HomeMy WebLinkAboutResolution No. 2019-25 RESOLUTION NO. R2019-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,TEXAS,PROVIDING FOR THE ADMINISTRATION OF A BOND ELECTION. WHEREAS, by an ordinance adopted by the City Council (the "Council") of the City of Friendswood (the "City") on August 12, 2019 (as such ordinance may be subsequently amended, the"Bond Election Ordinance"),the Council has deemed it advisable to call a bond election in the City on November 5, 2019 (the "Election"); and WHEREAS,the Election is subject to the provisions of Section 43.004(b), Texas Election Code (the "Code"), which requires that the City share voting locations on election day with Galveston County and Harris County (the "Counties"), and the City is authorized by the Code to also share voting locations for early voting with the Counties; and WHEREAS,the City has determined that it is in the best interest of its citizens and voters to contract with the Galveston County Clerk, acting as the elections administrator for Galveston County (the "Galveston County Election Administrator"), pursuant to an election services agreement (the "Galveston County Election Services Agreement"), to provide for the administration by the Galveston County Election Administrator of the election in Galveston County; and WHEREAS, the City has determined that it is in the best interest of its citizens and voters to contract with the Harris County Clerk, acting as the elections administrator for Harris County (the "Harris County Election Administrator"), pursuant to an election services agreement (the "Harris County Election Services Agreement"), to provide for the administration by the Harris County Election Administrator of the election in Harris County; and WHEREAS,the election shall be conducted as a joint election with Galveston County and Harris County to serve the voters of the City that reside in the respective Counties, and with other political subdivisions in the respective County under the authority of Chapter 271, Texas Election Code, and/or Chapter 31, Texas Election Code, and in accordance with the Galveston County Election Services Agreement and the Harris County Election Services Agreement; and WHEREAS, it is hereby officially found and determined that the meeting at which this Resolution was adopted was open to the public, and public notice of the time, place, and purpose of the meeting was given, all as required by the Texas Government Code, Chapter 551. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. The statements contained in the preamble of this Resolution are true and correct and are hereby adopted as findings of fact and as a part of the operative provisions hereof. Section 2. The Council hereby approves the respective Election Services Agreement with Galveston County and Harris County and authorizes the Mayor or City Manager to sign and deliver such agreements on behalf of the City. Section 3. The appointment of the Presiding Election Judges, Alternate Presiding Judges and Early Voting Clerks and Deputy Early Voting Clerks for the designated polling places for the Election shall be made by the respective Election Administrator in accordance with the respective Election Services Agreement. Section 4. All resident, qualified electors of the City shall be entitled to vote at the Election. Section 5. Notice of the Election shall be given by posting and publication, and the Bond Election Ordinance shall be posted, at the times and in the places required by law. The City, its employees, contracting parties and any other agents having duties and responsibilities with R2019-25 2 respect to the Election shall, to best of their ability carry out their duties and responsibilities and the Election shall be conducted in substantial compliance with the Code.
