ORDINANCE NO. 2019-27
AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FRIENDSWOOD,TEXAS,
CHAPTER 34 PROVIDING FOR ADOPTION OF THE
"FLOOD INSURANCE STUDY FOR GALVESTON
COUNTY, TEXAS, AND INCORPORATED AREAS" (FIS)
AND FLOOD INSURANCE RATE MAP (FIRM) FOR
GALVESTON COUNTY,TEXAS,DATED AUGUST 15,2019;
PROVIDING A PENALTY OF AN AMOUNT NOT TO
EXCEED $2,000 FOR EACH DAY OF VIOLATION
HEREOF; AND PROVIDING FOR SEVERABILITY.

WHEREAS,the City of Friendswood understands that a Flood Insurance Study(FIS) and
Flood Insurance Rate Map (FIRM) have been completed for our community, specifically
Galveston County; and
WHEREAS, the City of Friendswood understands that the FIS and FIRM will become
effective for Galveston County on August 15, 2019; and
WHEREAS, the City of Friendswood understands that by the FIS and FIRM effective
date, the Department of Homeland Security's Federal Emergency Management Agency (FEMA)
Regional Office is required to approve the legally enforceable floodplain management measures
that our community adopts in accordance with Title 44 Code of Federal Regulations Section
60.3(d); now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. That Section 34-24 of the Code of Ordinances of the City of Friendswood,
Texas, is amended to read as follows:
Section 34-24. Basis for establishing the areas of special flood hazard.
The areas of special flood hazard identified by the Federal Emergency
Management Agency in a scientific and engineering report entitled, "The Flood
Insurance Study for Galveston County, Texas and Incorporated Areas," dated
August 15, 2019, with accompanying Flood Insurance Rate Map and Flood
Boundary-Floodway Maps (FIRM and FBFM), "The Flood Insurance Study for
Harris County, Texas and Incorporated Areas," dated January 6, 2017, with
accompanying Flood Insurance Rate Maps and Flood Boundary-Floodway Maps
(FIRM and FBFM) and any revisions thereto, and "The Flood Insurance Study for
Harris County, Texas and Incorporated Areas," dated June 18, 2007, with
accompanying Flood Insurance Rate Maps and Flood Boundary-Floodway Maps
(FIRM and FBFM) and any revisions thereto, are hereby adopted by reference and
declared to be a part of this Ordinance.
Section 2. Any person who shall knowingly, willingly, or with criminal negligence
violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction, shall be fined in an amount not to exceed $2,000.00. Each day of violation shall
constitute a separate offense.
Section 3. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or
provision hereof other any part or provision hereof other than the part declared to be invalid or
unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the omission of any and every part
of the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, or whether there be one or more parts.
