A RESOLUTION REQUESTING THAT DAN MORALES,
ATTORNEY GENERAL OF THE STATE OF TEXAS,
FILE A MOTION WITH FEDERAL JUDGE WILLIAM
WAYNE JUSTICE TO RAISE THE 95o INMATE
CAPACITY RESTRICTION IN TEXAS PRISONS.
* * * * * * * * * * *
WHEREAS, the State of Texas is experiencing an alarming
increase in the amount of violent crime; and
WHEREAS, prisons in the State of Texas are restricted to a
95% inmate capacity limit; and
WHEREAS, due to the 95o inmate capacity limit, a large
number of convicted felans are being released fram Texas
prisons before completing their sentences in order to comply
with the limit; and
WHEREAS, it has been clearly demonstrated that convicted
felons who are released before the completion of their
sentence commit additianal crimes; and
WHEREAS, complying with this 95� inmate capacity limit the
citizens of the State of Texas are becoming mare fearful for
the loss of their lives and/or their praperties due to early
releases from Texas prisons; and
WHEREAS, federal prisons and the prisons of other States
are allowed to operate under a 120� capacity limit;

NOW, THEREFORE BE IT RESOLVED that the Friendswood City
Council request that Attarney General Dan Morales file a
motion with Federal Judge William Wayne Justice and take all
other appropriate action to raise the 95� capacity limit on
Texas prisons in order to ensure that convicted felons serve
their entire sentence.
