HomeMy WebLinkAboutResolution No. 84-04 RESOLUTION N0. 84-R-4 A RESOLUTION SUSPENDING THE CHANGE IN RATES FOR ELEC- TRIC SERVICE WITHIN T'HE CITY OF F�IENDSWOOD, TEXAS , PROPOSED BY TEXAS-NEW MEXICO POWER COMPANY,TO BECOME EFFECTIVE FEBRUARY 21 , 1984. �r * * � * WHEREAS , on January 13, 1984, Texas-New Mexico Power Company, filed a Statement of intent to change its rates fox electric service within the City of Friendswood , Texas , and has requested that said changes become effective on February 21, 1984; and WHEREAS, Texas-New Mexico Power Company has filed revised Tariff Schedules , together with statements specifying each pro- posed change, a rate filing package, and supporting testimony; and WHEREAS , Section 17 (a) of the Public Utility Regulatory Act, Article 1446c, Texas Revised Civil Statutes , gives the governing body of each municipality exclusive original juris- diction over electric rates within its municipal boundaries ; and WHEREAS, Section 43(d) of the Public Utility Regulatory Act authorizes the governing body of any municipality acting as a Regulatory Authority to suspend the operation of any proposed change in rates for a period not to exceed one hundred twenty (120) days beyond tbe date on which the schedule rates would otherwise go into effect , which period may be further extended for an additional thirty (30) days ; and WHEREAS, the proposed rate changes of Texas-New Mexico Power Company and the material supporting those changes require comprehensive evaluation and study, now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Sect.ion l. The changes in rates for electric service within the City of Friendswood, Texas , proposed by Texas-New Mexico Power Company to become effective on February 21 , 1984, should be and they are hereby, suspended for a period of one hundred twenty (120) days beyond sai�l proposed effective date, until June 20, 1984, subject to an additional suspension of up to thirty (30) days beyond June 20, 1984, upon further resolu- tion of the City Council. 3ection_ 2, That the City Secretary be, and she is here- by, directed to forward a certified copy of this Ordinance to Texas-Ne°� Mexico Power Company.
