R2019-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, REQUESTING GOVERNOR ABBOTT TO VETO HOUSE BILL 2439. * * * * * * * * * * WHEREAS, House Bill 2439 will prohibit city governments from regulating or limiting building products and materials for both new construction and alterations for both residential and commercial buildings that differ from those approved for use by the national model code; and WHEREAS, this bill also prohibits city governments from establishing a standard for a building product,material or aesthetic method in construction if the standard is more stringent that a standard in the national model code; and WHEREAS, our current Zoning Ordinance does not allow metal, wood or cement fiber board buildings in the following commercial zoning districts — Community Shopping Center (CSC),Neighborhood Commercial (NC), Office Park District (OPD); types of building materials are also limited in Business Park(BP)and Downtown District(DD). Additionally,the Downtown District(DD)includes fenestration requirements, and the Community Overlay District(COD) and Downtown District (DD) only allow earth tone colors; and WHEREAS, if HB 2439 is signed into law, all of these Ordinances will be invalid; and WHEREAS, the national model building codes are even less stringent than local zoning ordinances and do not take into consideration aesthetics, quality, longevity, and economic impacts on a city, and deregulation of exterior building materials, especially for commercial buildings, would be detrimental to our City. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. That the facts and matters set forth in the Preamble of this Resolution are hereby found to be true and correct. Section 2. That the City Council of the City of Friendswood, Texas, hereby requests Governor Abbott veto HB 2439. Section 3. That the City Council has found and determined that the meeting at which this Resolution is considered was open to the public and that notice thereof was given in accordance with the provisions of the Texas Open Meetings Act, Texas Government Code, Chapter 551, as amended and that a quorum of the City Council was present. Section 4. That the City Secretary is hereby authorized and directed to cause a certified copy of this Resolution be immediately sent to Governor Abbott. Section 5.
