R 87-4A A RESOLUTION ORDERING AN ELECTION TO BE HELD ON THE 4TH DAY OF APRIL, 1987 , FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF FRIENDSWOOD, TEXAS, A PROPOSITION REGARDING CONSTRUCTION OF A NEW CITY I�iALL; PROVIDING THAT SUCH PROPOSITION IS NON-BINDING; STATING THE PROPOSED PROPOSITION; DESIGNATING THE POLLING PLACES AND APPOINTING ELECTION ` OFFICIALS ; DIRECTING THE GIVING OF NOTICE; AND � PROVIDING OTHER MATTERS RELATING TO THE SUBJECT. * � � �r � BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, � STATE OF TEXAS : Section 1 . It is hereby ordered that an election be held in the City of Friendswood , Texas , on the 4th day of April, 1987, at which there will be submitted to the resident qualified voters of the City a non-binding proposition regarding a proposal to construct a new City Hall . Such proposition shall be as follows : CITY HALL PROPOSITION 1. SHALL THE CITY OF FRIENDSWOOD CONTINUE IN IT ' S EFFORTS TO CONSTRUCT A NEW CITY HALL? 2. WOULD YOU SUPPORT THE CITY OF FRIENDSWOOD INCURRING DEBT, IF NECESSARY, TO PAY FOR THE NEW CITY HALL? Section 2. That said election shall be held in each of the election precincts within said City and the polling places and election offic�als for each of said precincts shall be as follows : Election Precinct 56: Boundaries the same as that portion of Galveston County election Precinct 56 lying within the City limits of the City of Friendswood . Pollin� Place: Water District Improvement Office 5006 Pennystone Friendswood, Texas Election Officers : Janis Fuss Presiding Judge Phyllis Mi�dleton � Alternate Presi ng u ge The City Secretary is hereby authorized and directed to provide a copy of this Ordinance to each judge as written notice of the appaintment as required by Section 32.009 of the Texas Election Code. Each Presiding Judge shall have the authority to appoint no more than three (3) qualified voters as clerks to assist in the holding of said election, but in no event shall the Presiding Judge appoint less than two (2) clerks . Section 3. Ms . Delor_is McKenzie, City Secretary, is hereby appointed clerk for absentee voting ; appointments of deputy clerks for absentPe voting by the City Secretary shall be in accordance with Section 83.031 et seq, of the Texas Election Code and the: -2- City Hall 109 Willowick Friendswood, Texas 77546 is hereby designated as the place for absentee voting for said election. Said clerks shall keep said office open for at least nine (9) hours , that is , from eight o 'clock (8:00) a.m. until fiv� o' clock (5: 00) p .m. , on each day for absentee voting which is not a Saturday, a Sunday, or an official state holiday, beginning on the twentieth (20th) day and continuing through the fourth (4th) day preceding the date of said election. Said clerks shall not permit anyone to vote absentee by personal appearance on any day which is not a regular working day for the clerk' s office, and under no circumstances shall they permit anyone to vote absentee by personal appearance at any tirae when such office is not open to the public. The above- described place for absentee voting is also the absentee clerk' s mailing address to which ballot applications and bal- lots voted by mail may be sent . The absentee voting clerk, in accordance with the provisions of the Texas Election Code, shall maintain a roster listing e�ch person who votes absentee by personal appearance and each person to whom an absentee ballot to be voted by mail is sent . The roster shall be maintained in a form approved by the Secretary of State. Section 4. R. J. Blanken hereby appointed as Presiding Judge of the Absentee Ballot Board. In accordance with Section 87 .001 , et seq, of the Texas Election Code, said presiding judge shall appoint at least two (2) other members to said board, and shall procpss absentee voting results in accordanc� with said Texas Election Code. Section 5. That said election shall be held in accordance with the Constitution and Laws of the State of Texas , and all duly qualified resident electors of the City of Friendswood , Texas , shall be entitled to vote. -3- Section 6. The City Secretary is hereby authorized and directed to furn�sh all necessary election supplies to conduct such election. Section 7 . That the ballot of said election shall conform to the requirements of the Election Code of the State of Texas, as amended, and on such bal].ot shall appear the proposition set forth above in Section 1 , with the provision on such ballot permitting voters to vote "For" or "Against" such proposition. Such proposition shall provide as follows : CITY HALL PROPOSITION SHALL THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, IMPLEMENT THE PROPOSAL TO CONSTRUCT A NEW CITY HALL, TO BE LOCATED AT 910 SOUTH FRIENDSWOOD DRIVE, UTILIZING AVAILABLE FUNDS. Section 8. The voting at such election shall be upon voting machines . The manner of indicating on the voting machine ballot the proposition here ordered to be submitted, and the provision for the indication and registration by the voters upon such machines of their vote for or agains� the proposition shall be substantially as hereinafter provided. The abov� stated proposition shall appear on the voting machine ballot . Immediately opposite such proposition and immediately opposite two respective corresponding voting levers , there shall appear the words "For" and "A�ainst . " A voter desiring to vote for the proposition shall depress or turn down the voting lever so that an "X" appears opposite the word "For," and a voter desiring to vote against the proposition shall depress or turn down the voting lever so that an "X" appears opposite the word "Against . " Provided further that absentee voting at such election shall be by paper ballot . Such paper ballot shall have printed upon it the proposition hereinabove stated ; and i.mmediately beneath or alongside the statement of the proposition there shall appear the words "For" and "Against ." A voter desiring to vote for the adoption of -4- the proposition shall place an "X" in the square opposite the word "For" where it appears immediately below or beside the statement of the proposition; and a voter desiring to vote against the the adoption of the proposition sha11 place an "X" in the square opposite the word "Against" where it appears immediately below or beside the statement of the proposition. Section 9. Notice of this election shall be given in accordance with the provisions of the Texas Election Code and returns of such notice shall be made as provided for in said Code. The Mayor shall issue all necessary orders and writs for such election, and returns of such election shall be made to the City Secretary immediately after the closing of the polls . Section 10. Said election sha11 be held in accordance with the Texas Election Code and the Federal Voting Rights Act of 1965, as amended.
