2005-29 AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS ESTABLISHING A LIMITATION ON TAXES IMPOSED BY THE CITY ON THE RESIDENTIAL HOMESTEAD OF A PERSON WHO IS DISABLED OR A PERSON WHO IS 65 YEARS OF AGE OR OLDER; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR IN CONFLICT HEREWITH. * * * � * WHEREAS, at an election held on September 13, 2003, the voters of the State of Texas adopted Proposition 13,which added Section 1-b(h)to Article VIII of the Texas Constitution; and, WI�REAS, Proposition 13 authorizes certain political subdivisions, including cities, to limit the total amount of ta��es that may be imposed on the residential homestead of a disabled person or a person who is 65 years of age or older; and, WHEREAS, the procedure for adopting the limitation is established by Section 11.261 of the Texas Tax Code; and, WHEEREAS, the City Council of the City of Friendswood believes that such limitation as authorized by Proposition 13 and Section 11.261 of the Texas Tax Code should be adopted by the City;now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. That the City of Friendswood hereby adopts the properiy ta�c limitation authorized by Article VIII, Section 1-b(h), Texas Constitution(Proposition 13) and Section 11.261, Texas T� Code, on the residential homestead of a person who is disabled or a person who is 65 years of age or older. Section 2. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence,or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts. Section 3. All ordinances or parts of ordinances in conflict or inconsistent herewith are, to the extent of such conflict or inconsistency,hereby repealed.
