ORDINANCE NO. 2019-21 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2018-28, PASSED AND APPROVED OCTOBER 1, 2018, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2018-2019 BY APPROVING "BUDGET AMENDMENT VII" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2018- 2019"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. * * WHEREAS, by Ordinance No. 2018-28, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2018-2019"; and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2018-2019; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2018-2019," is hereby amended for municipal purposes as shown on "Budget Amendment VII" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2018-2019" attached hereto. Said Budget Amendment VII shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and"B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Library Donations, $1,528. Appropriate funds received from book sales and donations to the Library department. The funds will be appropriated to the Library operating equipment and supplies budget to be used in fiscal year 2019. 2. Police Investigation Funds, $3,873. Appropriate funds from the Police Investigation Fund (PIF) to purchase four tarp covers for the LMTV Units. The funding source will be the Police Investigation Fund unassigned fund balance. 3. Public Works Vehicle Unit 87, $3,277. Appropriate funds to cover the additional cost of replacing Unit 42. At the April 1, 2019 meeting, Council approved using Vehicle Replacement Funds to purchase the new vehicle Unit 87 which will replace Unit 42. The cost of the replacement vehicle was more than appropriated from the VRP. The funding source will be from the Vehicle Replacement Fund balance. 4. Public Works Facility Evaluation, $30,000. Appropriate funds for services to perform structural engineering services for the storm damage and cost evaluation of the City of Friendswood's Public Works facility located at 1306 Deepwood. The funding source will be spilt equally from the unassigned General Fund balance and Water and Sewer Working Capital. The funds will be appropriated into the Facility Operations division contract services account. 5. Police Department Body-Worn Cameras and In-Car Solution, $269,176. Appropriate funds to replace and purchase body-worn cameras and vehicle in-car cameras. At the April 1, 2019 Council meeting, Council approved the replacement and purchase of equipment. Funding will be appropriated from several sources. Funding of$85,000 will come from the Federal Asset Forfeiture Fund, $141,316 from Unassigned General Fund Balance, and $8,400 from the Police Department Patrol division operating equipment. Also $15,000 from the Vehicle Replacement Fund balance will be appropriated. Three of the most recently purchased cameras from L-3 Mobile Service will be returned and a refund of$15,000 is expected to be received in which the reimbursement will be appropriated back to the Vehicle Replacement Fund balance. In addition to the equipment, a server will be purchased to host the new system. The cost of the server of$19,460 will be covered by the existing Police Department contingency account and transferred into the capital operating account within the Patrol division to purchase the server. 6. Flood Vulnerability Study, $10,000. Appropriate additional funding to conclude the Flood Vulnerability Study undertaken with Rice University. The Study developed a drainage model of the Clear Creek Watershed in Friendswood and was a critical component of the Drainage Subcommittee's effort. The funding source for the expense will be unassigned General Fund Balance. Please note a future request Ord 2019-21 Exhibit A Exhibit A Page 2 will also be made to allocate funds on an ongoing basis to maintain the model to analyze potential flood mitigation projects.
