HomeMy WebLinkAboutResolution No. 82-01 �,.�� �. m RESOLUTION N0. � ' - A RESOLUTION SUSPErdDING THE CHANGE IN RATES FOR ELECTRIC SERVICE WITHIN THE CITY OF FRIENDSWOOD, TEXAS , PROPOSED BY TEXAS-rIEW MEXICO POWER COPM- PANY, TO BECOME EFFECTIVE JANUAP.Y 26 , 1982 . � � �: WHEREAS , on December 22 , 1981 , Texas-rlew Mexico Power Company filed a Statement of Intent to change its rates for electric service within the City of Friendswood, Texas , and has requested that said changes become effective on January 26 , 1982 ; and WHEREAS, Texas-New Mexico Power Company has filed revised Tariff Schedules , together with statements specifying each pro- posed change, a rate filing package, and supporting testimony; an d WHEREAS , Section 17(a) of the Public Utility Regulatory Act , Article 1446 , Texas Revised Civil Statutes , gives the governing body of each municipality exclusive original juris- diction over electric rates within its municipal boundaries ; and WHEREAS , Section 43 (d) of the Public Utility Regulatory Act authorizes the governing body� of any municipality acting as a regulatory authority to suspend the operation of any pro- posed change in rates for a period not to excee�d 120 days beyond the date on which the scheduled rates would otherwise go into effect, which period may be further extended for �an additional 30 days ; and WHEREAS , the proposed rate changes of Texas-New Mexico � Power Company and the material supporting those changes require comprehensive evaluation and study, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, r�- STATE OF TEXAS : Section 1 . The changes in rates for electric service with- in the City of Friendswood, Texas , proposed by Texas-New Mexico Power Company to become effective on January 26 , 1982 ,, should be and they are hereby, suspended for a period of 120 days beyond said proposed effective date, until May 26 , 1982 , subject ta an additional suspension of up to 30 days beyond May 26 , 1982 , upon further resolution of the City Council. Section 2. That the City Secretary be , and she is hereby , directed to forward a certified copy of this Resolution to Texas- New Mexico Power Company.
