R88-16 A RESOLUTION CANVASSI�IG THE RETURNS ANP DECLARING THE RESULTS OF A SPECIAL ELECTION HELD IN THE CITY OF FRIENDSWOOD, TEXAS, ON MAY 7, 1988, RELATING TO THE AUTHORITY OF THE CITY COUNCIL TO DISCONTINUE THE USE OF TWO TRACTS OF LAND WITHIN THE CITY AS PUBLIC PARKS. s'c � � �'c x �'c WHEREAS , a special election was held in the City of Friendswood, Texas, on May 7, 1988, at which a proposition relatin�; to tfie authority of the City Council to discontinue the use of two tracts of land witk�in the c�ty as public parks was submitted to the duly qualified, resident electors of the City for their action thereon; and WHEREAS , there were cast at said special election 2, 840 votes, of which number there were cast : PARK LAND PROPOSITION FOR THE PARK LAND PROPOSITION. . . . . . . . . . . . . . . 1335 votes AGAINST THE PARK LAND PROPOSITION. . . . . . . . . . . 727 votes MAJORITY FOR THE PARK LAND PROPOSITION. . . . . . 608 votes ancl WAEREAS , the above and foregoing totals are shown in the official election returns of said special election heretofore submitted to the City Council and filed with the City Secretary ; and WHEREAS , said special election was called and held in all respects under and in strict conformity with the Constitution and laws of the State of Texas and of the United States ; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS : Section 1. The matters and facts set forth in the preamble of this Resolution are hereby found to be true and correct. Section 2. The special elPCtion held in the City of Friendswood, Texas , on May 7, 1988, which is more fully described in the preamble of this Resolution, was called and notice thereof was given in accordance with law. Only qualified, resident electors of the City voted in the special election; returns of the special election have been lawfully made by the proper officials ; the special election has resulted favorably to the Park Land Proposition authorizing the City Council to discontinue the use of two tracts of land within the City as public parks , with more than a majority of the qualified voters voting at the special election having voted in favor of the Park Land Proposition submitted at such special election. Section 3. The City Council is hereby authorized to discontinue use of that certain 0. 826 acre tract of lan�, more or less, located adjacent to Lot l, Block 9, Dunbar Estates Section 2, out of Abstract 20, Perry and Austin League, as recorded at Record ��15, Map 54, Recording No. 96523, Galveston County, Texas, and that certain 0. 7286 acre tract of land, more or less, located adjacent to Lot l, Block l, Dunbar Estates Section 1 , out of Abstract 20, Perry and Austin League , as recorded at Vol. 10, page 79, Recordin� No. 415173, of the map records of Galveston County, Texas, as City parks. Section 4. It is hereby found and determined that the NOTICE OF MEETING, relating to the regular meetin� of the City Council at which this Resolution was resolved, and heretofore posted by the City Secretary, and the posting thereof, was proper and said notic� and posting are hereby authorized, approved, resolved, ratified, and confirmed.
